HomeMy WebLinkAbout78-096REL/fm 7/21/78 RESOLUTION NO. 78-96 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DECLARING ITS INTENTION TO VACATE SECOND STREET AND ALL EAST-WEST ALLEYS BETWEEN FORMER VAN NESS AVENUE AND FLOWER STREET AND GARNSEY AND PARTON STREETS BETWEEN FIRST STREET AND THIRD STREET, APPROVING A MAP THEREOF, SETTING A PUBLIC HEARING THEREON, AND DIRECTING NOTICE THERE- OF TO BE POSTED AND PUBLISHED. BE IT RESOLVED by the City Council of the City of Santa Ana: 1. Pursuant to and in accordance with section 8322 of the Streets and Highways Code of the State of California, this Council does hereby declare its intention to order the vacation of and to vacate Second Street and all East-West alleys between former Van Ness Avenue and Flower Street and Garnsey and Parton Streets between First Street and Third Street, as more particularly described and shown on Exhibit A, attached hereto and incorporated by reference herein. 2. That the City Council of the City of Santa Ana does hereby approve that certain map attached as part of Exhibit A, as the map showing those portions of said streets and alleys which this Council declares its intention to vacate. The Clerk of the Council is hereby directed to file said map in her office where the same may be examined by any and all persons desiring to do so. 3. Notice is hereby given that at the hour of 7:30 p.m. or as so on thereafter as the matter can be heard on August 21, 1978, in the Council Chambers of the City of Santa Aha, 22 Civic Center Plaza, Santa Ana, California, a public hearing will be held by this Council at which time any and all persons interested in or objecting to the pro- posed vacation of the said portions of the streets and alleys hereinabove described may appear and be heard. 4. The Clerk of the Council is hereby directed to cause this Resolution to be published at least once in "The Register," a newspaper of general circulation in the City, within fifteen (15) days after the date of adoption of this Resolution and at least ten (10) days before the date set for said hearing. 5. The Director of Public Works is hereby directed to post conspicuously, in the manner prescribed by law, notice of the adoption of this Resolution, containing the statement of the time and place of hearing hereinabove set forth along the lines of the above said streets and alleys at least ten (10) days before the date set for said hearing. Pursuant to section 2381 of the Streets and Highway Code of the State of California, the City Council does hereby find and determine that none of the said streets and alleys, or parts thereof, are useful as non-motorized transportation facilities. 7. Resolution No. 78-93 is hereby repealed. Parcel 2: That portion of Second Street, 50 feet in width, together with that portion of Parton Street, 60 feet in width, in the City of Santa Ana, County of Orange, California, as shown on a map of the "Jacob Ross Tract in the Ross Addition to the Town of Santa Aha", recorded in Book 5, page 582 of Miscellaneous Records of Los Angeles County, California, bounded Northerly by the South line of Third Street, 60 feet in width, bounded Westerly by the East line of Garnsey Street, 60 feet in width, and bounded Southerly by the Easterly prolongation of a line parallel and distant 40.0 feet Northerly, measured at right angles, from the South line of Block g in said "Jacob Ross Tract" as shown on said map. Parcel 4: That portion of Garnsey Street, 60 feet in width, in the City of Santa Ana, County of Orange, California, bounded Easterly by the West lines of Blocks 4 and g in the "Jacob Ross Tract in the Ross Addition to the Town of Santa Ana" as shown on a map recorded in Book 5, page 582 of Miscellaneous Records of Los Angeles County, California; bounded Westerly by the East lines of Blocks J and K in the Ross Addition to Santa Ana as shown on a map recorded in Book 3, page 534 of Miscellaneous Records of Los Angeles County, California; bounded Northerly by the Easterly prolongation of the North line of said Block J; bounded Southerly by a line parallel and distant 40.00 feet Northerly, measured at right angles from the South line of said Block K.
