Book 12239 Page 889 CTD:nr 5-24-77 RESOLUTION NO. 77-62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA VACATING A PORTION OF THE WEST HALF OF LOWE STREET (VAN NESS AVENUE) BETWEEN FIRST AND THIRD STREETS IN THE CITY OF SANTA ANA, CALIFORNIA BE IT RESOLVED by the City Council of the City of Santa Ama: WHEREAS, this Council heretofore adopted on May 16, 1977, a Resolution No. 77-56, wherein it declared its intention to vacate pursuant to and in acccordance with the provisions of Part 3 of Division 9 of the Streets and Highways Code of the State of California, a portion of the west half of Lowe Street (Van Ness Avenue) between First and Third Streets in the City of Santa Ana, California, said portion of said street being specifi- cally described in said Resolution and reference being made in said Resolution to a certain map on file in the office of the Clerk of the Council for full particulars as to such proposed vacation; and WHEREAS, said Resolution gave notice that on the 6th day of June, 1977, at 7:30 p.m., or as soon thereafter as the matter can be heard, in the Council Chambers of the City of Santa Ana, 20 Civic Center Plaza, Santa Ana, California, this Council would hear any and all persons interested in or objecting to said proposed vacation of the said portion of the west half of Lowe Street (Van Ness Avenue); and WHEREAS, this Council finds that said Resolution has been published in the manner prescribed by law for the publishing of ordinances of the City; and WHEREAS, this Council further finds that notices of said proposed street vacations, stating the purposes of said Resolution and time and place set for hearing, were posted as directed by the Council and required by law; and WHEREAS, this Council at the time and place set for hearing has heard any and all persons interested in or objecting to said proposed vacation of said portion of said street and has received and considered all evidence submitted; and WHEREAS, this Council finds from all the evidence submitted that the said portion of the said street described in the abovementioned Resolution, and described more fully in "Exhi- bit A" attached hereto, is unnecessary for present or prospec- tive street purposes based upon the following findings of fact: 1. The proposed vacation would eliminate traffic hazards by eliminating two internal intersections as well as eliminating access from driveways and parking areas onto the heavily traveled First and Third Streets. 2. The elimination of the rights of way to be vacated will focus traffic flow onto the major arterial streets which will facilitate smoother traffic circulation through this area. 3. The proposed vacation will allow consolidation of the adjacent land area into larger blocks which will tend to result in an increased potential growth, development and effi- cient land utilization thereon. The vacation as proposed would eliminate current blight in the form of excessive rights of way resulting in fre- quent traffic intersections and would decrease the number of small inefficient blocks. WHEREAS, pursuant to the provisions of Division 3, Chapter 8, Section 2381 of the Streets and Highways Code of the State of California, this Council does hereby find and determine that none of said street, nor parts thereof, are useful as bicy- cle paths or routes. NOW, THEREFORE, this Council does hereby order that the portion of the west half of Lowe Street (Van Ness Avenue) between First Street and Third Street in the City of Santa Aha, County of Orange, State of California, more fully described in "Exhibit A" attached hereto and made a part hereof by this reference, be and is hereby vacated. GOW, City Attorney LEGAL DESCRIPTION That portion of the West half of Lowe Street (Van Ness Avenue) as shown on a Map of "Dawson and Cummings Addition to the Town of Santa Ana", recorded in Book 13, page 47, of Miscellaneous Records of Los Angeles County, California, bounded Northerly by the South line of Third Street as shown on said Map, and bounded Southerly by a line parallel with and distant Northerly 40 feet, measured at right angles, from the North line of First Street as shown on said Map.
