Heinly None Each member of the City Council having received copies of the Minutes of May 20, 1957, reading of the Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by Hall and carried. Hearing ~MaburyAnnex No. 2" Ordinance This being the date set for hearing protests on annexation to the City of certain uninhabited territory designated "Mabury Annex No. 2", and there being no protests, on motion of Councilman Markel, seconded by Hall and carried, the following Ordinance entitled: "Ordinance declaring the annexation of that certain territory designated 'MaburyAnnex No. 2'" Hearing "Mabury Annex No. 3" Ordinance was introduced, considered and placed on file for second reading. This being the date set for hearing protests on annexation to the City of certain uninhabited territory designated "Mabury Annex No. 3", communication vas read from T.A. and Jessie W. Boswell protesting the annexation of their property in one of the "Mabury Annexations". On motion of Councilman Markel, seconded by Hall and carried, the co~municatlon was received and filed. On motion of Councilman Markel, seconded by Gould and carried, the following Ordinance .entitled: "Ordinance declaring the annexation of that certain territory designated 'Mabury Annex No. 3'" was introduced, considered and placed on file for second reading. No. 57-146 This being the date set for hearing protests on annexation to the City of certain uninhabited territory designated "Segerstrom Annex NO. 3", and there being no pro- tests, on motion of Councilman Hubbard, seconded by Hall and carried, the follo~-lng Ordinance entitled: "Ordinance declaring the annexation of that certain territory designated 'Segerstrc~ Annex No. 3'" was introduced, considered and placed on file for second reading. This being the date set for hearing protests to amend Section 9114.3 of the Zoning Ordinance to provide for time limitations on Variances, and there being no protests, on motion of Councilman Hall, seconded.by Gould and carried~ the following Ordinance entitled: "Ordinance adding a new Section to the Santa Aha Municipal Code to place a time limitation on the effectiveness of any Variance during which the use permitted must be started" was introduced, considered and placed on file for second reading. This being the date set for hearing and no protests having been received, the amend- ment initiated by the Planning Commission was considered for the reclassification, from R-3 District to P-PK and C-1-PK Districts, properties situated within the area bounded by Main Street on the east, Broadway on the west, 20th Street on the south, and Eanta Clara Avenue on the north; and also~ to reclassify to C-1-PK District~ the existing C-2 District and the easterly lO0-foot portion of R-1 District found within the area bounded by Main Street, Broadway, Santa Clara Avenue, and the Santa Aha Freeway, with the exception that the parcel of land situated at the northwest corner of Main Street and Santa Clara Avenue, remain C-2 District as presently zoned. On motion of Councilman Hubbard, seconded by N~ll and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Ana Municipal Code creating changes in district boundaries, and amending Sheets No. 13 and 14 of the Districting Map to show the reclassification" was introduced~ considered and placed on file for second reading. This being the date set for hearing and no protests having been received, the amend- ment initiated by the Planning Co~mission was considered for the reclassification from R-2 to R-3 District, property o~ued by the City of Santa Aha amd leased to the Izaak Walton League of America, ~nc., upon which they propose to erect a Clubhouse, said property consisting of approximately 3.40 acres, situated near the Santa Ana River and immediately West of the termination of Santa Clara Avenue. On motion of Councilman Gould, seconded by Markel and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Aha Municipal Code creating changes in district boundaries, and amending Sheets No. 21 and 25 of the Districting Map to show the reclassification" was introduced, considered and placed on file for second re~ding. Councilman Markel disqualified himself on his amendment application to reclassify property on the east side of South Sycamore Street, between Edinger Street and Borchard Avenue, from R-3 to C-2 District. This being the date set for hearing on the amend- and no protests having been received, ment application of J. Ogden Markel explained the amendment application and requested that the three lots, 1427, 1431 and 14~5 South Sycsmore Street, be rezoned from R-3 District to C-2 District and stated off-street parking would be provided. Ogden Markel On motion of Councilman Hubbard, seconded by Hall and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Ana Municipal Code creating changes in district boundaries, and amending Sheet No. 31 of the Districting Map to show the reclassification" was introduced, considered and placed on file for second reading. Councilman Hubbard presented a merit certificate and a cash award to Paul Bernard DeCroix, who was the outstanding driver of the month in the Santa Ana Safe Driving Campaign. Mrs. Weston Walker presented a First Award Trophy for Civic Beautification won by the City in the Orange County Beautification Contest of 1957 which was accepted by Councilman A. A. Hall on behalf of the City. A tabulation of bids was presented by the Manager for the blacktopping of basket ball courts in Monte Vista Park, as follows: Sully-Miller Contracting Co. R.J.Noble Co. On motion of Councilman Hubbard, seconded by Hall and carried, the Clerk was author- ized to open the one bid for the publication of legal notices and other matters required by law to be published, for the fiscal year beginning July 1, 1957 and ending June 30, 1958, as follows: Santa Ana Register: First insertion, Saturday only, $1.35 per inch. On motion of Councilman Hall, seconded by Markel and carried, the recommendation of the Planning Commission was approved and the variance of Clara E. Vose, which was originally granted January 5, 1953, for a period of three years (1-5-5~ to 1-5-56); and renewal granted on September 26, 1955, for one and one-half year (1-5-56 to 7-5- period. 