RESOLUTION NO. 77-66
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA REVERSING THE ACTION OF THE
PLANNING COMMISSION ON VARIANCE APPLICATION
77-11 AND APPROVING SAID VARIANCE APPLICATION
AND APPEAL NO. 376.
W}~REAS, a public hearing was duly held before the
City Council of the City of Santa Ana on June 20, 1977, on the
action taken by the Planning Commission in denying Variance
Application No. 77-11, which application seeks to allow self-
service gas pumps on an existing market site in the C-5
District, and
WHEREAS, the Planning Cox~ission denied such applica-
tion on April 11, 1977, and
WHEREAS, prior to taking action on said Variance
Application, this Council has reviewed and considered the nega-
tive declaration for the project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Santa Ana as follows:
1. That based on such public hearing and oral and
documentary evidence submitted therein, the City Council does
hereby reverse the action of the Planning Commission denying
said Variance Application 77-11 and does hereby approve said
Variance Application and grants Appeal No. 376.
2. That the City Council approves the findings con-
tained in the negative declaration and finds that the project
will not have a significant effect upon the environment.
3. That the City Council adopts as its findings of
fact for approval of Variance Application No. 77-11 the Findings
of Fact, Variance Application No. 77-11, prepared and submitted
by the Planning Commission, on file with the Clerk of the Council
and incorporated herein as though fully set forth, except as the
same are inconsistent with the action herein taken in approving
said Variance, and approyes said Variance Application subject
to the conditions set forth therein. The City Council further
expressly finds that the proposed use is not inconsistent with
uses permitted in the C-5 District.
