Pre sent: Councilmen Absent: Councilmen Royal E. Hubbard, Stanley C. Gould, Jr., A.A.Hall, J. Ogden Markel~ D~le H. Heinly None The Pledge of Allegiance was given. Invocation was given by Reverend Garland Lacey of the Wilshire Dial-A-Prayer Presbyterian Church. Each member of the City Council having received copies of the Minutes of April 7, 1958, reading of the Minutes was dispensed with and approved on motion of Councilman Gould, seconded by Hall and carried. Presentation of gifts Edwin H. Armstrong presented to Mayor Heinly and the Council an album of plct~res, the flag of Santa Ana,E1 Salvador, Central America and a silver plate which was inscribed by the Mayor. The gifts w~re accepted with sincere appreciation and Record of Survey Map - Faith Evangelical United Brethren Church thanks by Mayor Heinly. On motion of Councilman Hubbard, seconded by Hall and carried, the Record of Survey Map filed by FaDth .Evangelical United Brethren Church on property situated at the northwest corner of Raitt Street and Fairview Avenue, was approved and proper Reso. No. 58-102 Accept easement deed and grant deed - Faith Evangelical United Brethren Church officials authorized to execute agreement in lieu of fili~ a $10,000.00 bond. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Hall and carried, the following Resolution entitled~ "Resolution No. 58-102 accepting easement deed for street purpose and grant deed for two parcels south of R~itt Street" from Faith Evangelical United Brethren Church, was considered and passed by the following vote: Map of Tract No.3293 Lemon Heights Invest- ment Co..Z ~j Ayes, Councilmen Royal E. Heinly Noes, Councilmen None Absent, Councilmen None On motion of Councilman Markel, seconded by Hall and carried, Map of Tract No. 3293 filed by Lemon Heights Investment Company, for the dedication of Wisteria Place, Beverly Place, Normandy Place, Harwood Place~ McFadden Street, Standard Avenue and alleys, and all vehicular access rights on McFadden Street and Stand~rd Avenue, and bond in the amount of $45,500.00 were approved, license payment fee in the sum of Preliminary Standard Pressed , Steel Co. $1800.00 accepted and agreement covering improvements was ordered signed. On motion of Councilman Hubbard, seconded by Hall and carried, the Preliminary Map having been approved on September 16, 1956 and Final Map approved by the County Surveyor January 9, 1958, on property located on the east side of Harbor Boulevard, i Preliminary Record of Survey Map filed by Henry Jones Corp. for Trino M. Reynoso 2476 feet north of Talbert Avenue, of Standard Pressed Steel Company, agreement was ordered signed by officials and bond in the amount of $12,000.00 approved to cover the improvements on the property. Communication was read from the Plannin~ Department reference Preliminary Record of Survey Map filed by Henry Jones Corporation, for Trino M. Reynoso, on property situated at the northwest corner of Evergreen Street and St. Andrew Place, recom- mending disapproval of the map due to the physical conditions evolving from this subdivision of property and the probable effect upon the valuation of the property on the "prospective" key lot. Attorney John D. Cochran requested the approvs2 of the map, as presented. On motion of Councilman Gould, seconded by Markel and carried, action was continued until the next meeting. 446 Variance Communication was again read from the Planning Commission recommen~in~ approval of ~ Vernon W. Hudson II c~.~ variance of Vernon W. and Ruth Hudson to permit construction of a two-f~mily duplex: Variance Church of Christ of Santa Aha Variance Harold and David Wener Variance Lenney Homes, Inc. Variance Olson Realty Co. with two bedrooms each unit, at the rear of existing single-family residence on front portion of the lot, on property situated at 1517 Durant Street, in an District, with a four-car detached garage with paved apron to the alley, to the rear of proposed duplex, and a decrease in rear setback line from 10' to 9' in orde to maintain proper distances between buildings. Douglas Welch submitted an smende~ plot plan which involved a smaller buildings, reducing the square footage, and on motion of Councilman Gould, seconded by Markel and carried, the plan, as amended, was received and filed. On motion of Counc~lm~n Gould, seconded by Markel and carried, the variance application was approved, according to the amended plot plan, and subject to the condition that additional car pad be completed, with the two- single-car detached garages. On motion of Councilman Gould, seconded by M~rkel and carried, the recommendation of the Planning Commission was approved and the variance of Church of Christ of Santa Ana granted to permit the construction of a church auditorium and bible schoo classrooms, with parking facilities, in accordance with plot plan, on property situated on the west side of King Street between Judith Lane and Eleventh Street, if extended west, in an R-1 District, subject to conditions. Communication was read fram the Planning Commission recommending approval of variance application of Harold and David Wener to permit the construction of a 21- unit motel with 21 parkiag stalls, %rith single-story units across the rear part of the lot, and two-story un_its along the east side of the property, with parking spac, along the west side of the property; also 31 parking stalls for the proposed six stores at ll20 West 17th Street, in C-1-PK and R-1 Districts, in accordance width revised plan "C". Charles B. ~nispel, 1115 W. 16th Street and Eric I. Jorgensen, lll9 W. 16~h Street, protested the construction of the motel, in an R-1 District. Attorney Milford Dahl spoke on behalf of the applicants. On motion of Councilman Hall, seconded by Markel and carried, the recommendation of the Planning Commission was approved and the variance granted subject to all conditions. Gould, Jr., None seconded by Gould and carried, the recommendation of the Planning Commission was approved and the variance of Lenney Homes, Inc., granted to erect a temporary directional sign (8' x 10') on the northeast corner of property situated at 1502 East 17th Street, in an R-1 District, to direct traffi south on Linwood Avenue to Unit No. 20, Cameo Park Estates, a tract of 48 houses, located one block south of 17th Street, east of Linwood Avenue, subject to a con- dition. On motion of Councilman Hall, seconded by Hubbard and carried, the recommendation of the Planning Commission was approved and the variance of Olson