5,,7)t to operate a real estate office at 1320 Memory Lane, was extended for a two yea_~r/ On motion of Councilman Hubbard, seconded by Markel and carried, the recommendation of the Planning Commission was approved and the variance of Morris and Gloria Glasser granted to permit conversion of an existing residence on property at 710 Spurgeon Street, into an office for Certified Public Accountant, to be occupied by three persons, subject to conditions of the Commission and the Department of Public Works. A letter was read from Mr. and Mrs. Glasser agreeing to the conditions. Communication was read from the Planning Commission recommending denial of variance application of Church of Religious Science of Santa Ana to permit the use of garage on church property at 1209 Spurgeon Street, for a thrift shop in connection with the Church. On motion of Councilman Hall, seconded by Gould and carried, the recom- mendation of the Planning Commission was approved and the variance denied. On motion of Councilman Gould, seconded by Hubbard and carried, the recommendation of the Planning Commission was approved and the variance of Santa Ana Savings and Loan Association granted to permit the use of property at 1419 North Sycamore Street, for off-street parking for customers and employees, and also for customers of restaurant now located on the east portion of the property fronting on North Main Street, with exit and entrance to be provided on Fifteenth and Sycamore Streets, subject to conditions of the Department of Public Works. Communication was read fram the Planning Commission recommending approval of varianc~ application of A1 N. Zale to permit the erection of a 25' x 60' one-story metal building, on property at 1668 East Palm Street, to be used for the receiving and storage of food st~ffs for distribution to food catering trucks, subject to conditio~ of the Commission that the applicant comply with the provisions of the PK Ordinance, ~ but the Commission did not concur in the conditions as imposed by the Department of Public Works. Norman Lee Harvey~ representing the applicant, objected to the con- ditions as set forth by the Department of Public Works. It was moved by Councilman Hall, and seconded by Hubbard that the variance of A1 N. Zale be granted in accord- ance with recommendation of the Planning Commission subject to the PK Ordinance but without respect to the conditions of the Department of Public Works. Hubbard Absent, Councilmen None On motion of Councilman Hall, seconded by Hubbard and carried, the recommendation of the Planning Commission was approved and the variance of Cletues Eagles granted to permit construction of an additional single-family dwelling on westerly portion of property at 2325 west Sixth Street, subject to the condition that the owner replace broken sidewalk and install concrete drive approach, but not be required to pave between existing curb and center line of the street. Communication was read from the Planning Commission recommending an Ordinance be prepared regarding obstruction to sight distance at intersections, as approved by the Traffic Engineer. On motion of Councilman Markel, seconded by Hull and carried, the matter was referred to the Attorney for preparation of the Ordinance. Communication was read from the Planning Department recommending approval of Preliminary Map filed by the Southern Pacific Railroad Company, of property located on the south side of Delhi Road, beginning at a point 990 feet west of the center line of Main Street and Delhi Road, with a frontage of 500 feet on Delhi Road, and on motion of Councilman Gould, seconded by Hubbard and carried, the Preliminary Map was approved subject to the conditions of the Department of Public Works. Mrs. Loretta Wright, 2437 South Shelton Street, Esther Heyman, 1502 West St. Certrude Street and approximately twenty other persons protested the proposed location of the Electro-Data Division of Burroughs Corporation plant at the southwest corner of Bristol Street and Delhi Road for the reason the neighborhood is zoned R-1 and when they purchased their homes in the Tract they were assured the property would remain residential; they have waited ~ore than a year for stores and markets in the area, also, the proposed factory will increase traffic and devaluate their properties. i ' Nayor Heinly explained the property is not now in the C ty, is not the time for hearing and if and when the property is annexed and rezoned, a notice of public hearing will be published and the property posted according to law, at which time all protests will be heard. On motion of Councilman Gould, seconded by Markel and. carried, the protests as submitted and containing approximately 435 signatures against the location of the proposed plant, were received and filed. Communication was read from George H. and Margaret G. Rose, owners of 12.03 acres on the west side of Sullivan Street, approximately 330' north of Monte Vista Street~ adjacent to the west corporate limits of Santa Ana, in the County R-4 Zone, with a conditional use permit for a trailer park, and requesting some understanding con- cerning the permanent use of the property if it were annexed to the City. On motion of Councilman H~] 1, seconded by Hubbard and carried, the communication was received and filed. It was moved by Councilman Hubbard, seconded by Gould and carried, that the Council go on record as not objecting to the annexation and con- tinuation of the non-conforming use of the property. It was moved by Councilman Hubbard, seconded by Markel and carried, that escrow instructions be approved and signed for various properties from the following persons: Robert Aguilar - property located on Walnut Street betwmen Artesia and Daisy Streets, in the sum of $6,500.00; Harold Ebeling - property adjoining Eighth Reso.
