February 18, 1957, reading of the Minutes was dispensed with and approved

The Manager congratulated the Command Group of the Fire Department, consisting of
thirteen Captains and one Battalion Chief, upon the completion of a comprehensive
training course in administrative leadership and fire suppression, which was takex

This being the date set for the continued hearing on the amendment application of
John L. Nobles, for the reclassification of au irregular shaped parcel of land con-
taining 6.83 acres on the east side of King Street between 9th and 10th Streets,
from R-1 to R-3 District, three persons stood in protest for the reason that the
reclassification would devaluate their properties. The applicant spoke in favor
of the reclassification. Councilman Heinly disqualified himself on the amendment
application of John L. Nobles. On motion of Cou~c~lm~ Jerome, seconded by Mark~l

This being the date set for the continued hearingsthe amendment application of B.L.
Metcalf was considered for the ~eclassification of property located on the west si~
of North Main Street, beginning at a point 270' north and 216' west of the northeast
corner of the intersection of Owens Drive and North Main Street, thence north
485.63', thence west to the Santa Ana Freeway, thence southeasterly along the Santa
Ana Freeway to a point due west of the point of beginning, from the R-1 and R-2
Districts to C-2- District.
_Three property owners inquired as to the street
plan for the shopping center. Mr. Gladstone, on behalf of the applicant, stated a
60' street would be considered-and a street at the north end of the property would
be of no benefit, but the subdivider would de~icate 30 feet if Bullock's would
dedicate 30 feet,fo? a service road on the southerly side of the property. On

was introduced, considered and placed on file for second reading.
This being the date set for the continued hearing,the amendment application of
Orange County Development Company was considered for the reclassification of
property located on the north side of Wilshire Avenue just west of Bristol Street,
with a frontage of 1022.02' on Wilshire Avenue and a depth of approximately 271.92'
from R-1 to C-1 and R-3 Districts. Numerous persons stood in protest. Ken
1313 South Poplar Street~ presented a petition, containing approxfmately seventy
names of persons protesting the reclassification. ~r. Pruitt stated the protes:
tants feel this is merely carrying on the old issue and they are in favor of the
continuance of the R-1 District on the north side of Wilshire Street. C.W.Hester,
on behalf of the applicant, stated the property is probably better suited for an
R-1 District, although a portion should be R-3 and C-1 District on Bristol Street
to a depth of 240'. On motion of Councllmun Heinly, seconded by Jerome and car-
ried, the petition ~as received and filed. It was moved by Councilman Heinly~
seconded by Jerome and carried, that the Attorney be instructed to prepare an
Ordinance providing for a C-1 District for a distance of 200' on Wilshire Avenue
and 270' on Bristol Street, and the balance of the property to be R-1 District.

A tabulation of bids w~s presented by the Manager for the construction of nine

On rec~ndation of the Munnger and on motion of Councilman Jerome, seconded by
Narkel and carried, the bid of R.L.Steinmetz, in the s~m of $3,570.00 was accepted
and the other bid rejected.
The Chief of Police presented a merit certificate and a cash award to Sergeant
James Daniel Comber, of the E1 Toro Marine Base, who was the outstanding driver of
the ~nth in the Santa Aha Safe Driving Campaign.
Conm~mication was read fr~m the Plauning Commission reccmmending denial of variance
application of Marianne Whelan to permit construction of a single-family dwelling
on rear part of tot at P-17 South Baker Street, in addition to single-family
aud duplex existing on front part of the lot. The applicant spoke in favor of the
application and said the lot has a 240' frontage. It was moved by Councilman
Jerome.and seconded by Markel that the recommendation of the Planning Commission
be approved and the variance denied.