Realty Company granted to permit the blacktopping of the area west of existing dwellings on property situated at 902 South Shelton Street, in an R-1 District, and to use it as a parking area for the wholesale egg distributing business of Olson Bros., Inc., whose premises abut the north side of the property; subject property to be adequate enclosed by fence or brick wall, with access to the parking area from Shelton Stree and from the Olson Bros,! premises, subject to conditi~s.set forth by the Planning Commission. Valdez granted to permit the operation of the business of making custom wedding gowns, on property situated at 1145 West 17th Street, in a C-1-PK District, with space for off-street parking of four or five cars, instead of one-third of the land as re- quired by the existing zoning of the property, and subject to the conditions as imposed by the Co~nission only. Communication was read from the Planning Commission recommending denial of variance application of G. R. Hilliard to permit construction of one one-story triplex building (two bedrooms each unit) with one double garage and one single garage, ea¢ ,m~t to consist of approximately 900 square feet, on property situated at the north west corner of Bush Street and Santa Clara Avenue, in an R-2 District. On motion of Councilman Hubbard, seconded by Markel and carried, the recommendation of the Planning Commission was approved and the variance denied. It was moved by Councilman Gould that Resolutions Nos. 57-280 and No. 57-309 here- tofore passed by the City Council prohibiting stopping or standing on North Main Street from First to Ninth Streets between l0 A.M. and 9 P.M. be modified for a period of ninety days commencing May l, 1958 through July 31, 1958, between 3 P.5 and 6 P.M. only, daily except Sundays and holidays. Councilman Markel requested that the City Manager give the figures on the sales tax returns. The Manager reported that the sales tax returns were up 6~ for the Christmas season and that in February, March and April the payment made by the State have been some 15% to 19~0 greater than for the similar months in the past. The Council having unanimou~ y waived the reading of the Resolution, it was moved by Councilman Gould and seconde~ by Hall, that the following Resolution entitled: '~qesolution No. 58-103 amending Resolutions No. 57-280 and No. 57-309 to modify parking prohibition on Main Street, First to Ninth Streets" be considered and passed. It was moved by Councilman Gould, seconded by Hall and carried, that the motion be amended to change the dates to read "June l, 1958 to August 31, 1958". Annex" having been continued from the meeting of March 17, 1958, the Clerk read the communication of R. H. O'Neil and D.J.O"Neil rescinding their letter of March 10, 1958, wherein they protested the annexation of their property AP 16-200-07 and AP 16-200-09 to the City. On motion of Councilman Gould, seconded by Hall and carried, the commun~ cation was received and filed. Attorney Delbert Larsh, representing Horace J. Stevens, whose property is within the described annexation, vigorously objected to the inclusion of Mr. Stevens' property because no benefits would be derived and the cost in taxes would increase $800.00 a year. He proposed a strip annexation in- stead of the present area. Mr. Harry Martin spoke in favor of the annexation and the value to the City. The Mayor closed the discussion and stated that the protest filed represented 37.013~ of the total assessed valuation of land and improvements. CounciLman Hubbard disqualified himself on this matter. On motion of Councilman Markel, seconded by Gould and carried, the following Ordinance entitled: "Ordinance declaring the annexation of that certain territory designated 'Main and Newport N.E. Hubbard On motion of Councilman Hubbard, seconded by Markel and carried, proper officials were authorized to execute agreement dated April 21, 1958 between the City and the Santa Ana Board of Education, providing for the location, construction, maintenance and operation of the swimming pool on the Santa Ana College campus. On motion of Councilman Hubbard, seconded by Markel and carried, the plans and specifications were approved for the construction of the Santa Arm College swimming pool, mechanical facilities and concrete wind-walls, and the Purchasing Agent authoz ized to advertise for bids to be opened May 26, 1958. On motion of Councilman Hubbard, seconded by Gould and carried, the request of George Dunton, on behalf of the Santa Ana New Car Dealers' Association, was denied, for permission to hang street b~uners, approximately 4' x 50', across Fourth and Broadway, 17th and Bristol, 17th and Main, and First and Main Streets, from April 24th to May 5th, 1958. On motion of Councilman Hubbard, seconded by Gould and carried, the request of John A. Carr for approval to establish a regular business of selling household articles at auction at 917 South Main Street, was referred to the Attorney with instructions to prepare an Ordinance commensurate with the times. On motion of Councilman Hubbard, seconded by Hall and carried, the Purchasing Agent was authorized to advertise for bids for the furnishing and delivering of a Fire Alarm Control Pane.l,per Specification No. 634-6; bids to be opened May 5, 1958. On motion of Counci3~nan Hubbard, seconded by Gould and carried~ the City Manager was instructed to formulate and adopt and put into execution a plan to resist the "Greater Tustin Annexation". It was moved by Councilman Hubbard, seconded by Markel and carried, that the Council go on record as favoring some regulations by the Legislature to protect motor escort services and that copies of the Minute Order be forwarded to the State Senator and Assemblymen. On recommendation of the Department of Public Works and on motion of Councilman Gould, seconded by Hubbard and carried, the request of the Orange County Fair was granted to hang overhead flag lines at various locations along State Highway Route 18~a in connection with publicity program advertising the 1958 Orange County Fair to be held May 23 to June l, 1958, subject to conditions. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Gould, seconded by Hubbard and carried, the following Resolution entitle "Resolution No. 58-109 concerning through streets in the City of Santa Ana" establishing a stop sign on Third Street at French Street, as recommended by the Department of Public Works, was considered and passed by the following vote: Ayes, Councilmen Royal E.
