D~hl None Each member of the City Council having received copies of the Minutes of March 4, 1957, reading of the Minutes was dispensed with and approved on motion of Councilman Heinly, seconded by Merkel and carried. Variance On motion of Councilman Heinly, seconded by Markel and carried, the recommendation Nelson & Casserly ~#/3 of the Planning Commission was approved and the variance of Nelson & Casserly granted to permit construction of two one-story buiIdings, containing one two- bedroom apartment unit, and nine one-bedroom apartment units, with ten garage spaces, at 621 North Baker Street, in R-2 District, subject to the conditions of Variance Russell }{. Jessup the Department of Public Works. On motion of Counci!~sn Markel, seconded by Jerome and carried, the recommendation of the Planning Commission was approved and the variance of Russell H. It was moved by Counci!m~u Heinly, seconded by Markel and carried, that action on the Ordinance amending Sections 7403, 7404 and 7405 regulating water service be continued until the next meeting to permit further stud~ by the Council as a whole. On motion of Councilman Heinly, seconded by Markel and carried, the following Ordinance entitled: "Ordinance amending certain Sections of the Uniform Buildin~ Code, 1955 Edition" was introduced, considered and placed on file for second reading. On motion of Councilman Heinly, seconded by Jerome and carried, the following Ordinance entitled: "Ordinance amending Chapter 2 of Article VIII of the Santa Aha Municipal Code to adopt byreference the Uniform Plumbing Code, 1955 Edition, with amendments thereto" was introduced, considered, placed on file for second reading, and a notice of public hearing ordered published setting the date of hearing on April 15, 1957. Dahl Noes, Councilmen None Absent, Councilmen None Communication was read from the State of California, Department of Public Works, advisin~ that in order to comply with the 1956 Federal Highway Act, it is necessary to prepare for the State, a complete inventory of highway, road and street improve- ment needs for the period July ~, ~956 to July l~ 1971. On motion of Councilman Heinly, seconded by Markel and carried, the matter was referred to the Msnager and the Department of Public Works. I !98. Beard Communication was read frc~ the Chamber of Commerce urging that immediate steps be taken to release owners of agricultural lands, now in the City or contemplated for annexation, from assuming through tax assessment or otherwise, the cost of collecti¢ of garbage or trash when the same is not required, and on motion of Councilman Jerome, seconded by Heinly and carried, the communication was received and filed. Co~nunication was read fram the Chamber of Commerce advlsing that it is the recom- mendation of the Annexation Committee that a qualified legal firm, well known in the bond field, be retained to obtain an opinion to rights and/or liabilities of proper~ owners in territory transferred from one sanitation district to another, and on motion of Councilman Markel, seconded by Jerome and carried, the ccmmamication was received and filed. It was moved by ColA~ci~man Neinly, seconded by Jerome and car- ried, that a qm,~ Ified legal firm, well known in the bond field, be employed at a fee not to exceed $500.00, to render an opinion. Communication was read from the Chs~,ber of Commerce requesting that plans be formuls for Joint effort between the City and the Count~ relative to the improvement of First Street (Bolsa Avenue) which is in-~Sequate to carry the traffic load, and on motion of CounciLman Markel, seconded by Heinly and carried, the communication was received, filed and referred to the Department of Public Works with instructions to formulate the plans as requested. Communication was read frc~ the Chamber of Commerce requesting action in developmen' of the Delhi Road-Wintersburg Avenue alignment and the necessary bridge over the Santa Aha River; and the improvement of the grade of the Edinger Street crossing of the Santa Ana River with expedited action on the development of the proposed ~brid~e On motion of Councilman Markel, seconded by Heinly and carried, the communication was received and filed. Frank Bueche, Chamber of Commerce Annexation Chairman, presented petitions for annexation of the area known as "North of Smeltzer Annexation" signed by approxfmst~ 829 registered electors in the area. On motion of Councilman Heinly, seconded by Markel and carried, the petitions were received~ filed and referred to the Clerk for checking as required by the Annexation Act of 1913. Frank Bueche, Chamber of Commerce Annexation Chairman, presented petitions for annexation of the area known as "South of Smeltzer Annexation" signed by approx- imately 89 registered electors in the area. On motion-of Councilman Heinly, seconded by Markel and carried, the petitions were received, filed and referred to the Clerk for checking as required by the Annexation Act of 1913. Frank