to permit construction of one-story sixteen-unit medical building, together with
pharmacy and fountain, on property at 119 Edgewood Road, in R-1 District, subject
to condition of the Commission and the further condition of the Depar'~ment of
Public Works.
On motion of Counc~lm~n M~rkel, seconded by Heinly and carried, the recommendation
of the Planning Commission was approved and the variance application, as amended,
of Ramona Ey O'Keefe and Patricia Ey ;;~wris granted to permit construction of a
concrete building at 901, 903, 905, 907, ~0~ and 911 Bush Street, for barber shop,
dress shop, sporting goods shop, advertising agency and restaurant, subject to con-
ditions of the Commission and the further conditions of the Department of Public
Works.
On motion of Councilman Jerome, seconded by Heinly and carried, the recommendation
of the Planning Commission was approved and the variance of George E. Callens
granted to permit construction and occupancy of a one-story, professional-type
building, approximately 55' x 57', on property at 1415 South Broadway, with deleti~
of the side-yard requirement on north side of building, space to be provided for o~
street parking for 13 to 15 cars, as shown on plot plan, the building to be used fo~
one firm of Accountamts and one firm of Attorneys.
On motion of Councilman Heinly, seconded by Markel and carried, the recommendation
of the Planning Co~g~ission was approved and the variance of Amron Development
Company granted to permit establishment of temporary sales office and erection of
nineteen temporary directional signs, to advertise new houses in new trac~s, locate¢
at Halladay Street between Beverly Place and Myrtle Street, subject to conditions
as imposed by the Corem1 ssion.
On ~otion of Councilman Heinly, seconded by Markel and carried, the recommendation
of the Planning Corem1 ssion was approved and the variance of Donal K. MacKenzie
granted to permit establishment and operation of a photographic ~wkroom and office
for a photographic service, in existing building on property at 208 South Sycamore
Street, subject to conditions as imposed by the Commission and the Department of
Public Works.
Communication was read from the Planning Commission recommending denial of variance
application of Dr. Jerome J. Krueger to permit construction of a medical office
building, 41'6" x 50', consisting of office space for the applicant and for one
other doctor, with six off-street parking spaces, on property at the southwest
corner of the intersection of Flower Street and Washington Avenue. It w~s moved
by Counci~m~n Heinly, seconded by Markel and carried, that a Resolution be adopted
granting the variance subject to conditions as imposed by the Department of Public
Works and the further condition that the plot plan, as submitted with the applicati

This being the date set for' the continued hearing of protests on assessments in the
proceeding known as "Vehicle Parking District No. l", the Clerk read the Attorney's
report dated February 27, 1957, reference the proceeding to be followed. On
of Councilm~ Heinly, seconded by Markel and carried, the report was received and
filed. Attorney Willis J. Clemens, representing The Church of the Messiah pro-
tested the amount of the assessment on the basis of the benefit derived and stated
that business establishments derive the greatest amount of benefit from the parking
lot; the method of assessment is arbitrary and suggested that the assessment in the
sum of $2,253.25 be revised for the Church. Attorney Roy Giordane, representing
The First Congregational Church, requested that the assessment be reduced as the
Church derives no benefits from the parking lot as the parishioners use the parking
lot directly across the street on Sundays or for other Church meetings and rec
that the matter be reconsidered. Attorney John N. Stanley, representing Katherine
and George Dryer, protested the nn~easonableness of the assessment on his clients.
It was moved by Councilman Heinly, seconded by Jerome and carried, that the protest
of Katherine and George Dryer be denied. It was moved by Councilman Helnly,
by Jerome and carried, that the protest of Roy J. Lyon be denied. It was moved by
Counc~lm~u Heinly, seconded by Markel and carried, that the protest of Esther
MacFarlane and protest of Josiah S. Talcott be denied. It was moved by Counc~lma~

and carried, that the assessments on the three Churches be reduced to one-third of
the present assessment, ~the assessment on the Telephone Company property be reviewed
for possible adjustment and all others be adjusted accordingly.

