HomeMy WebLinkAbout77-044EJC:adg 4/8/77 RESOLUTION NO. 77-44 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA STATING AND DECLARING THE RESULTS OF THE CANVASS OF THE GENERAL MUNICIPAL ELECTION HELD IN THE CITY OF SANTA ANA, CALIFORNIA, ON A~RIL 5, 1977. WHEREAS, The City Council of the City of Santa Aha, by Ordinance NS-1346, duly called for and provided for the holding of a General Municipal Election on April 5, 1977, to fill vacancies in public offices; and WHEREAS, Notice of said election, notice of nominees for public office, and notice of the election officers and polling places were regularly given in time, form and manner as provided by law; the sample ballots, the statements sub- mitted by the candidates for public office, and the arguments submitted for and against the proposed Charter Amendment which is set out in "Exhibit B" attached hereto and made a part hereof, including the City Attorney's analysis, were regularly mailed to all electors within the City; and said election on said date was duly held at the polling places designated and the votes cast thereat were canvassed and the returns thereof made in the time, manner, and form provided by law; and WHEREAS, on the 12th day of April, 1977, the City Council of the City of Santa Ana has duly assembled at its usual place of meeting, the returns of said election having been canvassed by the Clerk of the Council pursuant to Reso- lution No. 77-7. NOW, THEREFORE, the City Council of the City of Santa Ana does hereby resolve, determine, and order as follows: That the General Municipal Election was duly held on April 5, 1977, and the votes cast thereat were duly and regularly canvassed and the returns thereof made in the time, form, and manner required; that all things were regularly done as required by law; that the absent voter ballots were duly canvassed and counted as required by law, and the result of such count is hereinafter set forth on Exhibit A, attached hereto and made a part hereof; that the Clerk of the Council has duly canvassed the returns of said election and from the said returns, it appears, and the City Council finds, that the total number of votes cast in each precinct for each person and the proposed charter amendment, the number of votes cast in the City to each person and the charter amendment, the whole number of votes cast in the City, and the total number of absentee votes cast in the City, are as set forth on Exhibit A attached hereto and made a part hereof. BE IT FURTHER RESOLVED, that at said General Municipal Election Gordon Bricken, residing in Ward One, James Ward resid~ ing in Ward 3, John Garthe residing in Ward 5, and Harry Yamamoto residing in Ward 7, were elected to offices of Member of the City Council for terms of four (4) years; and The Charter Amendment was adopted by a majority of the electorate. IZ 20 18 ? 33 583 6 ~0 Z2 38 10 14 3T Z3 ~5 8 6Z ~8 8 96 OF 96 PREC[NC[5 R[PORTiNG Z OF TURNOUT [~Z RESOLUTION NO. 77~44 EXHIBIT B BALLOT LANGUAGE OF MEASURE TO BE VOTED ON AT MUNICIPAL ELECTION CITY OF SANTA ANA, APRIL 5, 1977: ELECTIONS: Shall Sections 400, 401.1, 403, 1201, 1203 and 1204 of the Santa Ana Charter be amended to allow the City Council to authorize con- solidation of general municipal elections with other elections and to prescribe an election date earlier than the first Tuesday in April for purposes of such consolidation; to retain the second Tuesday in April as the beginning date for terms of office of Council Members, whether or not an earlier election date is authorized; and to eliminate obsolete references to Cities of the sixth class? EXHIBIT B