Gelinas, Secretary-~ager of the Chamber of Commerc9 submitted a report of expenditures to date on the "North of ~ltzer Annexation" and "South of Smeltzer Annexation". It was moved by Councilm-n Heinly, seconded by Markel and carried, that the existing contract with the Chamber of Commerce be amended to provide for additio~-I campensation in the sum of $2500.00 to cover cost of further work involved on said annexations. Communication was read frc~ The Orange County Ornithological Society protesting against the removal, destruction or abolishment of Birch Park, and on motion of Councilman Jerome, seconded by Heinly and carried, the communication was received and filed. On motion of Councilman Jerome, seconded by Markel and carried, the communication was referred to the Manager and Park Department. On motion of Councilm~ Jerome, seconded by Heinly and carried, the request of the L.A.M.S.F.A. League, Hollandia Soccer Club of Orange, for free rental of the Municipal Bowl for the purpose of conducting a charity exhibition soc~e~ game for the "March of Dimes", was received and filed. On motion of Councilman Heinly, seconded by Markel and carried, the request was referred to the Manager with in- structions to secure further information and report back. Communication was read from the Orange County Veterinary Medical Association, with Resolution attached, advising that the rabies outbreak of 1955-56 in the County has shown evidence of being at least temporarily controlled by means of mass i~muni~ zation of the canine population of the County, and on May l, 1957 the agreement~ with the County and the incorporated areas in' regard to the $2.00 vaccination fee will be discontinued and resolving that a more equitable program be instituted. On motion of Councilman Markel, seconded by Jerome and carried, the communication and recon~mendations were received and filed. On motion of Councilman Markel, seconded by Heinly and carried, the recommendations were approved and a letter to be directed to the Association conveying the appreciation and full cooperation of the Council in this program. On motion of Councilman Jerome, seconded by Heinly and carried, the bond of Louis B. Minter filed for the improvements within the boundaries of Record of Survey No. 184, on property at the northwest corner of Grand Avenue and Washington Place, in the sum of $1,000.00, was ordered released and improvements accepted as completed. On motion of Councilman Markel, Seconded by Jerome and carried, the communication from the City of Orange advising of proposed annexation No. 84, ~f property located northwest of Collins Avenue and Glassell Street, on the north side of Orange, was received and filed. It was moved by Councilman Markel, seconded by Jerome and carried, that the commun~ cation from the Boundary Commission be received and filed reference the proposed annexation of territory to the City of Garden Grove, Annexation No. 17, and a letter ordered directed to the City of Garden Grove advising the City of Santa Aha objects to this annexation as it overlaps a portion of the area in the proposed "South of Smeltzer Annexation". Conm~unication was read from the County Tax Collector advising that it is the intent ion to sell at public auction certain properties in the City of Santa Ana, and on motion of Councilman Jerome, seconded by Markel and carried, the communication was received and filed. The Manager stated that accordi~ to the report of the Department of Public Works there are several parcels of property which ar~ highly desirable for ownership by the City and recommended that four parcels be acquired. On motion of Counc~ma~ Jerome, seconded by Markel and carried, the claim of Walter W. Cole for alleged injuries sustained due to a fall on the defective sidewalk in the 1000 block on Sixth Street, in the snm of $25,805.00, was referred to the Attorney and Insurance Carrier. On motion of Cotmcilman Jerome, seconded by Markel and carried, the applications o~ Charles A. Nelson, Hazel J. Schwulst and Louis E. Walker, to drive taxicabs, were approved and permits granted. On motion of Councilman Jerome, seconded by Heinly and carried, the notifications of the Department of Alcoholic Beverage Control of beverage applications of Frans R. Hanson and James RI. McVay, 216 West Third Street, Ben C.,Eddie C.,Pascual C. and Robert G. Ntmoz, 1324 West First Street and Francisco P. and Petra B. Jimenez, 404 West Fourth Street, were received and filed. On motion of Councilman Jerome, seconded by Heinly and carried, the application of D.W.Boyles and J.R.Britton, before the Public Utilities Commission, to operate limousine service as a highway co~on carrier of passengers, baggage, express, newspapers and mail between Santa Aha, Anaheim and Los Angeles (International) Airport, Zuglewood, w~s received and filed. It was moved by Councilman Jerome, seconded by Markel and carried, that a letter be directed to Messrs. Boyles and Britton advising that it will be necessary to provide