League is planning to erect a Clubhouse on the City property near the Santa Aha
River and requesting a reclassification, by the City, from the R-2 to the R-3 Distri.

license payment fee in the amount of $550.00 accepted and agreement covering
improvements was ordered signed.
On motion of Counc~lm~ Heinly, seconded by Markel and carried, Map of Tract No.
~l~l, submitted by ~,met C. Rogers, for the dedication of eleven lots on Westwood
Avenue and Santa Clara Avenue and bond in the sum of $8,300.00 were approved,
license pa2ment fee in the amount of $550.00 accepted and agreement covering

On motion of Cou~cilm~ Heinly, seconded by Markel and carried, Tentative Map of

three lots, was approved, subject to the conditions as set forth by the Department

On motion of Counc~m~ Reinly, seconded by Markel and carried, Tentative Map of
Tract No. 3217, submitted by Industrial Enterprises, Inc., of property located on
the east side of Kllson Drive, south of Dyer Road, and consisting of seven lots,
was approved, subject to certain corrections and eliminations of statements as
shown on the map.
On motion of Councilman Heinly, seconded by Markel and carried, Tentative Map of
Tract No. 3210, submitted by W. D. Greschner Company, of property located on the
east side of McClay Street between Warren and McFadden ~treets, and consisting of
twenty lots, was approved, subject to conditions as imposed by the Department of
Public Works.
Communications were read from Nathan Rubaloff advising that a part of Tentative
Tract No. 2494, will not be subdivided, which is approximately 84' x 500', and is
a part of the Walnut Street extension, and suggesting that Mr. Fred Woslum grant to
the City a deed, without cost. Mm-. Rubaloff offered to negotiate for the removal
of the water well, on the property, without cost, providing the City will make
certain improvements. On motion of Councilman Neinly, seconded by Markel and car-
ried, the communications were received, filed and referred to the M~ager to study
the matter with Mr. Rubaloff.
It was moved by Councllmeu Heinly, seconded by M~rkel and carried, that amended
escrow instructions be approved and signed with Mildred L. Kenyon, for property on
North Bristol Street.
It was moved by Counc~m~u Heinly, seconded by Markel and carried, that escrow
instructions be approved and signed with Ernest C. Wilson et ux, for the purchase
of 4.686 acres of property Immediately east of Prentice Park on Main Street, Tustin
for park pmrposes, and the Director of Finance instructed to issue warrant for the
sam of $32,500.00.

On motion of Counc~lm~n Heinly, seconded by Markel and carried, it W~s recnmmended
to the P]~ing Ca-mission that the Civic Center area be extended to include Van

On motion of Councilman Markel, seconded by Heinly and carried, the request of
American Cancer Society, Orange County Branch, for permission to solicit funds
April 8th through April 20th, 1957, was granted.
On motion of Counc~m~n Mark~l, seconded by Heinly and carried, the request of Blue
Star Mothers of America, for permission to solicit funds May 3rd, 1957, was granted.
On motion of Councilman Helnly, seconded by Markel and carried, the r~quest of Jack
Fisher Chapter No. 23, Disabled American Veterans, for permission to solicit funds
and to conduct a Baby Show, was granted.
Coemmu~ication was read fr~n F. E. Carter, owner of property at ll20 Russell Avenue,
protesting the condition of Russell Avenue between Shelton and Rosewood Streets,
and on motion of Councilman Markel, seconded by Heinly and carried, the matter was
referred to the Department of Public Works for report.
Communication was read from Attorney Robert H. Jacobs, expressing appreciation for
the cooperation of Director of Public Works, Hugh H. Foreman and Inspector, Ted
in the cases of Bond and Moore versus the City, and on motion of Counc~l~-~ Markel,
seconded by Heinly and carried, the matter was referred to the Manager and communi-
cation ordered filed.
C~unication was read from James S. Utt,et al, owners of ~roperties adjacent to.or
in the vicinity of East Chestnut Street Immediately east of the Santa Fe l~ilroad
tracks, advising that due to recent engineering, regrading and destruction of long
existing drains on East Chestnut Street, that the rain on February 23rd caused a
large amount of water to stand on the street making it impassable. On motion of
Counc~lm~n Heinly, seconded by Markel and carried, the cnm,nn%ication was referred
to the Manager for report.
Communication was read from California Roadside Council with copy of State Senate
Bill 666 to prohibit outdoor advertising from Freeways and scenic highways and re-
questing support on the matter and submitting bulletin and facts with reference
thereto. On motion of Councilman Heinly, seconded by Markel and carried, the
cc~mnunication was referred to the City Council as a committee of the whole.
Conmmmication was read from Lakewood Pan-American Parade Association advising that
the eleventh annual Pan-American Festival Parade will be held on April 13th and
enclosing an entry blank for the City if it desires to enter a float. On motion
Councilman Helnly, seconded by Markel and carried, the communication was received,
filed and referred to the Chamber of Commerce for action.
Communication was read from the Board of Supervisors submitting letter frc~ A. R.
Tompkins, 719 Chalynn Circle, Orange, protesting against the admission charge of
the Skate Ranch, North Main Street, and on motion of Councilm~u Heinly, seconded by
Markel and carried, the protest was referred to the Manager for answer.

