Present: Councilmen Absent: Counct 1 men Royal E. Hubbard, Stanley C. Gould, Jr., A.A.W~11~ Dale H. Heiuly J. Ogden Markel The Pledge of Allegiance was given. Tnvocation was given by Reverend Robert Bos of the First Presbyterian Church. Each member of the City Council having received copies of the Minutes of July 2_1, 1958, reading of the Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by F~"l! amd. carried. Bid acceptance Sanitary sewer on Raitt Street from Fairview to Cubbon A tabulation of bids was presented by the Manager for the construction of sanitary cew~r on Raitt Street from Fairview Avenue to Oubbon Street, Project No. 22, as follows: Danfel Estrada ~-~-~.28 10~ bond Edwin L. Barkley 1816.50 10~ bond Ted Worley 1847.50 lo~ bond Sanitary ~ineering Co. 2123.75 lO~ bond On rec~ndation of the c~tttee, and on motion of Councilma~ Hubbard, seconded by w~l 1 and carried, the low bid of Edwin L. Barkley, in the sum of $1816.50, on the basis of the unit prices as set forth in his bid proposal, was accepted and Hearing Vacate portion E. 5th St. between Poinsettia St. and Sou. Pac. Co. R.R. right-of-way ~11 other bids rejected. This bein~ the dste set for hearing on the vacation of a portion of East Fifth Street between Poinsettia Street and the Southern Pacific Co. On motion of Col~ucllman GOuld, seconded by and carried, the communication was received and filed. It was moved by Councilman Gould, seconded by Hubbard and carried, that the matter gO off the Hearing - Amendment No. 254 - Plaguing Commission initiated Area described in "Main and Newport N.E.Annex" OrdinAnce calendar. This being the date set for hearing and no protests having been received, amendment No. 254 initiated by the Planning Commission was considered to reclaesify frc~ to M-1 District that ax, ea described in the '1~ain and Newport N.E. Annex", as a tr~-~o~,Alar~shaped parcel located south of Dyer Road, east of Main Street and wast of Newport Avenue, excepting a portion of said annexed area bounded on the wast by Main Street, on the east by Newport Avenue, on the north by an east-w~st line of Main Street and Newport Avenue, which is to be reclassified from R-1 to C-2-PK District. On motion of CoumcJlm~ Hubbard, seconded by M~11 and carried, the fol- lowing Ordi,~nce entitled: "Ordinance ~mending Article IX of the Santa Aha Mmmicipal Code to change the district classification of certain property and to adopt Sectional District Maps 30-5-5 and B1-5-9" Hearing Weed assessments Reso. No. 58-190 Allowing protests was introduced, considered and placed on file for second reading. This being the date set for hearing on the weed assessments, Louis ~OO~m~n~ owner of property at 2701 South Main Street, stated he had been assessed $16.~O by the City for cleaning the weeds on his property and presented two bills paid for hiring men to cut the weeds and requested that the City charges be deleted. The Director of Public Works stated he had tickets which showed the man hours and r~.~s of the persons who did the work. ~rs. Ma~rie O&ins, 1516 North English Street, protested the manner in which the work was done on her property and stated that the burning of the weeds cumpletely d~,aged a walnut tree, orange tree and a grape vine. She also said that about one-half of the work was done before the City forces came on the property and protested the charge of $37.64. Nearing declared closed. It Gould, seconded by Hubbard and carried, that the weed asses! merit against Louis Goodmau be allowed and the assessment deleted. It was moved by ColecO]man Gould, seconded by Hall amd carried, that the protest of Mrs. MarJorie Cains be accepted and the assesmsent ob-wge stricken from the roll. Mayor Hei~ly rest~-?d the Chair. The Council having unanimously waived the reading of the Resolution, on motion of Councilm~ Gould, seconded by Hubbard and carried, the following ~esolution entitled: Preliminary Record of Survey Map "Resolution No. 58-190 ~l]owt~g protests of weed report of Street Superintendent and approving the co~A~cted report and ordering a copy thereof filed with the Tax C~llector" was considered and passed by the following vote: Ayes, Counctl~n Royal E. Mrs. Haan, daughter of Mr. Manard, pre- sented a letter frcm W.F.0wmn, Jr., M.D. reference Mr. Manard's health, and on motion of Counci~m~n Hubbard, seconded by GoUld and carried, the communication was received and filed. It was moved'by Collncilm~n ~a]~ and seconded by Hubbard that the Preliminary Map be denied, as rec~m,,ended by the Planning Department. Mr. Manard stated the house on the rear of property at 1805 Spurgeon Street was sold, and he signed the deed but later was forced to take