HomeMy WebLinkAbout77-073EJC:adg 6/27/77 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA REPEALING RESOLUTION 76-66 AND ESTABLISHING REVISED SCHEDULE OF RATES FOR REFUSE COLLECTION EFFECTIVE AUGUST 1, 1977. WHEREAS, Article II, Chapter 16 of the Santa Aha Municipal Code provides for refuse collection regulation and authorizes the establishment of charges for the collection and disposal of refuse by resolution; and WHEREAS, Resolution 76-66 established rates for collection and disposal of refuse including rates for com- mercial containers which have been in effect since October 1975; and WHEREAS, increased costs now require an upward adjustment in residential collection charges; NOW, THEREFORE, BE IT RESOLVED: That Resolution 76-66 is repealed, effective August 1, 1977. BE IT FURTHER RESOLVED: That the rates hereinbelow set out are the rates that shall be due to the City for the collection and disposal of refuse and/or for standby or the availability of said service. Said rates shall be added to the rate charges for water service and billed with the bill for water service. Any residential, commercial, or industrial occupancy not served by a separate water meter, shall be sep- arately billed for standby collection and refuse disposal service. All rates for such services shall be due and payable at the Finance Department in the City Hall on the date of billing therefor and become delinquent fifteen (15) days from and after the date of such billing. A penalty of 10% shall be charged on all unpaid bills for such service thirty (30) days from and after the billing date. BE IT FURTHER RESOLVED: That the rates to be charged for standby collection and refuse disposal service are hereby established in accordance with the schedule hereinafter set out: Schedule of Rates for Refuse Collection and Standby Service 1. The basic rate for each single family residence for each two months, or part thereof, shall be f~urdollars and seventy-six cents ($4.76). 2. The basic rate for each duplex family residence for each two months, or part thereof, shall be seven dollars and eighty cents ($7.80). 3. The basic rate for all triplex family residences for each two months, or part thereof, shall be ten dollars and sixty-eight cents ($10.68). RESOLU~I'ON NO. 77-73 Page Two 4. (a) Each commercial and each industrial occupancy and any other occupancy not expressly provided for herein shall pay the basic rate of four dollars and seventy-five cents ($4.75) for each two months~ period for the standard curb- side refuse collection services which conform to the standard requirements of the City as set forth in paragraph 4b below. These charges are to be paid to the City for standard curbside refuse collection. If an agreement is made with the City's refuse collection contractor for additional or special collection services, all charges for extra service will be billed and collected directly by the contractor. (b) The City charges listed in paragraph 4a above apply only to refuse services which conform to standard requirements of the City, such as, total of 200 pounds or four cubic yards limit, standard 32-gallon metal or plastic containers, placement at curb or in alley, once weekly, and all other regulations. Any service received or special arrangements made in addition to or greater than these standard requirements shall be handled by agree- ment directly with the contractor, in addition to the billing by the City as provided herein. Collections beyond the once a week pickup by the City may be provided by agreement with the contractor and shall be based on the commercial container (dumpster) rates for similar amounts of refuse and frequency of collection. Users of rented container (dumpster) service will not be charged by City for standard curbside refuse collection. (c) The following are the authorized rental rates to be charged for refuse collection containers (dumpsters) by the refuse collection contractor. NOTE 2: Additional charges are authorized in those cases where containers must be rolled out to the collection point by the trash collector, or where other problems substantially increase the contractor's costs. NOTE 3: Rental agreements must be with the City's refuse collection contractor. 5. (al It shall be mandatory that residential buildings with four or more dwelling units be served by com~ercial refuse containers (dumpsters), obtained through agreement with the City's refuse collection contractor. The requirement for manda- tory containers may be waived for residential buildings existing on January 1, 1972, upon a finding by the Uirector of Public Works that no space is available for such container within the boundary lines of subject property. In no case, however, shall container locations be permitted in the front yard set-back or within areas required for meeting the minimum off-street parking require- ments of applicable zoning regulations. Any appli- cant who has been denied a waiver by the Director of Public Works may appeal such action to the City Council by filing within thirty (30) days after such denial, a written statement of his reasons why the City Council should reverse the action from which the appeal is taken. (b) If space for a commercial container is not available as determined above, the City's fee schedule shall apply as follows: Monthly Cost NO. BE IT FURTHER RESOLVED: That the charges provided for herein to be collected by the City shall be added to the water bill or separately billed each two months.
