EX 76-4 AND APPROVING SAID MINOR EXCEP- TION PERMIT APPLICATION FILED BY PACIFIC LIGHTING LEASING COMPANY WHEREAS, the City Council of the City of Santa Aha determined on April 19, 1976, to set Minor Exception Permit Application No. EX 76-4 for public hearing by the said City Council; and WHEREAS, a public hearing was duly held before the City Council on May 3, 1976, on said minor exception permit application; NOW, THEREFORE, BE IT RESOLVED, that based on such public hearing and the oral and documentary evidence submitted therein, the City Council does hereby affirm the action of the Zoning Administrator approving Minor Exception Permit Applica- tion No. EX 76-4 filed by Pacific Lighting Leasing Company and does hereby approve said application. BE IT FURTHER RESOLVED, that said approval is subject to those conditions set forth in the staff report EX 76-4 sub- mitted to the City Council for its review of said application and that the City Council hereby adopts as its finding of fact for approval of Minor Exception Permit Application No. EX 76-4 said staff report EX 76-4. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its re§ular meeting held on the 3rd day of May , 1976. Grand Avenue AR 41-220-81 C 5 District SDM 31-4-9 EX PURPOSE: To allow on sale beer and wine in an existing restaurant within 300' of residential property. ZONING ADMINISTRATOR'S DECISION: APPROVAL 3/24/76 10:30 AM REASON FOR DECISION: The restaurant occupies the second floor only and is located approximately 100' away from residential property to the west. Residential carports and driveway act as a buffer along the common property line. 2. The restaurant offers no games or entertainment and closes at 9:00 PM daily. DETAILS OF PROPOSAL: 1. Description of Proposal: The restaurant is located on top of an existing service station. The operation now consis~of food service only. Hours ofoperation are: weekdays 7:00 AM - 9:00 PM, weekends 8:00 AM- 9:00 PM. No changes are proposed except the addition of beer andwine to the menu. 2. Area Description: A. Property: An irregular shaped parcel containing 1.07 acres and located on thewest side of Grand Avenue at the south side of the Garden Grove Freeway. B. Surrounding Development: north - freeway east - shopping center under construction south - motel west - apartment development C. Street System: Grand is a planned arterial street. D. Comparable Applications or 'Circumstances: . A number of minor exceptions have been approved for on sale beer and wine in bona fide restaurants within 300' of residential distri, cts. E.
