HomeMy WebLinkAbout78-025REL :nr 2-16-78 RESOLUTION NO. 78-25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA REQUESTING THE BOARD OF SUPERVISORS OF ORANGE COUNTY TO CONSOLIDATE A SPECIAL MUNICIPAL ELEC- TION OF THE CITY OF SANTA ANA WITH THE GENERAL ELECTION TO BE HELD ON JUNE 6, 1978 WHEREAS, the City Council of the City of Santa Ana intends to call a special election in the City of Santa Ana on June 6, 1978 for the purpose of submitting to the qualified voters of the City certain proposed amendments to the City Char- ter; and WHEREAS, there will be a statewide general election held on June 6, 1978; and WHEREAS, it is desirable that said special election of the City of Santa Ana be consolidated with the statewide general election to be held on the same date and that within the City of Santa Ana the precincts, polling places and election officers be the same, and that the Board of Supervisors of the County of Orange canvass the returns of the special municipal election and that said general election and special municipal election be held in all respects as if there were only one election; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Aha: SECTION 1: That pursuant to the requirements of Sec- tion 23302 of the Elections Code of the State of California, the Board of Supervisors of the County of Orange is hereby requested to consent to and order the consolidation with the general elec- tion of June 6, 1978, of a special election of the City of Santa Ana to be held upon the same date for the purpose of submitting to the electors of the City of Santa Aha certain propositions to appear on the ballot as follows: CHARTER LANGUAGE. Shall the Charter be amended to bring Charter provisions into conformance with State law and to revise regulation of political activities, including: -Deleting provisions which are now con- trolled by State law and extending provi- sions to include all powers granted by State law. -Making the competitive bidding require- ments of the City similar to those set by State law. -Prohibiting gifts to City personnel from financially interested persons? Shall the Charter be amended to modify provisions for service on the city's boards and commissions, including: -Giving Council the authority to regulate use of subpoena power by Boards and Com- missions; -Eliminating the prohibition against Personnel Board ~members holding public office or employment or being candidates for public or political office and the prohibition against eligibility for employment by the City for a period of one year after completion of service as a Personnel Board member? (Sections amended: 901, 906, 911, 912) : YES : : : NO : : PERSONNEL PROCEDURES. Shall the Charter be amended to revise rules for selection and pro- motion of City personnel, including: -Allowing the City Council more flexi- bility in setting rules for employee selection, promotion and probationary periods; -Providing for employment of officers and employees of other cities or special districts if they merge with Santa Ana? (Sections emended: 701, 1000,1001,1002, 1003,1005,1006,1007, 1012,1013) : YES : : : NO : : CITY EMPLOYEES. Shall the Charter be amended to revise regulations affecting City employees, including: -Providing that any officer or employee of the City who engages in any strike, sickout, or other stoppage of work shall be subject to suspension, demotion or dismissal without right of appeal; -Revising suspension and demotion proce- dure for employees and setting new requirements for notice of charges and written decision; -Revising requirements for providing an employee retirement plan and guidelines for employee lay offs? (Sections amended 1008, 1009, 1014, 1400) : YES : : : NO : : RESOLUTION NO. 78-25 PAGE THREE CITY ORGANIZATION. to allow the City Council more flexibility in making administrative decisions and to set new rules for holding city elections, including: Shall the Charter be amended: -Revising the procedure to fill Council vacancies and allowing Council to call city elections by resolution; -Allowing the Council to amend the effec- tive dates of the fiscal year and per- mitting a majority rather than two-thirds of the Council to amend the budget; -Expanding Council authority to provide for City staff organization and contract for professional services on personnel matters? (Sections amended: 102,403,502,609,700, 1011,1200,1202) : YES : : : NO : : CITY ORDINANCES. Shall the Charter be amended to revise city ordinance procedures, including: -Requiring pending ordinances or reso- lutions to be made available for public inspection at Council meetings instead of reading them in full; -Requiring newspaper publication of the title explanation before final adoption instead of the entire ordinance after adoption; -Specifying requirements for adopting City ordinances and their effective dates?: (Sections amended: 410, 413,416,417,418, : 422) : : YES : : NO : : SECTION 2: Said Board of Supervisors is hereby autho- rized to canvass the returns of said special municipal election pursuant to Section 23306 of the Elections Code of the State of California. SECTION 3: The City of Santa Aha recognizes that addi- tional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County for any such costs. SECTION 4: The Clerk of the Council is hereby directed to file a certified copy of this resolution with the Board of Supervisors of the County of Orange and a certified copy of this resolution with the Registrar of Voters of the County of Orange.
