HomeMy WebLinkAbout76-155Book 12029 Page 1782 CTD:ar January 11, 1977 9:05 a.m. 12/16/76 RESOLUTION NO. 76-155 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA VACATING A PORTION OF THE ALLEY IN BLOCK "B" OF THE WILEY'S ADDITION TO THE TOWN OF SANTA ANA, LYING NORTH OF 17TH STREET, EAST OF MAIN STREET AND WEST OF BUSH STREET IN THE CITY OF SANTA ANA, CALIFORNIA. BE IT RESOLVED by the City Council of the City of Santa Ana: WHEREAS, this Council heretofore adopted, on Decem- ber 6, 1976, a Resolution No. 76-125, wherein it declared its intention to vacate pursuant to and in accordance with the provisions of Part III of Division 9 of the Streets and Highways Code of the State of California, a portion of the alley in Block "B" of the Wiley's Addition to the Town of Santa Ana, recorded in Book 17, page 36 of Miscellaneous Records of Los Angeles County, California, said portion of said alley being specifically described in said Resolution and reference being made in said Resolution to a certain map on file in the office of the Clerk of Council for full particulars as to such proposed vacations; and WHEREAS, said Resolution gave notice that on the 20th day of December, 1976, at 7:30 P.M. or as soon thereafter as the matter can be heard, in the Council Chambers of the City Council, at City Hall in the City of Santa Ana, 20 Civic Center Plaza, Santa Ana, California, this Council would hear any and all persons interested in or objecting to said pro- posed vacation of that said portion of the alley in Block "B" of the Wiley's Addition to the Town of Santa Ana; and WHEREAS, this Council finds that said Resolution has been published in the manner prescribed by law for the publishing of ordinances of the City; and WHEREAS, this Council further finds that notices of said proposed street vacations stating the purpose of said resolution and time and place set for hearing, were posted as directed by the Council and required by law; and WHEREAS, this Council at the time and place set for hearing has heard any and all persons interested in or objecting to said proposed vacation of said portion of said alley, and has received and considered all evidence submitted; and WHEREAS, this Council finds, from all the evidence submitted, that the said portion of the said alley described in the above mentioned Resolution, and described more fully in "Exhibit A" attached hereto, is unnecessary for present or prospective street purposes based upon the following find- ings of fact: 1. The alley will be relocated across Lot 7 to Main Street and will provide all adjacent properties with access to that public street. 2. The relocation of the alley will provide for safer traffic movement on 17th Street by removing alley access from 17th Street and relocating the access to Main Street which has approximately one-half the traffic volume as 17th Street. Access to a street with a lesser volume of traffic will decrease traffic conflicts. RESOLUTION NO. 76-155 PAGE TWO 3. Through the vacation of the alley, several narrow and undeveloped lots on either side of the present alley may be consolidated into a large building site which will permit an extensive development, thus adding consider- ably to the City tax base. 4. The new development, permitted through the consolidation of lots, will enhance the appearance of the general area. 5. The replacement of the vacated section of the alley with new construction materials will diminish the cost of maintenance to the City for a few years resulting in a savings of City operating cost. WHEREAS, pursuant to the provisions of Section 2381 of Chapter 8 of Division 3 of the Streets and Highways Code of the State of California, this Council does hereby find and determine that none of said alley, nor parts thereof, are useful as bicycle paths or routes; and NOW THEREFORE, this Council does hereby order that the portion of the alley in Block "B" of the Wiley's Addition to the Town of Santa Ana, lying North of 17th Street, East of Main Street and West of Bush Street in the City of Santa Ana, California, more fully described in "Exhibit A" attached hereto, be and is hereby vacated.
