RESOLUTION NO. 76-48
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AFFIRMING THE ACTION OF
THE PLANNING COMMISSION ON VARIANCE APPLI-
CATION NO. 76-4, DENYING SAID VARIANCE
APPLICATION, AND DENYING APPEAL NO. 361

WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on April 19, 1976, on
Appeal No. 361 filed by Glen Gary Boyd in opposition to the
Planning Commission's denial of Variance Application No. 76-4.
NOW, THEREFORE, BE IT RESOLVED that based on such
public hearing and the oral and documentary evidence submitted
therein, the City Council of the City of Santa Ana does hereby
affirm the action of the Planning Commission denying Variance
Application No. 76-4 and does hereby deny said Variance Appli-
cation No. 76-4 and does hereby deny Appeal No, 361 filed there-
on in opposition to the Planning Commission's action.
BE IT FURTHER RESOLVED, that the City Council hereby
adopts as its findings of fact for denial of Variance Applica-
tion No. 76-4 those "Finding of Fact, VA 76-4" prepared and
submitted by the Planning Commission, attached hereto and incor-
porated herein as though fully set forth,
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its regula~ meeting held on the ]?th
day of May , 1976.

REASONS FOR ACTION:
A.. The proposed use would not a compatible w~th the existing established
residential and light commercial neighborhood.
There already is an over concentration of social welfare facilities in
the City that deals with problems on a County basis rather than a
restricted basis of the City only.
DETAILS OF PROPOSAL:
1. Description of Proposal:
The applicant is presently renovating a medical building that was built in
1955 to convert it to a six unit apartment building. Property is zoned for
apartments. The applicant is proposing to utilize the soon to be apartment
building for a half-way house for offenders.
The building will be converted as follows:
2 one bedroom units - 576 sq.ft.
2 two bedroom units - 770 sq.ft.
2 three bedroom units - 1276 sq.ft.
There is 22% open space and 4 private patios.
Total building area - 6448 sq.ft.
Open Space in front of building 2728 sq.ft.
£~ndscaping area in rear 1260. sq.ft.
Private patios four 6 x 12 patio areas.
Off street parking - 9 carports and 3 open space
The applicant proposes to utilize the building as follows:

It should be noted that there is not a similar facility in the entire County.
2. Area Description:
A. Property:
Subject property has 150' of frontage on Broadway and is 123' deep; total
area involved is 18,450 sq.ft.

north - beauty shop
east - multiple residential
south - fire station
west - duplexes
Street System:
Broadway is planned arterial highway.
D. Comparable Applications or Circumstances:
None in the City.
Surrounding Zoning: See attached SDM
Present Use:
Medical building in the process of being converted to apartments.
3. General Plan Compatiblity:
General Plan indicates multi-use corridor.
4. Staff Evaluation:
The neighborhood in which the project is proposed has not been highly
_impacted by social service and care-facilities. However, the City as a
whole has more than its proportionate share of said facilities as indicated
.in a presentation to the Planning Commission and City Council at a previous
date. In the County there are approximatelyi1397 care facilities of this
total approximateiy 17% are located in the City of Santa Aha. Total 246
'facilities. Due to the fact that there is already an over concentration
of social welfare facilities in the City of Santa Aha which deals with
problems on a County basis rather than a restricted basis of the City only.
it is recommended that the proposal should not be located in the City of
Santa Aha.
5. ]Reasons for Staff Recommendation:
'A. The proposed use would not be compatible with the existing established

6. If the Commission approves the application, the following standard requirements
must be met:
A. Planning: 1, 2, 3, 4, 13, 14
B. Public Works: 7, 16, 22c, d, 41, 43.

A.' Planning
4~ There shall be a minimum 20' x 60' landscaped area between the carports
and the open parking area.
2) This variance shall terminate at the end of a one year period at which time. the
Planning Department shall review the subject premises to determine if the
required conditions of the variance have been met and to determine whether
or not any problems have arisen due to this operation. The Planning Depart-
ment shall thereafter report to the Planning Commission, which may grant
extensions for a period of time.of one year under the same conditions or
under different conditions, without the necessity of filing an additional
extensions of this variance,.however, shall be subject to this same condition.
3) There shail be a maximum of 16 people living on the premises,

California Admin(strative Code (Public Safety} and the Uniform Fire
COde.
