HomeMy WebLinkAbout75-171TD:nr RESOLUTION NO. 75-171 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING A MAP AND DECLARING INTENTION TO VACATE A PORTION OF HELIOTROPE DRIVE IN THE FLORAL PARK TRACT 748, BOOK 30, PAGE 9 RECORDS OF ORANGE COUNTY, STATE OF CALIFORNIA, IN THE CITY OF SANTA ANA BETWEEN SEVENTEENTH STREET AND NINETEENTH STREET, SUBJECT TO THE RESERVATION AND EXCEPTION OF A CERTAIN EASEMENT AND RIGHT OF WAY; DIRECTING THE CLERK OF COUNCIL TO FILE SAID MAP IN HER OFFICE; DESCRIBING SAID STREET AND THE EASEMENT AND RIGHT OF WAY TO BE RESERVED AND EXCEPTED; SETTING A PUBLIC HEARING THEREON; AND DIRECTING NOTICE HEREOF TO BE POSTED. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SANTA ANA: SECTION 1: This Council of the City of Santa Ana does hereby approve that certain map entitled Street Abandonment No. 79 (Heliotrope Drive), as the map showing the portion of Heliotrope Drive between Seventeenth Street and Nineteenth Street which this Council hereinafter declares its intention to vacate subject to the reservation and exception of a certain easement and right of way hereinafter described. SECTION 2: The Clerk of the Council is hereby directed to file said map in her office where the same may be examined by any and all persons desiring to do so. SECTION 3: Pursuant to and in accordance with the provisions of Part 3 of Division 9 of the Streets and Highways Code of the State of California, this Council does hereby declare its inten- tion to order the vacation of, and to vacate, that portion of Heliotrope Drive between Seventeenth Street and Nineteenth Street subject to the reservation and exception of the easement and right of way hereinafter described which is delineated on said map to which reference is hereby made for full and further particulars. SECTION 4: Notice is hereby given that at the hour of 7:30 P.M. or as soon thereafter as the matter can be heard, on the 5th day of January , 19 76, in the Council Chambers of the City of Santa A/la, 22 Civic Center Plaza, Santa Ana, California, a public hearing will be held by this Council at which time any and all persons interested in or objecting to the proposed vacation of Heliotrope Drive between Seventeenth Street and Nineteenth Street and the reservation and exception of the easement and right of way, hereinafter described, may appear and be heard. SECTION 5: The Clerk of the Council is hereby directed to cause the resolution to be published in The Register within fifteen (15) days after the date of adoption of this resolution and at least ten (10) days before the date set for said hearing. SECTION 6: The Director of Public Works is hereby directed to cause notices of said proposed street vacation to be posted conspicuously along the line of the aforesaid Heliotrope Drive between Seventeenth Street and Nineteenth Street, which is proposed to be vacated, at least ten (10) days before the date set for said hearing. Such notices shall be posted not more than three hundred feet (300') apart, but at least three (3) shall be posted. Such notices shall state the passage of this resolution of intention and the time and place of the hearing. RESOLUTION NO. 75- 171 PAGE TWO SECTION 7: Said section of said street proposed to be vacated is more fully described as follows: A strip of land 2.00 feet wide bounded Easterly by the Westerly line of Lot 17, of Tract No. 748, in the City of Santa Ana, County of Orange, State of California, as shown on a map recorded in Book 30, page 9 of Miscellaneous Maps, records of said Orange County; bounded Westerly by the Easterly line of Lot 29, of said Tract No. 748; bounded Southerly by the Easterly prolongation of the Southerly line of said Lot 29; bounded Northerly by a line 2.00 feet Northerly from and parallel to the said Easterly prolongation of the Southerly line of said Lot 29. Reserving and excepting to the City of Santa Ana the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipelines, telegraphic and telephonic lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise to protect the same from all hazards in, upon, and over the street or part thereof proposed to be vacated. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its adjourned regular meeting held on the 8th day of December , 1975.
