RESOLUTION NO. 75-7
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA, AFFIRMING THE ACTION OF THE
PLANNING COMMISSION ON VARIANCE APPLICATION
NO. 75-~g* APPROVING SAID VARIANCE APPLICATION,
AND DENYING APPEAL NO. 359 FILED THEREON BY
LEE M. KEARNEY OF CITIZENS FOR FAIR ZONING
ASSOCIATION.
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Aha on 3anuary 5, 1976 ,
on Appeal No. 359 filed by Lee M. Kearney of Citizens for Fair
Zoning Association in opposition to the Planning Commission's
approval of Variance Application No. 75-50.
NOW, THEREFORE, BE IT RESOLVED, that based on such
public hearing and the oral and documentary evidence submitted
therein, the City Council of the City of Santa Ana does hereby
affirm the action of the Planning Commission approving Variance
Application No. 75-50 and does hereby approve said Variance
Application No. 75-50 and does hereby deny Appeal No. 359 filed
thereon in opposition to the Planning Commission's action.
BE IT FURTHER RESOLVED, that the City Council hereby
adopts as its finding of fact for approval of Variance Application
No. 75-50, those "Finding of Fact, Variance No. 75-50 prepared
and submitted by the Planning Commission.
PASSED AND ADOPTED by the City Council of the City
of Santa Ana at its regular meeting held on the
5th day of .lan~ary , 1976.

REASON FOR ACTION:
That the granting of this variance with all attached conditions

DETAILS OF PROPOSAL:
1. Description of Proposal:
The applicant proposes to construct an apartment complex to be
known as Lake Dianne. Lake Dianne is planned in two phases. The
first phase will contain 186 dwelling units and the second phase
will include 128 dwelling units. The distribution of planned
dwelling units is displayed as follows:

The total development will contain 32 separate buildings; 29
of which will contain 10 units each, and 3 which will contain
8 units each. All buildings will be two-story.
Parking
The required one covered parking space and .5 open
parking space per unit has been provided, for a
total of 471 parking spaces.
Density and Open Space
The proposed development would be built at 25.8 units/acre,
or 1,687~ of land area per unit. Open space provided would
be 50.2%. Approximately 76,100~ of the open space will be
provided in the form of two lakes, each one surrounded
by buildings.
Recreation Facilities
The development proposes a swimming pool and recreation
room for each phase of the project. The recreation rooms
will ~ontain a sauna, lounge, and game room with a total
square footage of approximately 1,800~.
2. Area Description:
A. Property:
An irregular shaped parcel with 655' of frontage on Fruit
Street, a depth of approximately 750' and a total area of
approximately 12.1 acres.
B. Surrounding Development:
north - single family residences
east - vacant property
south - professional offices & vacant property
west - single family residences & Cabrillo Park
C. Street System:
Both Fruit Street and Dianne Street are designated as local
streets.
Comparable Applications or Circumstances:
VA 68-24 1100 E. Fairhaven Avenue allowed two story
apartmen~ buildings in the R4 District within 150 feet of
property zoned R1 and Al.
VA 68-45 1440-1450 N. Tustin Avenue allowed two story
apartment buildings in the R4 District within 150 feet of
property zoned R 1.
VA 69-9, 701 West Sunflower Avenue, allowed three story
apartment buildings in the R4 District within 300 feet of
property zoned R1 and Al.
VA 69-38 1000 W. MacArthur Blvd., allowed two story
apartment buildings in the R4 District within 150 feet
of property zoned R 1.
VA 70-30 775 W. Sunflower Avenue, allowed two story
apartment buildings in the R 4 District within 150 feet
of property zoned R 1.
VA 70-84 801-843 W. Sunflower Avenue allowed two story
apartment buildings in the R 4 District within 150 feet

VA 73-37, 2102 E. Fairhaven, allowed two story condominium
buildings in the R4 District within 150 feet of property
zoned Al, RE, and R1. Approved 8/6/73.

