RESOLUTION NO. 76-21
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ~A APPROVING TIlE A~EXATION OF
TERRITORY~ DESIGNATED "SANTIAGO CREEK AND
GARDEN GROVE FREEWAY NORTHEAST ANNEX" TO
THE CITY OF SANTA ANA
WHEREAS, the City Council of the City of Orange has by
resolution consented to the detachment of certain territory, the
description of which has been filed with the Orange County Local
Agency Formation Commission as "Proposed Santiago Creek and Garden
Grove Freeway Annex; and
WHEREAS, the Local Agency Formation Commission of Orange
County has approved a description of territory herein contained and
annexation of said territory to the City of Santa Ana, California in
conformance with the requirements of Government Code Sections 35304
and 54797.1; and
WHEREAS, the Local Agency Formation Commission of Orange
County has authorized the City Council of the City of Santa Ana to
annex said territory without notice and hearing and without an elec-
tion pursuant to Section 54797.1 of the Government Code.
NOW THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Ana, California, hereby finds and declares that
said territory was uninhabited at the time of adoption of this reso-
lution and is contiguous to the city of Santa Ana; and written con-
sent to annexation has been filed with the City of Santa Ana by the
owner of all the land in the territory of said annexation, to wit
the City of Santa Ana itself; and that all the statements herein are
true and correct.
BE IT FURTHER RESOLVED: That the annexation to the City
of Santa Ana and to Ward No. 1 in said City of all the territory in
the County of Orange, State of California, designated as"Santiago
Creek and Garden Grove Freeway Northeast Annex," as described in
Exhibit "A", attached hereto and by this reference incorporated here-
in as though fully set forth, be and the same is hereby approved,
under the Annexation of Uninhabited Territory Act of 1939 comprising
Government Code Sections 35300, Et Seq.

BE IT FURTHER RESOLVED: The Clerk of the Council of the
Santa Ana shall without delay transmit to the Secretary of
certified copy of this resolution.
BE IT FURTHER RESOLVED: That the Environmental Impact
Evaluator of the City of Santa Ana shall immediately file with the
Orange County Clerk and the Secretary of the California State Re-
sources Agency a Notice of Determination with a copy of the Negative
Declaration attached thereto.

(Detachment of territory from the City of Orange to the City of
Santa Aha per City of Orange Resolution No. 4211)
That portion of the Abel Stearns Allotment of the Rancho Santiago de Santa
^na acquired by the State of California by deed recorded in Book 7079
page 754 and by Parcel 1 of deed recorded in Book 7604 page 500, both
of Official Records in the office of the County Recorder of Orange County,
described as follows:
Beginning at the most Southerly corner of the land described in said Par-
cel 1, said point of beginning being an angle point in the City of Santa
Ana boundary as established by an annexation Resolution No. 68-117, said
angle point being also along the most Northeasterly line in the City of
Santa Ana boundary as established by an annexation Resolution No. NS-241,
last said Northeasterly line being also along the Northeasterly right-of-
way line of the Atchison~ Topeka and Santa Fe Railway 100 feet wide, as
shown on a map filed in Book 33, page 47, Record of Survey of Orange County,
said point of beginning being also the most Southerly corner in the City
of Orange, California boundary as established by an annexation No. 42,
per City of O~ange Ordinance No. 583; thence leaving said Northeasterly
line of said annexation Resolution No. NS-24t and said Northeasterly
right-of-way line of said Atchison, Topeka and Santa Fe Railway, and
running along the Northwesterly line of said annexation Resolution No.
68-117, and running along the Southeasterly line of said annexation No.
42 of the City of Orange boundary~ North 38° 52' 08" East, a distance
220.48 feet to an angle point, said angle point being along the South-
westerly right-of-way line of the Garden Grove Freeway, as shown on State
right-of-way map No. F-1256 in the office of the County Surveyor of said
county as File No. 10794; thence, leaving said Northwesterly line of
said annexation Resolution No. 68-117 and said Southeasterly line of
said annexation No. 42 and running along said Southwesterly right-of-way
line of tile Garden Grove Freeway, North 59° 43' 30" West, a distance
141.96 feet to an angle point, said angle point being 204 feet Southwesterly,
measured at right angles from the centerline of said Garden Grove Freeway;
thence still along said Southwesterly right-of-way line of said Garden

Grove Freeway, North 56° 51' 41" West, a distance of 102.26 feet to an angle
point~ sa±d angle point being 194 feet Southwesterly, measured at right
angles from the centerline of said Garden Grove Freeway; thence still
along said Southwesterly right-of-way line of said Garden Grove Freeway,
North 49° 57~ 08" lqest, a distance of 126.13 feet to its intersection with
the Southwesterly line described in said deed recorded in said Book 7079
page 754, said Southwesterly line of last said deed being also the South-
westerly line of said annexat±on No. 42 of the City of Orange boundary,
also last said Southwesterly line being also the Northeasterly right-of-
way line of last said railway, last said intersection being a point of
cusp in a curve concave Northeasterly having a radius of 2,175 feet;
thence Southeasterly along said Southwesterly City of Orange boundary,
and along said Norfl~easterly right-of-way line of last said railway and
along the arc of said curve through a central angle of 2° 05' 40" a distance
of 78.17 feet to an angle point in the City of Santa Aha boundary as
establ±shed by said annexation Resolution No. NS-241, said angle point
being still along last said Southwesterly City of Orange boundary and
still along the Northeasterly right-of-way line of last said railway;
thence continuing Southeasterly along last said Southwesterly City of
Orange boundary, and along last said Northeasterly right-of-way line

tablished by said annexation Resolution No. NS-241, and along the arc
of a curve concave Northeasterly through the same radius of 2175 feet
and through a central angle of 4° 55' 40" a distance of 185.63 feet to
an angle point in last said City of Santa ^ha boundary, said angle point
being the point where said railroad right-of-way changes from a width
of 75 feet to 100 feet, as shown on last said map; thence North 68° 09' 58"
East along said City of Orange boundary and along City of Santa Aha bound-
ary as established by said annexation Resolution No. NS-241, a distance

Santa Ana boundaries, said angle point being the point on said railroad

REVIEWING DEPARTMENT: Planning
In accordance with the City of Santa Ana's policies regarding
implementation of the California Environmental Quality Act of
1970 (specifically Section 21151 of the Public Resources code),
the Environmental Impact Evaluator for this department has
reviewed the Environmental Assessment Form submitted in re-
quest for Negative Declaration status for the above described
project and hereby finds that the proposed project cannot, or
will not, have a significant effect on the environment. Neg-
ative Declaration status is therefore granted for this pro-
ject and the submittal of an Environmental Impact Re~ort is
thereby not necessary.
The granting of Negative Declaration status is based upon the
following: .-
1) The property, is owned by the City of Santa Ana.
The property is isolated from the City of Orange by a man-made
barrier, the Garden Grove Freeway.
3)
The property will be used for park expansion purposes ogly and
theKeby will have a positive impact on ithe en'vironment.
