RESOLUTION NO. 78-57
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA, TO INITIATE
PROCEEDINGS FOR THE ANNEXATION OF
THE "HOLLY SUGAR FACTORY AREA" IN
COMPLIANCE WITH ORANGE COUNTY LOCAL
AGENCY FORMATION COMMISSION RESOLUTION
No. 78-87 ADOPTED APRIL 26, 1978, SETTING
A HEARING; AND DIRECTING THE CLERK OF
THE COUNCIL TO GIVE NOTICE.
WHEREAS, it is the desire of the City of Santa Ana
to annex certain property, herein entitled "The Holly Sugar
Factory Annexation", to the incorporated boundaries of the
City; and
WHEREAS, it is the desire of the City of Santa Ana
to eliminate duplication of government services to the
subject area presently provided by both the City of Santa
Ana and the County of Orange; and
WHEREAS, Holly Sugar Corporation, owner of all the
land within the subject area, initiated the annexation
proceedings by petition which was accepted by the Executive
Officer, Orange County Local Agency Formation Commission,
for filing March 30, 1978; and
WHEREAS, it is the desire of t'he petitioner to
obtain the benefits of incorporation including zoning consideration
as well as direct fire and police services; and
WHEREAS, the subject territory is uninhabited as
determined by the Orange County Local Agency Formation
Commission in its Resolution Number 78-87; and
WHEREAS, the Executive Officer, Orange County
Local Agency Formation Commission, determined and the said
Commission has adopted the determination that this annexation
project is "categorically exempt" from the requirements of
the California Environmental Quality Act of 1970 and as set
forth in said Commission's Resolution 78-87; and
WHEREAS, the boundaries of the territory proposed
to be annexed to the City of Santa Ana are specifically
described in the legal description "Exhibit A" and map
"Exhibit B" attached hereto and by this reference made a
part hereof; and
WHEREAS, it has been determined by the Orange
County Local Agency Formation Commission in its Resolution
78-87, that the subject area should be annexed to the City
of Santa Ana; and
WHEREAS, in its Resolution 78-87, the Orange
County Local Agency Formation Commission has designated the
City Council, City of Santa Ana, as the conducting authority;
and
WHEREAS, also in its Resolution 78-87, the Orange
County Local Agency Formation Commission has determined that
the subject annexation territory be prezoned prior to the
completion of this proposal; and

WHEREAS, the owner of land within the territory
may under Section 35220 (h) of the Municipal Organization
Act, 1977, file a written protest against the annexation
with the Clerk of the Council, City of Santa Ana, at any
time prior to conclusion of this Council's hearing on the
proposed annexation:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA:
1. The foregoing recitals are true and correct,
and this Council so finds and determines.
2. Notice is hereby given that at the hour of
5:00 p.m. or as soon thereafter as the matter can be
heard, on June 27, 1978, in the Council Chambers of the City
of Santa Ana, 20 Civic Center Plaza, Santa Ana, California,
a public hearing will be held by this Council, at which time
any and all persons interested in or objecting to said
proposed annexation may appear and be heard.
3. That the Clerk of the Council is hereby
directed to file the map and legal description, "Exhibit A"
and "Exhibit B" hereto, in her office, where the same may be
examined by any and all persons desiring to do so.
4. Pursuant to the requirements of Government
Code Sections 35055 and 6066, the Clerk of the Council is
hereby directed to cause a copy of this Resolution to be
published once each week for two consecutive weeks in "The
Register", a newspaper of general circulation in the City
and County and beginning at least fifteen (15) days before
the date set for said hearing.
5. Pursuant to the requirements of Government
Code Section 35223, the Clerk of the Council is hereby
directed to mail, by first class mail, a copy of this resolution
to:
(a) Any person who has filed his name and address with the
clerk and has requested such mailed notice;
(b) The chief petitioners, if any, as indicated in the
petition initiating the instant proceedings;
(c) To each affected city, county, and district; and
(d) To the executive officer of the local agency formation
commission.
6. Pursuant to Government Code Sections 35055
and 56085, the Clerk of the Council is hereby directed to
cause notice of hearing on the proposed annexation referred
to herein, to be posted on or near the doors of the Council
Chambers of the City Council of the City of Santa Ana at the
address referred to above on an official bulletin board and
in other locations customarily used for posting public
notices by or pertaining to this Council. Said notice is to
be posted at least 15 days prior to the date specified
herein for hearing and shall continue to the time of the
hearing.

7. After completion of the duties specified
above, The Clerk of the Council is hereby directed to place
affidavits on file herein confirming the performance of the
said duties.

LEGAL DESCRIPTION FOR THE HOLLY SUGAR FACTORY ANNEX
TO THE CITY OF SANTA ANA~ CALIFORNIA
All that certain territory situated in the County of Orange, State of California,
more particularly described as follows:
Beginning at the Southeasterly corner of the "S.E. Southern Pacific and Delhi
Annex" to the City of Santa Ana, said corner being in the Northeast quarter of
Section 30, Township 5 South, Range 9 West, S.B.B. and M., as shown on a map filed
in Book 33, page 41 of Records of Surveys of Orange County, California.
Thence, along the existing boundary line of said City of Santa Ana as established
by the "Grand Avenue South of Warner Avenue West Annex", by the "Dyer and Grand
Northwest Annex", by the "Irvine's Subdivision Annex No. 1 (Revised)", by the
"Dyer and Grand Northwest Annex No. 2", by the "Irvine's Subdivision Annex No. 1
(Revised)", by the "Genevieve De Sutter Annex", by the Glorietta Addition", by
the "Townsend Annexation" and by said "S.E. Southern Pacific and Delhi Annex"
through the following courses:
