HomeMy WebLinkAbout76-102Recorded August 20, 1976 9:05 a.m. Book 11859 Page 892 RESOLUTION NO. 76~02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA VACATING MARTHA LANE WEST OF PACIFIC AVENUE IN THE CITY OF SANTA ANA WHEREAS, this Council heretofore adopted, on July 19, 1976, a resolution No. 76-73, wherein it declared its intention to vacate pursuant to and in accordance with the provisions of Part 3 of Division 9 of the Streets and Highways Code of the State of California, Martha Lane west of Pacific Avenue, said portion of said street being specifically described in said reso- lution and reference being made in said resolution to a certain map on file in the office of the Clerk of the Council for full particulars as to such proposed vacation; and WHEREAS, said resolution gave notice that on Monday, the 16th day of August, 1976, at 7:30 p.m., or as soon thereafter as the matter can be heard, in the Council chambers of the City of Santa Ana, 20 Civic Center Plaza, Santa Ana, California, this Council would hear any and all persons interested in or objecting to said proposed vacation of said Martha Lane west of Pacific Avenue; and WHEREAS, this Council finds that said resolution has been published in the manner prescribed by law for the publishing of ordinances of the City; and WHEREAS, this Council further finds that notices of said proposed street vacation stating the purpose of said resolu- tion and the time and place set for hearing, were posted as directed by the Council and required by law; and WHEREAS, this Council, at the time and place set for hearing, has heard any and all persons interested in or objecting to said proposed vacation of said portion of said street, and has received and considered all evidence submitted; and WHEREAS, this Council finds, from all the evidence sub- mitted, that the following portion of the following street, des- cribed in the above mentioned resolution, is unnecessary for pre- sent or prospective public street purposes; and WHEREAS, pursuant to the provisions of Section 2381 of Chapter 8 of Division 3 of the Streets and Highways Code of the State of California, this Council does hereby find and determine that neither said portion of said street nor parts thereof is use- ful as bicycle paths or routes; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana that the following portion of Martha Lane west of Pacific Avenue in the City of Santa Ana, be and is hereby vacated: Ail of Martha Lane as shown in a map of Tract 1292, recorded in the office of the Recorder of Orange County in Book 46 of Miscellaneous Maps, page 5, and all of Martha Lane as shown in a map of Tract 758 recorded in the office of said Recorder in Book 23 of Miscellaneous Maps, page 26, west of a line 35' Westerly and parallel to the centerline of Pacific Avenue as shown on said map of Tract 758. The City Clerk is hereby directed to cause a certified copy hereof, attested by her under seal, to be recorded forthwith in the Office 6f the Recorder of Orange County.
