RESOLUTION OF TRE CITY COUNCIL FINDING AND
DETERMINING THAT T~E ~JBLIC CONV~XE~E AND
NECESSITY ~EQUIRE CERTAXN PUBLIC IMPrOVE-
mENTS IN A SPECIAL ASSESSMENT DISTRICT AND
FURTHER STATING THAT THE SPECIAL ASSESS~ENT
INVESTIGATION, LIMITATION AND MAJORITY P~O-
TEST ACT DOES NOT A~PLY.
ASSESSMENT DISTRICT NO. 240
(SILVER ACRES)
WHEREAS, a public hearing, for which readable notice
hms been given by publication and posting , has ~een held as to
the ~blic convenience and necessity for the ~st~¢tion of cer-
tai~ ~4blic works of improvement and appurtenant i~rove~ents
in a special assessment district known and ~es~&t~ as
ASSESSMENT DISTRICT NO. 240
(SILVER ACRES)
(hereinafter referred to as the "Assessment District"); and,
WHEREAS, this City Council has heard and considered all
the evidence, both oral and written, relative to the public con-
venience and necessity of the construction of the aforesaid im-
provements; and,
WHEREAS, this City Council now is satisfied as to the
works of improvement now proposed,
NOW, THEREFORE, IT IS HEREBY RESOLVED BY T~E CITY
THE CITY OF SANTA ANA
FOLLOWS~
SECTION 1. That the above recitals are all true and
correct.
SECTION 2. That this City Council hereby finds and
~etermines that the public convenience and necessity require the
following work and improvements, to wit:
The construction of certain street improvements, including
clearing, grading, curbs and gutters, and driveway approaches
together with certain drainage improvements in the City of
Santa Ana, in a special assessment district known and desig-
nated as ASSESSMENT DISTRICT NO. 240 (SILVER ACRES).
SECTION 3. This City Council further determines that
the provisions and limitations of the "Special Assessment Investi-
gation, Limitation and Majority Protest Act of 1931' shall not be
applicable to proceedings for this improvement.
