RESOLUTION NO. 77-64
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA REVERSING THE ACTION OF THE PLANNING
COMMISSION ON VARIANCE APPLICATION NO. 77-19 AND
DENYING SAID VARIANCE APPLICATION NO. 77-19 AND
GRANTING APPEAL NO. 378 FILED THEREON
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on June 6, 1977, on
Appeal No. 378 filed by Don Drysdale's Dugout Restaurant in
opposition to the Planning Commission granting of Variance
Application No. 77-19 filed by Lyon Avenue Associates to
allow an indoor recreational facility in the C-5 District,
and
WHEREAS, the Planning Commission approved such
Variance Application on May 9, 1977,
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Santa Ana:
1. That based on such public hearing and oral and
documentary evidence submitted therein, the City Council does
hereby reverse the action of the Planning Commission approv-
ing said Variance Application No. 77-19 and does hereby deny
said Variance Application No. 77-19 and grants Appeal No.
378.
2. That the City Council hereby finds that no
special circumstances applicable to the subject property
described herein exist, and that the strict application of
the zoning ordinance does not deprive the subject property of
privileges not otherwise at variance with the intent and
purpose of said zoning ordinance.
