HomeMy WebLinkAbout78-008RESOLUTION NO. 78-8 A RESOLUTION OF THE CITY COUNCIL, CITY OF SANTA ANA, CALIFORNIA, REQUESTING THE COMMENCEMENT OF PROCEEDINGS FOR THE ANNEXATION OF CERTAIN UNIN- HABITED TERRITORY DESIGNATED AS "HOLLY SUGAR FACTORY ANNEXATION" TO THE CITY OF SANTA ANA WHEREAS, it is the desire of the City of Santa Ana to annex into its boundaries certain uninhabited property constituting an unincor- porated island; and WHEREAS, it has been determined by the Orange County Local Agency Formation Commission that the subject area is within the Sphere of Influence of the City of Santa Ana; and WHEREAS, the City Council has determined that the proposed an- nexation is categorically exempt from the CEQA requirements for en- vironmental impact review; and WHEREAS, it is the desire of the City of Santa Ana to extend the full range of municipal services to these unincorporated islands; and WHEREAS, it has been determined that the City of Santa Aha is currently providing and has in the past provided a variety of muni- cipal services to the proposed annexation; NOW, THEREFORE, BE IT RESOLVED by the City Council, City of Santa Ana, California: That the City of Santa Ana requests the commencement of annexa- tion proceedings regarding said uninhabited territory in accordance with the Municipal Organization Act of 1977 governing unincorporated island annexation. That the proposed annexation be made pursuant to Sections 35013 and 35150 (f) of the Municipal Organization Act of 1977. That the Local Agency Formation Commission is hereby petitioned to determine pursuant to Section 35150 (f) of the Municipal Or- ganization Act of 1977 that the proposed area: a. Does not exceed 100 acres in area b. That subject area constitutes the entire island c. That subject area is totally surrounded by the City of Santa Aha d. That subject area is fully developed e. That subject area is not prime agricultural land f. That subject area is receiving benefits from the City of Santa Ana, and following notice and hearing, authorize the Board of Supervisors of Orange County to order the annexa- tions of the subject territory without an election. That the said incorporated territory be, and hereby is, designated as the "Holly Sugar Factory Annexation" to the City of Santa Ana and is shown on Exhibit "A" attached hereto and incorporated herein by this reference, and as legally described in Exhibit "B" attached hereto and incorporated herein by this reference. 5o That the subject area is a developed area of 41.16 acres con- sisting of a manufacturing plant for the processing of sugar beets. The area is totally surrounded by the incorporated limits of the City of Santa Ana. RESOLUTION NO. 78-8 PAGE TWO That the justification for the proposed change of organization is to provide full municipal services to a developed County island area, thereby increasing the quality, economy and effi- ciency of such service to the area. That the Clerk of the Council shall certify the adoption of the Resolution. E.Southern Pacific and Delhi Annex" to the City of Santa Aha as estab- lished by the City of Santa Ana Ordinance No. NS-220, passed on December 17, lg56~ thence South 89020'25'' East 800.25 feet along the South line of the said "S.E. South- ern Pacific and Delhi Annex" to a point on the West line of the "Grand Avenue South of Warner Avenue West Annex" to the City of Santa Ana as established by the City of Santa Ana Resolution 68-109, passed on July 15, 1968, said point being North 0°26'50" East a distance of 963.27 feet from the Southwest corner of the said "Grand Avenue South of Warner Avenue'West Annex", said point also being in the West.line of th~ property described as Parcel 1 in the deed from J. S. Ellis to Sarah E.
