Present: Councilmen Absent: Councilmen Royal E. Hubbard, Stanley C. Gquld, Jr., A. A. Hall~ J. Ogden Markel, Dale H. Heinly None The Pledge of Allegiance wasgiven. Invocation was given by Reverend Rhodes ~.~rtin of the Spurgeon ~morial M~thodist Church. Each member of the City Council havir~g received copies of the Minutes of January 6, 1958~ reading of the Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by Gould and carried. Bid acceptance Radio telephone equipment The Manager presented a tabulation of bids for the furnishin~ of one servi~car motorcycle radio, including all accessories, two solocycle motorcycle radios~ includir~ all accessories and fourteen mobile units~ including all accessories, per Specification No. 654-3, as follows: Orange County Radiotelephone Service Net cost to City $8,200.00 Motorola Communications &Electronics,Inc. ' ....... $9,165.41 On recommendation of the Manager and on motion of CounciLman Gould, seconded by Markel and carried, the low bid of Orange County Radiotelephone Service, at a net Hearing Improve Delhi and other streets Assessment Dist. No. 197 Reso. No. 58-14 cost of $8,200.00 was accepted and the other bid rejected. The Mayor announced this is the time and place for hearing evidence to determine whether the public convenience and necessity require the improvement of Delhi Stree' and others by paving and other work, in Assessment District No. 197, and asked the Clerk if she was in possession of the affidavit of publication and affidavit of posting. The Clerk stated she had the affidavit of publication and affidavit of posting, and on motion of Councilmau Hubbard, seconded by Hall and carried, the affidavits were received and filed. The Clerk stated there were no written pro- tests. The Mayor asked if there were any oral protests, and there being none~ on motion of Councilman Gould, seconded by Hall and carried~ the hearing was closed. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Gould and carried, the following Resolution entitled "Resolution No. 58-14 of the City Council of the City of Santa Ana, California, finding that the public convenience and necessity require the improvement of Delhi and other streets all within the City of Santa Ana" Reso. No. 58-15 Declaring intention to improve Delhi and other streets Assessment District No. 197 c~?o Continued hearing Amendment Francis X. Heinly None None The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Gould and carried, the following Resolution entitle "Resolution No. 58-15 of the City Council of the City of Santa Aha, California, declaring its intention to improve Delhi Street and others within the City of Santa Aha, and determining that bonds shall be issued to represent the cost therefor, and declaring the work to be of more than local or ordinary public benefit and that the expense thereof shall be assessed upon a district" setting the date of hearing on February 17, 1958, was considered and passed by the following vote: Ayes, CounciLmen Noes, Councilmen Absent, Councilmen Royal E. Heinly None None This being the date set for the continued hearing, the smendment application of Francis X, Shoen was considered for the reclassification of property situated on the south side of Delhi Road, extending from a point 135 feet east of the southeast corner of Delhi Road and Main Street to the west side of Orange Avenue, with a depth of approximately 205 feet on all of the property fronting on Delhi Road (approximately 5h5 feet) the two parcels at the southwest corner of Delhi Road and 0r~nge Avenue (faeir%% Or,nEe Avenue) extending approximately 150 feet south of Delhi Road, from the R-1 and R-~ Districts to C-2-1K<~ District. A.A.Oliver, ~15 East Delhi Road, spokesman for a group, protested the amendment and stated that changing an R-1 District into a C-~ District is not good. planning; the lots on their side of the street are too small, parking would not be available and there are fifteen or twenty G.I. residences in the area; also they have been mmable to learn what the property will be used for but heard that a storage yard is to be established. Mr. Heyman, ~310 South Orange Avenue,objected to the zone change and stated the neighbors want residences and not business or commercial uses. On motion of CounciLman Gould, seconded by Hubbard and carried, the protests were received and filed. Jack Gilbert, representing the applicant, said the property is not suitable for residential development and believes it is a reasonable request for the chan~e to C-2 District. The applicant does not have a concrete plan for the property, but would settle for a C-1 District. It was noted that owners of Lots 6, 7 and 8 did not sign the'~nendment application for chan~e of zone and owners of Lots 26 and 27 signed the protest petition. It was moved by Councilman Gould, seconded by Hubbard and carried, that action be continued for two' weeks and the Manager instructed to write a letter to the owners of Lots 6, ? and 8 request- ing their presence at the meeting of the Council on February 3, 1~58. This being the date set for hearing and no protests having been received~ the amendment initiated by the Planning Con~ission %~s considered tO modify the exist- ina "P" District classification of property situated on both sides of North Broad- way, from first alley north of 17th Street' to Santa Clara Avenue, by adding thereto (Parking District requirements) resulting in a P-PK District classificatior on said property. On motion of Councilman Hubbard, seconded by Gould and carried the following Ordinance entitled: "Ordinance amending Artidle IX of the Santa Ana ~nicipal Code creating changes in district boundaries and amending Sheet No. lk of the districting map to show the reclassification" was introduced, considered and placed on file for second reading. 395 Amendment Erwin Eisenbraun et al ~ ~ap of Tract No. 5245 Orange County Development Company ~ ~ Variance G. Nardulli and alley abandonment This being the date set for hearing, the amendment application of Erwin Eisenbraun, et al was considered for reclassification, from R-1 and R-2 Districts to R-~ District, of property bounded on the north by Sixth Street, on the east by the Santa Ana Freeway, on the south by first alley south of Fourth Street, and on the west, in part, by Eastside Avenue, and in part by a line parallel to and 1BO feet of the east side of Eastside Avenue. The Planning Commission recommended denial of amendment application. Attoyney Arthur Nisson, representing the applicant, said they would consider having the property rezoned to an R-2 District instead of R-~ District. On motion of Councilman Hall, seconded by Could and carried, the recommendation of the Planning Commission was approved and the amendment application of Erwin Eisenbraun, et sl denied, without prejudice, so that the applicant may re-apply during the next six months for zone change to R-2 District. On motion of Councilman Hubbard, seconded by Gould and carried, Map of Tract N~. 5245 filed by Orange County Development Company, for the dedication of Lingan Lane, Dahl Lane, Poplar Street and alleys, and bond in the amount of $~5,000.00 were approved, license payment fee in the sum of $1~50.00 accepted and ~greement cover- lng improvements was ordered signed. On motion of Councilman Gould~ seconded by Markel and carried, the recommendation of the Planning C~ission ~as approved and the variance application of G.J.Nardull~ granted to permit the construction of a five-unit apartment building on property located at the northwest corner of Valencia Avenue and the Freeway ramp, in accord- ance with new plot plan submitted and subject to conditions of the Department of Public ~orks, the Planning Ccem~iss~on and the further condition that the dedicated ~ariance Wise Service Welding ~ ~ Variance George A. On motion of Councilman Markel, seconded by Gould and carried, the copy of commnni cation of the Chamber of Commerce to C.M.Featherly, Supervisor District No. 1, recommending the appointment of Bob Fernandez on the Airport Commission and copy of Resolution endorsing the establishment of an Airport Commission, were received and filed.
