Present: Councilmen Royal E. Hubbard, Stanley C. Gould, Jr., A.A.Hall~ J. Ogden Markel Absent: Councilmen Dale H. Reinly The Pledge of Allegiance was given. Invocation was given by Reverend Don Jordan of the First United Presbyterian Church. Each member of the City Council having received copies of the Minutes of August 18, 1958, reading of the Minutes was dispensed with and approved on motion of Counc~lma~ Hubbard, seconded by Hall and carried. This being the date set for hearing on the vacation of a portion of North Birch Street lying between Sixth Street and Eighth Street and no protests having been received, on motion of Council~u Gould, seconded by Hall and carried, the hearing was closed. Commm~uication was read from Ram Investment Company ngreeing to the conditions recommended by the Planning Department to be incorporated on the Final Map of Tract No. 2437. On motion of Councilman Gould, seconded by Hubbard and carried, Tentative Tract Map No. 2437 on property bounded on the east by the Southern Pacific Railroad, on the west by a line approx~m~.tely 150 feet east of Standard Avenue, on the south by McFadden Street and on the north by a line approximately llll feet north of McFadden Street, consisting of forty lots, was approved subject to conditions. On motion of Councilman Gould, seconded by Hubbard and carried, Map of Tract No. 2235 filed by Park Homes, a partnership, on 23 lots located on Center Street and Borchard Avenue, and bond in the amount of $17,500.00 were approved, license tax in the sum of $1,150.00 accepted and agreement covering improvements was ordered signed. On motion of Councilmau Hubbard, seconded by Gould and carried, the recomm~ndation of the Planning Commission was approved and the Variance Application No. 1019 of Romeric Builders, Inc., granted to permit the erection of a 10' x 20' temporary sign on property situated at the northeast corner of Washington Place and Grand Avenue, in an R-1 District, to direct prospective purchasers to tract located on Stafford Street, near the Freeway on the south, subject to conditions. On motion of Councilm~u Hubbard, seconded by Hall and carried, the recommendation of the Planning Commission was approved and Variance Application No. 1020 of Romeric Builders, Inc., granted to permit the erection of a lC' x 20' temporary directional sign on property situated on Lot 238, Tract 26~8 on the west side of Stafford Street, fourth lot south of Grace Street, to advertise sale of homes in said tract, subject Roll Call Ayes, Councilmen Royal E. On motion of Councilman Hubbard, seconded by Gould and carried, the petition signed by Reverend Odie Gunter of the Edinger Street Church of the Nazarene, reports of the Boundary Commission and Planning Commission relative to the annexation of unin- habited territory designated '~Edinger and Center North Annex", were received and filed. At the oral request of the Diremtor of Public ~orks and on motion of Councilman seconded by Hubbard and carried, the employment of Leroy Cranda] 1 and Associates was approved for soil investigation for the Library and Police Buildings. On motion of Counc~!man Hubbard, seconded by Gould and carried, permission was granted Santa Aha Rertoma Club to set up an automobile safety check program during the week of October 13, 1958, on the east side of North Sycamore Street at the Army Reserve Training Center driveway and extending north to the Knickerbocker lot. On motion of Councilman Gould, seconded by Hubbard and carried, the Lions Club of Santa Ana was granted permission to solicit funds on the streets, Friday, September 26, 1958, to defray expenses for the Club's Sight Conservation Program. On motion of Co~cilma~ Hubbard, seconded by Hall and carried, the additional petition, submitted by Mrs. Weston Walker, and signed by appro×~m~tely 75 persons, requesting the Council to rescind its action in granting the Weber Baking Company permission to erect a large billboard along the Santa ~na Freeway, was received and filed. The Cler~ rend communication signed by Attorneys Charles D. Swarmer and Fred Forgy giving their opinion regarding the validity of Section 8412 of the Municipal Code and urging the Council to rescind its action in granting Weber Baking Company permission to erect a large billboard along the Santa Ana Freeway, as it is in violation of the Mnnicipal Code sections, it is contrary to the intent of the law, it would establish a precedent and make the approach to Santa Aha a veritable billboard alley and would deprive the City and its citizens of landscaping maintenance along the Freeway as well as additional contemplated landscaping. Conmm~uication fi-~ Mrs. Weston Walker was read quoting the State's policy with regard to billboards and landscaping al~ the Freeway and cotangents of Senior Highway Engineer of the State Highway Department in Los Angeles, with regard to billboards along the Santa Aha Freeway. Mrs. Walker requested information as to whether there is any way an emergency ruling may be made to prohibit all signs along the Freeway until the City has a good Sign Ordinance, and stated that Weber Baking Company should ~e made to present its application for the sign to the State Highway Commission for~ approval. It was moved by Councilman Hall, seconded by Hubbard and carried, that the Attorney be instructed to rewrite the Ordinance in accordance with the original interpretation, and the words "or premises" in Section 8441.4 of the Santa Ana Municipal Code be stricken from the Ordinance. On motion of CounciLman Hubbard, seconded by Gould and carried, the request of Allison Honer Company, on behalf of the Bower Company, for permission to place ten display signs, approxfm~tely 25' in height and 9' wide, in the curb (City right-of- way) on Bristol Street from the northerly limits of their property southerly to approximately Fifteenth Street, for the period September 4, to October 4, 1958, was denied. On motion of Councilman Hubbard, seconded by Gould and carried, the Purchasing Agent was authorized to advertise for bids for the furnishing of seven solo motorcycle transmitters and receivers for operation on two different frequency channels, per Specification 654-4; bids to be opened September 15, 1958.