3. General Plan Compatibility:
The General Plan designates the area for medium density residential.
4. Reasons for Staff Recommendation:

With the parking area along Fruit Street being buffered
by landscaped bermed areas and a 5' high retaining wall,
the parking area will not be visible to or have a detri-
mental effect on existing single family residences on
the north side of Fruit Street.
The two story buildings proposed in the R 1 District are
setback an average distance of 5~ from the property line on
Fruit Street and design treatment.will be subject to the
Planning Department's approval. Dense landscaping within
the 18 foot wide landscape strip will also provide a
screening effect.
The R 1 zone which requires the 150' setback for 2 story
buildings is located on the subject property and will not
be developed into single family residences. As a result
this 150'foot setback area is located 160' to 310' from
developed single family properties on the north side of
Fruit Street.
I'f the Commission approves the application, the following standard
requirements must be met:
A. Planning: 1, 2, 3, 4, 5, 13, 14
B. Public Works: 1, 3, 10, 11, 13, 14, 15, 20, 21c, d, f,
28, 40, 41, 42.
6. The following requirements must also be met:

Development conform to all the provisions of the R 4 District,
including site plan review procedure, except for the waiver
of the setbacks if provided for by the conditions of this
variance.
A 6'htg~ 6"wide concrete block wall be constructed along the
west and south property lines. Subject wall height to be
measured from highest grade.
D. Location and design of master TV antennas shall meet with
the approval of the Planning Department.
That construction plans for the lakes be submitted to and
approved by the Orange County Mosquito Abatement District
prior to the issuance of building permits.
That a parcel map for the proposed phasing of the project
be submitted to and approved by the City, and recorded prior
to the issuance of building permits.
G. That the properties be maintained under, single ownership, and
not be sold off separately.

Public Works
H~. Developer shall make provisions for commercial trash
collection bins in accordance with City standards.
I. Improvements.
1) Fruit Street with full width sidewalk, close existing
curb cut and remove tank from existing right of way.
2) Dianne Street with full width sidewalk.
NOTE:
Trees and tree well locations are to be approved
by the Parks Department. Street trees are to be
installed by the developer.
Fire Department
J. Prov{sions complying with the following codes shall apply:
1) 1971 Uniform Fire Code
2) Title 19, California Administrative Code, Public
Safety
3) Title 25, California Administrative Code, Housing &
Commercial Development
4) California Administrative Code, State Building
Standards
5) National Fire Protection Association Standards
Plans incorporating the above codes showing Fire Department
access driveways, automatic fire protection systems, portable
fire extinguishers and on-site fire hydrants shall be sub-
mitted for approval by the Fire Department prior to the
issuance of a building permit.
Police Department
That a plot plan be placed at each driveway entrance into
the complex and at each of any recreations centers within
the complex in a manner meeting the approval of the Planning
Department,,and Police Department.
That all exterior doors, with the exception of glass sliding
doors, shall be solid core in design and be equipped with a
single cylinder deadbolt lock with a minimum one inch throw.
N. No glass shall be within 40 inches of the locking device on
solid core doors.
O. Glass sliding windows shall be equipped with a locking device.
P. Glass sliding windows shall be non-removable in design when
in a closed and locked position.
Glass sliding windows shall have an auxiliary locking device
or a single locking device for the sliding window and shall
be approved by the Police Department.
R. Glass Sliding doors shall be so designed as not to be capable
of being removed when the door is in a closed and locked position.

Plot plans of the completed complex shall be submitted to
the Police Department and Fire Department.
Identifying letters, numbers or combinations thereof shall be
placed 0n or adjacent to each unit (building) in the comple× which wi]
clearly identify the unit (building)~in a manner meeting
the approval of the Police Department and Planning Depar%ment.
That lighting for driveway entrances, garbages, carport areas,
exterior walkways and recreation areas mee~ the standards of
the Illuminating Engineers Society or shall meet w~th the
approval of the Police Department. This ]~ghting is to be
maintained at the recommended foot candle and wattage levels
during the hours of darkness.
That the height of the trees and shrubbery adjacent to the
driveways ~e limited to allow adequate visibility of Dian~]e
Street by the exiting traffic and to insure pedestrian safety.