On motion of Councilman Heinly, seconded by Markel and carried, the applications of
Wayne N. Swanson, Palmer P. Gillette, and Harold G. Ritter, to drive taxicabs, were
approved and permits granted.
On motion of Councilman Beinly, seconded by Markel and carried, the notification
of the Department of Alcoholic Beverage Control of beverage application of Jess
Allen, 648 North Van Ness Avenue, was received and filed.
On motion of Counc41m~n Be~nly, seconded by Markel and carried, the conmnn~ication
from.the Southern California Council of Outdoor Advertisin~ opposing Senate Bill
666 reference outdoor advertising, was tabled.
On motion of Councilman Heinly, seconded by Markel and carried, the Purchasing
Agent was authorized to advertise for bids for a training tower safety net, for the
Fire Department; bids to be opened April l, 1957.
The Manager orally reported on the protests of Edward B. Riniker, et al, reference
the trash and garbage cans of Markham Appliance Company and Chef's Hut, which are
left, for long periods of time, on the sidewalk on the west side of Bush Street,
the Markham parking lot and stated that the owners had made arrangements to have
the trash picked up on the Bush Street side, and the garbage cans would be set out
about 6:30 P.M., just before the pickup and brought in after the collection is made
On motion of Councilman Heinly, seconded by Markel and carried, the Clerk was
instructed to notify the complainants of the .report.
On motion of Counci~m~u Markel, seconded by Heinly and carried, the recommendation
of the curb usage c~m~ittee was approved and the request of ~.~mer S. Sullivan, 1232
South Main Street, for a twenty-minute zone, was denied.
On motion of Councilman Iieinly, seconded by Markel and carried, the recummendation
of the curb usage committee was approved and the request of Free, nan Morton, 321
McFadden Street, for an over-size drivewny, was granted.
On motion of Councilman Heinly, seconded by Markel and carried, the work was
for the construction of the Bristol Street Pumping Station, as performed by Bovee
and Crail Construction Company, and the Manager instructed to file and record a
Notice of Completion.
It was moved by Councilman Markel, seconded by Pfeinly and carried, that the legal
advertising be awarded to the Register Publishing Company for the balance of the
year on the basis of their bid as submitted for the fiscal year beginning July l,
1956.
On motion of Counci~mu Heinly, seconded by Markel and carried, the following
Ordinance entitled:
"Ordinance providing inspection fees on building relocation applications"
was introduced, considered and placed on file for second reading.
On motion of Councilman Heialy, seconded by Markel and carried, the plans and
specifications were approved for the reconstruction of Delhi Road, frc~ Park Drive
to Flower Street, including curbs on the north side and approximately 52' of paving
in width.
