RESOLUTION NO. 78-99
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA AFFIRMING THE
DECISION OF THE PLANNING COMMISSION
APPROVING CONDITIONAL USE PERMIT NO.
78-9
WHEREAS, a public hearing was duly held before the City
Council of the City of Santa Ana on June 19, 1978, on the action
taken by the Planning Commission in approving Conditional Use
Permit No. 78-16, which application seeks to allow retail sales
of linoleum, carpet and drapery material at 2760 S. Harbor Blvd.,
Units D and E, in the M1 use district; and
WHEREAS, prior to taking action on said conditional use
permit application, this Council has reviewed and considered the
negative declaration for the project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Santa Ana as follows:
1. That based on such public hearing and the oral and docu-
mentary evidence submitted therein, the City Council does hereby
affirm the action of the Planning Commission approving Conditional
Use Permit No. 78-9.
2. That the City Council hereby adopts as its findings of
fact for approval of Conditional Use Permit No. 78-9 that certain
"Finding of Fact, Conditional Use Permit 78-9," prepared and sub-
mitted by the Planning Commission, on file in the office of the
Clerk of the Council, and incorporated herein as though fully set
forth.
3. For the reasons set forth in the Negative Declaration
prepared for this project, the Council approves and adopts the
said Negative Declaration and its finding that the project will
not have a significant effect on the environment.
4. That in addition to the requirements imposed by the
Planning Commission upon the approval of the said Conditional Use
Permit, the following additional condition is also imposed: that
annual income from on-site retail sales shall not exceed ten
percent (10%) of total annual retail sales income.
