HomeMy WebLinkAbout76-137REL:nr 10-2~-76 RESOLUTION NO. 76- 137 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING THE PROCEDURE FOR PREPARATION AND APPROVAL OF CONFLICT OF INTEREST CODES FOR THE SEVERAL OFFICES, DE- PARTMENTS, BOARDS, AND COMMISSIONS OF THE CITY OF SANTA ANA WHEREAS, the People of the State of California, by initiative measure, have enacted into law the Political Reform Act of 1974, which Act, in Chapter 7, Article 3 thereof, imposes upon each office, department, board, and commission of this City the obligation to prepare a Conflict of Interest Code, and upon this Council the duty to review and approve such Codes, in accor- dance with the requirements and limitations of the said Act; NOW, THEREFORE, BE IT RESOLVED that each of the follow- ing offices and departments shall be deemed a separate and dis- tinct "agency" within the meaning of the Political Reform Act of 1974, Chapter 7, Article 3 and shall prepare a Conflict of Interest Code in accordance with the requirements and limitations of the said Act, and the chief administrative officer of each such office and department shall be responsible for such prepara- tion: 1. The Office of the City Manager, which, for purposes of this Resolution, shall be deemed to include the Public Informa- tion Office, the Office of Budget and Management Analysis, the Disaster Services Office, the Office of Community Development, the Manpower Services Office, the Public Housing Services Office, and the Office of the Executive Director of the Community Rede- velopment Agency; 2. RESOLUTION NO. 76- 137 PAGE TWO BE IT FURTHER RESOLVED that the following boards and commissions shall likewise be deemed to be "agencies" within the meaning of the said Act and shall prepare Conflict of Interest Codes in accordance with the said Act, and each such board and Commission shall be assisted in the preparation of its Code by the following officers, who shall be responsible for scheduling such preparation on the agenda of the board or commission: 1. The Planning Commission, assisted by the Director of Planning. 2. The Personnel Board, assisted by the Director of Personnel. 3. The Human Relations Commission, assisted by the Director of Community Relations. 4. The Board of Recreation and Parks, assisted by the Director of Recreation and Parks. 5. The Redevelopment Commission, assisted by the Executive Director of the Redevelopment Agency. 6. The Museum Board, assisted by the Museum Director. 7. The Library Board, assisted by the Library Director. BE IT FURTHER RESOLVED that this Council hereby finds that the following boards and commissions are solely advisory in function and the members thereof are unsalaried; that the members thereof are therefore exempted from the Conflict of Interest Code provisions of the Political Reform Act; and that such boards and Commissions therefore need not prepare a Conflict of Interest Code: 1. The Transportation Advisory Committee. 2. The Disaster Council. BE IT FURTHER RESOLVED that the City Attorney is hereby instructed to prepare a standard format for Conflict of Interest Codes, containing such provisions as may be required by the Political Reform Act and as may be convenient for uniform adminis- tration of such requirements, and to distribute the same to the agencies required to prepare such Codes. BE IT FURTHER RESOLVED that, upon receipt of the above described standard format from the City Attorney, each agency required to prepare a Code shall proceed to prepare an appendix to such standard format which shall designate those officers and employees within the agency who make, or participate in making, decisions which may foreseeably have a material effect on any financial interest, and shall, to the extent possible, set forth the specific types of investments, interests in real property, and income which are to be reportable by such designated officers and employees. BE IT FURTHER RESOLVED that, in preparing Conflict of Interest Codes, the administrative head of each office and department, and each board and commission, shall insure that all officers, employees, members and consultants have adequate notice that the Conflict of Interest Code is in the process of prepara- tion and a fair opportunity to present their views. RESOLUTION NO. 76-137 PAGE THREE BE IT FURTHER RESOLVED that all agencies required to prepare a Conflict of Interest Code shall submit a proposed Code to the Clerk of the Council not later that February 1, 1977, and this Council shall establish a uniform public hearing procedure by which residents of the City of Santa Ana shall be given adequate notice and a fair opportunity to present their views prior to approval of any such Code by this Council.
