HomeMy WebLinkAbout77-012Book 12048 - Page 359 January 26, 1977 11:05 a.m. CTD:rs 1-12-77 RESOLUTION NO. 77-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA VACATING A PORTION OF SECOND STREET AND THE D~LEYS ~N BLOCKS 6 and 7 OF THE "DAWSON AND CUMMINGS ADDITION TO THE TOWN OF SANTA ANA" BETWEEN LOWE STREET (VAN NESS AVENUE) AND ROSS STREET AND A PORTION OF THE EAST HALF OF LOWE STREET (VAN NESS AVENUE) BETWEEN FIRST AND THIRD STREETS IN THE CITY OF SANTA ANA, CALIFORNIA. BE IT RESOLVED by the City Council of the City of Santa Ana: WHEREAS, this Council heretofore adopted on December 20, 1976, a Resolution No. 76-149, wherein it declared its intention to vacate pursuant to and in accordance with the provisions of Part 3 of Division 9 of the Streets and Highways Code of the State of California, a portion of Second Street and the alleys in blocks 6 and 7 of the "Dawson and Cummings Addition To The Town of Santa Ana" between Lowe Street (Van Ness Avenue) and Ross Street and a portion of the East half of Lowe Street (Van Ness Avenue) between First and Third Streets, said portions of said streets and alleys being specifically described in said Resolution and reference being made in said Resolution to a certain Map on file in the office of the Clerk of the Council for full particulars as to such proposed vacation; and WHEREAS, said Resolution gave notice that on the 17th day of January, 1977, at 7:30 P.M., or as soon thereafter as the matter can be heard, in the Council Chambers of the City of Santa Ana, 20 Civic Center Plaza, Santa Ana, California, this Council would hear any and all persons interested in or object- ing to said proposed vacation of the said portions of Second Street and the alleys in blocks 6 and 7 of the "Dawson and Cummings Addition To The Town of Santa Ana" and said portion of the East half of Lowe Street; and WHEREAS, this Council finds that said Resolution has been published in the manner prescribed by law for the publishing of ordinances of the City; and WHEREAS, this Council further finds that notices of said proposed street vacations stating the purpose of said Resolution and time and place set for hearing, were posted as directed by the Council and required by law; and WHEREAS, this Council at the time and place set for hearing has heard any and all persons interested in or objecting to said proposed vacation of said portions of said streets and alleys, and has received and considered all evidence submitted; and WHEREAS, this Council finds from all the evidence submitted that the said portions of the said streets and alleys described in the above mentioned Resolution, and described more fully in "Exhibit A" attached hereto, are unnecessary for present or pros- pective street purposes based upon the following findings of fact: 1. The proposed vacation would eliminate traffic hazards by eliminating three internal intersections as well as eliminating access from driveways and parking areas onto the heavily traveled First and Third Streets. The elimination of the rights-of-way to be vacated will focus traffic flow onto the major arterial streets which will facilitate smoother traffic circulation through this area. 3. The proposed vacation will allow consolidation of the adjacent land area into larger blocks which will tend to result in an increased potential for growth, development and efficient land utilization thereon. 4. The vacation as proposed would eliminate current blight in the form of excessive rights-of-way resulting in frequent traffic intersections and would decrease the number of small inefficient blocks. WHEI{EAS, pursuant to the provisions of Section 2381 of Chapter 8 of Division 3 of the Streets and Highways Code of the State of California, this Council does hereby find and determine that none of said streets and alleys, nor parts thereof, are useful as bicycle paths or routes; and NOW, THEREFORE, this Council does hereby order that the portion of Second Street and the alleys in block 6 and 7 in the "Dawson and Cummings Addition To The Town of Santa Ana", between Lowe Street (Van Ness Avenue) and Ross Street, and that portion of the East half of Lowe Street (Van Ness Avenue) be- tween First Street and Third Street in the City of Santa Ana, County of Orange, State of California, more fully described in "Exhibit A" attached hereto and made a part hereof by this refer- ence, be and are hereby vacated. the ADOPTED, this 17th day of January , following vote, to wit: AYES, COUNCILMEN: ~van$, 0rtiz, Bricken~ Garthe, Brandt, Ward NOES, COUNCILMEN: None 1977 by Yamamoto, ABSENT, COUNCILMEN: None ATTEST: CLERK OF THE COUNCIL APPROVED AS TO FORM: KEITH L. ~OW CITY ATTORNEY That portion of Second Street, 50 feet in width and those portions of those certain alleys 14 feet in width as shown on a Nap of Blocks 6 ~d 7 of the "Dawson and Cun~nings Addition to the Town of Santa Ana". recorded in Book 13, page 47, of Miscellaneous Records of Cos Angeles County, California, hounded Westerly by the East line of Lowe Street .(VaQ~Ness Avenue}, 60 feet in width, as shown on said map; and bounded Easterly by a line parallel with'and distant Westerly 15 feet, l~easured at right angles, from the West line of Ross Street, §0 feet ~dtb, ~s shown on said map. Also that portion of the East half of Lowe Street (Van Ness Avenue) bounded Northerly by the South line of Third Street, as shown on said ma@~"~nd bounded Southerly by a line parallel with and distant Northerly 40 feet, measured at right angles, from the North line of [(rst Street as shown on said map.
