HomeMy WebLinkAbout75-173Recorded December 12, 1975, 9:05 a.m. CTD:po 11-21-75 Book 1159 Page 1460 RESOLUTIOI~ NO. 75-173 A RESOLUTION OF THE CITY COUNCIL OF TIlE CITY OF SANTA ANA ORDERI~G TIlE VACATIOi~ OF A PORTION OF SIXTIt STREET I~ TIlE ttICKEYS, ANDREWS, CRANES ADDITION TO SAi~TA ANA BETWEEN ROSS STREET AI~D SA1;TA A~A BOULEVARD, SUBJECT TO THE RESERVATION Ai~D EXCEPTION OF A CERTAIN EASEMENT AND RIGIIT OF WAY. ~EREAS, on recommendation of the Department of Public Works of the City of Santa Aha, Resolution 75-157 was adopted giving notice of intention to vacate a portion of Sixth Street in the ttickeys, Andrews, Cranes Addition to Santa Ana between Ross Street and Santa Ana Boulevard, subject to the reservation and exception of a certain easement and right of way; and ~IEREAS, on December 8, 1975, a public hearing was duly held on vacation of said street on posted notice and the publication of said Resolution No. 75-157. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Santa Ana: SECTION 1: This Council of the City of Santa Ana does hereby find that the abovementioned street is unnecessary for present or prospective street purposes and does hereby make its order abandoning and vacating for street purposes that certain right of way located in the City of Santa Ana, County of Orange, State of California, described more fully as follows: A portion of Sixth Street, 69 feet wide of Hickeys', Andrews' and Crane's Addition to Santa Ana, in the City of Santa Ana, as shown on a map thereof recorded in Book 5, Page 352, of Miscellaneous Records of Los Angeles County, California, more particularly described as follows: Beginning at the intersection of the centerlines of said Sixth Street and Ross Street, 50 feet wide, as said streets are shown on said map; thence Easterly along said centerline of Sixth Street a distance 53 feet to its intersection with a line parallel with said centerline of Ross Street, said intersection being also the true point of beginning; thence Northerly along said parallel line a distance 30 feet to the North line of said Sixth Street; thence Easterly along said North line of Sixth Street a distance 363.99 feet to a point on a tangent curve concave Southeasterly having a radius of 382 feet, a radial to last said point bears North 00~21'36'' West, last said point being also a point of cusp; thence Southwesterly along last said curve through a central angle of 32o32'54'' an arc distance of 217.00 feet to its intersection with the south line of said Sixth Street, a radial to last said point of intersection bears North 32054'30'' West; thence Westerly along said South line a distance 157.91 feet to last said line parallel with the centerline of Ross Street; thence Northerly along last said parallel line a distance 30 feet, to the true point of beginning. RESOLUTION NO. 75- 173 Page Two SECTION 2: Pursuant to and in accordance with the provisions of Part 3 of Division 9 of the Streets and Highways Code of the State of California, this Council does hereby order the vacation of that portion of Sixth Street between Ross Street and Santa Ana Boulevard subject to the reservation and exception of the easement and right of way hereinafter described: Reserving and excepting to the City of Santa Ana the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the street or part thereof proposed to be vacated. SECTION 3: Pursuant to the provisions of Section 5079 of the Public Resources Code of the State of California, this Council does hereby find and determine that neither said portion(s) of said street nor parts thereof is useful as bicycle paths or routes. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its adjourned regular meeting held on the 8th day of December , 1975.
