RESOLUTION NO. 76-35
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA OPPOSING SENATE BILL
1500 CSONG) COURT REORGANIZATION
WHEREAS, Senate Bill 1500 (Song) has been introduced
to the California State Senate; and
WHEREAS, Senate Bill 1500 is presently before and
being considered by the Senate Conunittee on Judiciary; and
WHEREAS, Chairman of the Senate Committee on Judiciary,
Senator Song, is author of Senate Bill 1500; and
WHEREAS, Senate Bill 1500 has already received public
support of the Administration; and
WHEREAS, the City Council of the City of Santa Ana finds
satisfactory the existing law of the State of California govern-
ing the organization of the lower state courts; and
WHEREAS, Senate Bill 1500, if enacted, would substan-
tially alter the present organization of the judiciary in that
it:
eliminates municipal courts, creating only a
"single trial court" of general jurisidiction
for the entire state,
2. removes from the county to the state, the financial
support of the judicial system, and
e
diverts city revenue derived from Vehicle Code
fines and forfeitures presently allocated to
cities under Section 1463 of the California
Penal Code to the state to support the new
organization. Such division of city revenues
amounts to approximately $30,000,000.00 state-
wide, $2,000.000.00 from the other cities of
Orange County and $340,000.00 from the City of
Santa Ana alone; and
WHEREAS, the purpose of the present law embodied in Sec-
tion 1463 of the California Penal Code as adopted in 1949 was that
when the cities gave up control of their own, then existing, city
and municipal court system, they would not lose any of the revenue
derived therefrom; and
WHEREAS, Senate Bill 1500, if enacted, would be a sub-
stantial detriment to city government:
1. financially through diversion of the afore-
mentioned funds and
2. politically through interference with local govern-
mental policies and spending by indirect methods.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA:
That this City Council hereby expresses strong
opposition to SB 1500 and urges all other
California cities to similarly oppose SB 1500.
That the City Clerk of the City of Santa Ana
shall cause copies of this resolution to be
forwarded to State Senator Song, Senator
Carpenter, Senator Robbins, the Senate Committee
on Judiciary, the Senate Coramittee on Local
Government, State Assemblyman Badham, State
Assemblyman Briggs, State Assemblyman Burke,
State Assemblyman Carpenter, State Assembly-
man Nestande, State Assemblyman Robinson,
the City Attorney of each city in Orange County,
the League of California Cities and the Orange
County Intergovernmental Coordinating Council,
Resolution Service.
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its adjourned re§ular meeting held on the 22nd
day of March , 1976.
