RESOLUTION NO. 77-59
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA APPORTIONING
COSTS OF STREET IMPROVEMENTS.
WHEREAS, Sections 33-41 and 33-42 of the Santa Ana
Municipal Code authorize the City Counc~to establish the
portion of the total cost of a public street improvement pro-
ject payable from City money upon the installation thereof by
private persons; and
WHEREAS, Home Federal Savings and Loan Association
of San Diego (hereinafter referred to as "Developer") is required
to install certain street improvements as a condition to obtaining
a building permit pursuant to Section 33-47 of said Code; and
WHEREAS, Developer is willing to install certain street
improvements, as designated by diagonal shading on Exhibit A
attached hereto and incorporated herein by this reference, in
addition tO and concurrently with the installation of the above-
said required improvements provided Developer receives compen-
sation for the costs of said additional improvements from the
City of Santa Ana;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Santa Ana, as follows:
1. In the event that Developer installs the public
street improvements designated in Exhibit A, Developer shall be
compensated for the costs thereof up to a maximum of two thou-
sand dollars ($2,000.00) subject to the terms and conditions
hereinafter set forth.
2. Developer shall comply with all the requirements
of Santa Aha Municipal Code Sections 33-26 through 33-40 per-
taining to street improvement work permits.
3. Developer shall, in compliance with Santa Ana
Municipal Code Section 33-32(2), file a certificate of insurance
indicating liability coverage in accordance with Section 7 of the
AGC-APWC Green Book, naming the City of Santa Ana and its officers,
agents, and employees as additional insureds, and prohibiting
cancellation or reduction of coverage except upon thirty (30) days
prior notice to all insureds.
4. Developer shall not contract for an improvement
project which includes the street improvements designated in
Exhibit A except after having invited bids from a least three
contractors and obtained the consent of the Director of Public
Works to the acceptance of any such bid by Developer. The Director
may require submission of additional bids or reject all bids. Bids
shall apportion costs between the improvements designated in Ex-
hibit A and any other improvements to be constructed by Developer's
street improvement project.
5. The costs of the improvements designated in Exhibit
A shall be the amount apportioned thereto in the bid accepted by
Developer with the consent of the Director of Public Works, sub-
ject to the maximum specified in Section 1 hereinabove.

6. Upon the certification by the Director of Public
Works that the work has been safisfactorily completed, he shall
notify the Director of Finance of the amount due to Developer
pursuant to Santa Ana Municipal Code Section 33-42.
