A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA APPROVING AND RATIFYING DELIVERY
BY THE CITY MANAGER OF A LETTER TO THE MUSICIANS'
ASSOCIATION, LOCAL NO. 7 OF THE AMERICAN FEDERA-
TION OF MUSICIANS, AND AUTHORIZING THE CITY MANAGER
TO DELIVER SIMILAR LETTERS IN THE FUTURE.
WHEREAS, from time to time, it is necessary for the
City to seek to obtain permission from the owners of various
properties in the City for use thereof by the City; and
WHEREAS, said owners often require, as a condition
precedent to giving the City such permission, that the City
agree to indemnify and hold them harmless from liability that
might result from the City's use of such property; and
WHEREAS, time does not often permit such agreements
to be considered by the City Council before they must be delivered
to such owners,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SANTA ANA:
1. That that certain letter, signed by the City Manager,
dated October 22, 1976, and addressed to Emmett Frizell, Secretary-
Treasurer, Musicians' Association Local 7, 2050 South Main Street,
Santa Ana, California 92707 is hereby approved and the City Manager's
action in delivering the same is hereby ratified.
2. That the City Manager~is hereby authorized, in the
future, to execute and deliver to owners of property, who require
the same, similar letters wherein the City agrees to indemnify and
hold harmless such owners, whenever the requirements of time make
it impractical for the same to be submitted to this Council in
advance of the time when the City requires the use of the property
in question.
ADOPTED, this 15th day of November , 1976, by
the following vote, to wit:
AYES, COUNCILMEN: Evans, Brandt, Bricken, 0rtiz,
Yamamoto, Garthe, Ward
NOES, COUNCILMEN: None
ABSENT, COUNCILMEN: None
