B. ~lD ~RGARET PRICE WHEREAS, a public hearing was duly held before the City Council of the City of Santa Ana on September 2, 1975, on Appeal No. 355 filed by J.B. and Margaret Price in oppo- sition to the Zoning Administrator's denial of Minor Exception Permit Application 75-25. NOW, THEREFORE, BE IT RESOLVED, that based on such public hearing and the oral and documentary evidence submitted therein, the City Council of the City of Santa Ana does hereby reverse the action of the Zoning Administrator denying Minor Exception Permit Application No. 75-25, and does hereby approve said Minor Exception Permit Application Ilo. 75-25 and does hereby approve Appeal No. 355 filed thereon in opposition to the Zoning Administrator's action. BE IT FURTHER RESOLVED, that the City Council hereby adopts the attached findings of fact supporting approval of Minor Exception Permit Application No. 75-25. Price ADDRESS & ZONING: 122 East Seventeenth Street AP 006-011-21 C1 District SDM 7-5-9 EX PURPOSE: To waive a portion of the required parking in con- nection with an addition to an existing restaurant. ZONING ADMINISTRATOR'S DECISION: Denied 8/21/75 11~00 a.m. DETAILS OF PROPOSAL: 1. Description of Proposal The site contains an existing 3,450 square foot restaurant with a capacity for 100 people. The proposal is to add a cocktail lounge onto the west end of the building which will have approximately 900 square feet and will provide for an additional 30 people. The total capacity would then be 130 people. Based upon the Code, the offstreet parking requirement is 35 spaces. The applicant's plot plan shows 32 spaces, one of which does not meet City standards, leaving a total of 31 spaces provided, or a shortage of four spaces. The minor exception application could allow a 20% waiver or, in this case, a minimum of 28 spaces. 2. Area Description: A. Property: A rectangular shaped parcel with approximately 138 feet of frontage on Seventeenth Street and 125 feet on Bush Street and an area of approximately 17,125 feet. B. Surrounding Development: North - vacant lot East - service station South - single family residence West - vacant lot C. Street Syst~: Seventeenth is a planned arterial street. Present Use: An existing restaurant. Approval is subject to the following conditions: A. Planning: Standard Requirements 1, 2, 3, 4, 13, 14 B. Public Works: Standard Requirements 1, 5, 16, 21 c, 22 c, 41, 42, 43 ff 4. The following requirements must also be met: A. That a revised plot be submitted to and approved by the Planning Department which shows the following changes: 1) 2) The first parking space (which is substandard) adjacent to Seventeenth Street shall be deleted and this area landscaped to the satisfaction of the Planning Department. That the parking area on the southerly half of the property be left as it now exists with 5-foot wide planters on both sides of the driveway and the revised plot plan be changed to reflect this con- dition. PUBLIC WORKS Details of Requirements: 1) Alley easement for a width of 10 feet from centerline to property line and to include an alley corner cut-off. 2) Improvements: Seventeenth Street a) Repair sidewalk. Bush Street a) Place sidewalk between existing curb and existing walk. FIRE DEPARTMENT EX 75-25 C. Provisions complying with the following codes shall apply: 1971 Uniform Fire Code and Title 19, California Admin- istrative Code, Public Safety Plans incorporating the above codes showing panic hard- - ware doors, automatic and portable fire extinguishers, and seating arrangement shall be submitted for approval by the Fire Department prior to the issuance of a building permit. D. The applicant shall submit evidence to the Planning Depart- ment that he has negotiated a parking sharing agreement with Norm's Restaurant in the manner described or is able to enter into a lease for property within a reasonable distance of the present parking to satisfy the requirement for his employees. ("Manner described" means to consolidate parking ~ areas so parking can be shared.)