back the property and is now without a water connection or mater. Miller granted to permit erection of a Texas Oil Company gas station 9n property at 509 North Bristol Street, in an R-2 District, existing buildings to be demolished, subject to conditions and the dedication of ~o additional feet On Bristol Street. Councilm~n Hubbard disqualified himself on this matter. On motion of Counc~l~n Gould, seconded by .Wsll and carried, the rec~ndation of the Planning Commission was approved and the variance of P.E. and Ferne I. Fennell granted to remodel existing duplex building and establish and operate interior design offices, at 1401 Bush Street, in an R-3 District, subject to conditions. O~ motion of Councilman Hubbard, seconded by Hall and .carried, the rec~m,endation of the Pl~nntug Commission was approved and the variance of Gregorio Valenzuela grante~ to permit the ccmbt-ation of two lots as one parcel and to construct a single-family residence on balance of vacant westerly portion of property at ~22 Central Avenue and first lot west ~hereof, in an R-1 District, subject to a condition. No. 58-195 Declaring intention to abandon N.Birch Street between 6th and 8th Streets Street, asked what the requirements are on the size of electrical signs, particularly with reference to the Weber Baking Company sign to be erected on their property near the Freeway. Mrs. Walker presented pictures showing the unsightly north entrance to the City and requested the Council to beautify the triangular piece of property owned by the City adjacent to the Southern Pacific HaLlway Company tracks. On motion of Councilman Hubbard, seconded by Na~ and carried, the Attorney was ,granted permission to leav~ the City and State from August 6 to August 17, 1958. On motion of Counc~!men Hubbard, seconded by Gould and carried, the copy of Minute Order from the Board of Supervisors instructing the County Counsel to prepare an application to the City for the abandonment of North Birch Street from Sixth Street to Eighth Street, and Resolution requesting the ahamionment of said street, were received and filed. The Council having ,,~nimously waived the reading of the Resolution, on motion of Counctlm~ Hubbard, seconded by Gould and carried, the fol- lowing Resolution entitled: '~esolution No. 58-195 approving map and declaring intention to vacate a portion of North Birch Street lying between Sixth Street and Eighth Street" was considered and passed by the following vote: 6 Parking prohibition on North Main Street Ayes, Counc~l~n Royal E. On motion of COunC~lmaU Nubbard, seconded by Rall and carried, the c~mmunication frc~ Mrs. Weston Walker ca~ling attention to the unsightly north entry into the City and suggesting that the Ordinance to control outdoor advertising signs is probably inadequate and not enforced as strictly as it should be, was received and filed. On motion of Councilman Hubbard, seconded by Gould and carried, proper officials were authorized to execute agreement with Murphy Zlaket requiring a 7 1/2 foot easement to the City prior to building over anY portion of the alley running between Main and Bush Streets at the intersection of Buffalo and North Main Street, if the same is vacated. On motion of Councilm-n Hubbard, seconded by Gould and carried, the request of Harry Tancredi was granted for a 35 foot access, instead of a 25 foot access, as previously granted, fer use of the Richfield Oil Corporation for one of the entrances to the service station to be located on East 17th Street, south side, east of Poinsettia Street. On motion of Counc!]m~ Hubbard, seconded by Gould and carried, the claim of Curtis O. Paris agaiust the City and Officer Kemm~th E. Day for ~am~s to his car at Edinger and Parton Streets, in the sum of $150.00, was referred to the Attorney for proper processing. It was moved by Counc~-~ Hubbard, seconded by Hall aud ca~-~-ied, that Mr. T. L. Eank Givens, publisher of the Santa Aha Independent, be notified of the Council's intention to void the contract for legal advertising for the reasons that his pub- lication does not meet the legal q~,~!ifieations and requirements as a n~wspmper of general circulation in the City. Councilman Gould abstained frc~ voting. On motion of Councilman Gould, seconded by Hubbard and carried, the request of L.D. Leeper for thr~e 35 foot driveways at the service station to be erected on the northeast corner of Bristol and Fourth Streets, was granted. On motion of Counc~lm-~ Hubbard, seconded by Hall and carried, the request of Herb Hill of Car Park, Inc., for two 35 foot driveways for parking lot to be.~6cated at the southwest cormer of Fifth amd Sycamore Streets, was granted.
