HomeMy WebLinkAbout76-104REL :nr 8-19-76 RESOLUTION NO. 76- 104 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA AlgA MODIFYING THE ACTION OF THE PLAN- NING COMMISSION ON CONDITIONAL USE PERMIT APPLI- CATION NO. 76-16, APPROVING SAID CONDITIONAL USE PERMIT APPLICATION, AND APPROVING APPEAL NO. 367 FILED THEREON BY CALVARY CHAPEL OF COSTA MESA WHEREAS, a public hearing was duly held before the City Council of the City of Santa Ana on August 16, 1976, on Appeal No. 367 filed by Calvary Chapel of Costa Mesa in opposition to a certain condition imposed by the Planning Coramission upon its approval of Conditional Use Permit Application No. 76-16; NOW, THEREFORE, BE IT RESOLVED, that based on such pub- lic hearing and the oral and documentary evidence submitted there- in, the City Council of the City of Santa Ana does hereby approve said Appeal No. 367, approve Conditional Use Permit Application subject to conditions as hereafter set forth, and modify the action of the Planning Commission thereon by revising the condition imposed by the Planning Commission. BE IT FURTHER RESOLVED, that the City Council hereby adopts as its findings of fact for approval of Conditional Use Permit Appli- cation NO. 76-16 that "Finding of Fact, Conditional Use Permit No. 76-16" prepared and submitted by the Planning Commission, attached hereto, except that section 6A(4) thereof is revised to read as follows: "That those areas adjacent to MacArthur Boulevard, which are shown as possible future parking or building sites, be land- scaped and maintained as lawn areas." BE IT FURTHER RESOLVED that said Conditional Use Permit Application is approved on condition of compliance with all require- ments set forth in the above-said findings as revised and on the additional condition that this conditional use permit shall be submitted for review by this Council at the expiration of twelve months hereafter, at which time this Council may supplement or modify the conditions of approval or initiate revocation proceed- ings for noncompliance with such conditions. DETAILS OF PROPOSAL:· Description of Proposal: , -. The applicant proposes to add a lO-acre site to the ex~Sting ll-acre .Calvary Chapel site at the northwest corner of Fairview Street and Sunflower Avenue. The existing Calvary Chapel site consists of the following: .1 office building 2 classroom buildings 1 nursery building 1 fellowship hall 1 sanctuary building Total '$,800 sq.ft. 21,750 sq.ft. 2,880 sq.ft. 6,000 sq.ft. 23,520 sq.ft. 59,960 sq.ft.' · Required parking for the facility, based on the seating capacity of the sanctuary, is 635 stalls; total existing parking is 686 spaces. The applicant proposes at this time Go add a 28,000 sq.ft, two-story class- room building and 622 parking spaces, for a total of 1,208 parking spaces. In addition, tentative plans call for a possible new sanctuary with a seating capacity of 4,70D. If the new sanctuary were to be constructed an additional 372 parkinq spaces would be added, thereby increasing the total number of available parking stalls to 1,580. This would exceed the required 1,567 parking s:alls by thirteen. If the new sanctuary were not to be constructed, the applicant is requesting that two church-related use buildings be permitted adjacent to MacArthur Blvd. In either case, the applicant is requesting that the Planni~)g Co~mdssion authorize the Planning staff to approve specific plans based upon the general plan that has been submitted as a part of this application. · CUP 76-16 Page 1 , CUP 76-i6 Calvary Chapel of Costa Mesa Area Description: .. Property: A rectangular shaped parcel with approximately 1,430 feet of frontage on Fairview Street, 650 feet of frontage on MacArthur Blvd., 630 feet of frontage on Sunflower Avenue, and a total area of approxi- mately gl acres. B. Surrounding Development: North: East: South: West: industrial building across MacArthur Blvd'. vacant property, mini-market, four-plexes across Fairview vacant property vacant property C. Street System: Sunflower Avenue, Fairview Street and MacArthur Blvd. are designated as planned arterial highways. O. Comparable Applications or Circumstances: Conditional Use Permits 71-11, 71-18 and 72-18 allowed the existing Calvary Chapel to be established on the subject property at the northwest corner of Sunflower Avenue and Fairview Street. .E..Surrounding Zoning: See attached SDH. F. Present Use: Existing church, church school, church-related buildings and vacant property. · 3, 'General Plan Compatibility: The General Plan indicates industrial for this location. Reasons for Staff Recommendation: A. The proposed project is a logical exoansion of an existing use that was previously approved under CUP 71-11, CUP 71-18 and CUP 72-18. The proposed project will not have any detrimental effect on the surrounding area. If the Commission approves the application, the following standard require- ments must be met: B. Public Works: l, 3, 7, 8a, 10, 13, 14, lS, 21a, b, c, d, f, 23, 24, 27, 29, 40, 41, 42, 43, 44 6. The following requirements must also be met: A. Planning l) That a revised plot plan be submitted showing 20-foot wide land- scaped setback areas along F~irview Street and MacArthur Blvd. as required by the recently adopted Ordinance NS 1301. 2) Prior to building permits, plot plans, floor plans and elevations of all buildings shall be submitted to the Planning Department for approval. Buildings to be in architectural conformance with existing buildings on the site. 3) That any and all proposed signing for the project be submitted to and approved by the Planning Department. 4) That the parking be expanded to the maximum stalls allowable on the site to meet the approval of the Planning Department. CUP 76-16 Page 2 CUP 76-16 Calvary Chapel of Costa Mesa Bo Publlc Works 1) Plug any private wells as requtred by City Code, County Health Department permit is required. 2) Dedications: a) MacArthur Blvd.: Vehicular access rights except at street intersection and approved drives. 'b.) Fatrvtew Street: Vehicular access rights except at street intersection and approved drives. NOTE: No breaks will be allowed in the existing median island in Fairview Street. · 3) Improvement Plans~ Fairview Street (existing Ctt~ Plan 1-38-8 " may be revised to show ornamental street .lights and drive approaches). 4) Improvements: a) MacArthur Blvd. with pavement to meet existing pavement and curb and gutter, sidewalks and ornamental street lights. b) Developer shall plant street trees on both streets as approved by the Parks Department for size, species and location. Fire Oeparltment : . l) Fire Department access shall comply with the Uniform Fire Code, 2) The buildings and their use shall conform to the regulations of Title 19, California Administrative Code (Public Safety) and the Uniform Fire Code. 'O. Police Department 1) Lighting for parking areas and walkways shall meet with standards of the Illuminating Engineers Society. This lighting is to be maintained at the recon~nended foot candle and wattage levels during the hours of darkness or in those areas which maintain darkness. 2) Exterior lighting shall have vandal resistant covers. 3) Interior night lighting shall be maintained in those areas that are visible from the street, all ground floors only. 4) Shurbbery, walls and storage areas be so designed as to prevent individuals from easily concealing themselves.