off-street parking for the coaches and that in the near future no parking will be permitted on Main Street at the location indicated as a lay-over for the coaches. Coem~nication was read frc~ the Department of Public Works submitting a new assess merit spread for the Vehicle Parking District No. l, and advising that the differen Churches are now assessed at one-third of the original assessment and all propertI assessments have been checked to determine that they fall under the allowable 35~ of assessed value of the land. On motion of Councilman Heialy, seconded by Markel to b~ and carried, the hearing was continued to April l, 1957 and the assessees_/notified by postcard of the continued hearing, any additional pretests to be recorded at that time. The Nanager orally reported on the request of United States Plywood Corporation for permission to use plywood instead of metal for signs on the top of their building at ll2k East 17th Street, and suggested an amendment to the Sign 0rdinan, which would permit the use of bonded plywood for roof signs or sky signs in Fire Zone No. 3. On motion of Councilman Jerome, seconded by Heinly and carried, the Attorney was instructed to prepare an amendment to the Sign Ordinance to conform to the suggested recommendations. The Manager orally reported that immediate action should be taken to install traffic signals or other safety measures at the intersection of North Bristol Street and ~emory Lane. On motion of Councilman Jerome, seconded by Heialy and carried, a letter was ordered directed to the State of California, Division of Highways, requesting that immediate action be taken for traffic signal control, or whatever facilities are available, to insure safety at said intersection. (over-size driveways) Request Two-hour parking 800 block N.Birch St. On recommendation of the Department of Public Works and on motion of Councilman Heinly, seconded by Jerome and carried, the work was accepted as completed, for the construction of paving,~ curb and gutter, and sidewalk on East Fourth Street, east of the Santa Ana Freeway, for a distance of approximately 646 feet, as performed by R.J.Noble Company, and the Manager instructed to file and record a Notice of Completion. The Manager reported reference the communication from James S. Utt et al in regard to the water standing on East Chestnut Street immediately east of the Santa Fe Railroad and stated that the condition was due to the construction taking place at that time and the situation has now been corrected. On motion of Councilman Jerome seconded by Markel and carried, the report was received and filed. On motion of Councilr~an Heinly, seconded by Markel and carried, the recommendation of the curb usage committee was approved and the request of Aetna Finance, 227 North Broadway, for a loading zone was denied. The ~t~nager orally reported on the suggestions of Nathan Rubaloff reference certain improvements to be made on a portion of the Walnut Street extension and stated he advised Mr. Rubaloff the City would guarantee the paving of the street and construc- tion of curbs and gutters in a part of Tract No. 2~9~, which is approximately 84' x 500'. On motion of Councilman Markel, seconded by Heinly and carried, the oral report was approved.and accepted. The M~neger reported on the pretest of F.E.Carter and stated the condition of Russell Avenue between Shelton and Rosewood is essentially the same as various sections throughout this area~ oil has been applied at various times to the existing~ material and the chuck-holes referred to are mainly in the parking area and not in the travel,way. On motion of Councilman Heinly, seconded by Markei and carried, the report was received, filed and approved. On motion of CounciLman Heinly, seconded by Markel and carried, the recc~muendation of the curb usage committee was approved and the request of C.H.Gallion, for limited parking at 801 North Spurgeon Street, was denied. On motion of Councilman Neinly, seconded by Jerome and carried, the recommendation of the curb usnge committee was approved and the request of Montgomery Ward denied to park a trailer in either the yellow zone on Main Street or the last two metered zones at Fourth and Main Streets during the hours from ll A.M. to 4 P.M. March 21, 22 and 23, during the "truck load tire sale". The Council having unanimously waived the reading of the Resolution, on motion of Councilman Helnly, seconded by Jerome and carried, the following Resolution entitled "Resolution No. 57-54 authorizing the execution of a deed granting access rights to First and Walnut Streets" to Income Centers, Inc., was considered and passed by the following vote: A~s, Councilmen D~le H. On motion of Councilman Heinly, seconded by Markel and carried, the recommendation of the curb usage committee was approved and the request of twenty-three persons that two-hour parking limit be established in the 800 block North Birch Street, was denied, subject to review by the committee.
