HomeMy WebLinkAbout78-123CM:nr 9-12-78 RESOLUTION NO. 78-123 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DECLARING ITS INTENTION TO VACATE AN EAST-WEST ALLEY WEST OF EUCLID STREET AND NORTH OF MCFADDEN AVENUE, APPROVING A MAP THEREOF, DIRECTING THE CLERK OF THE COUNCIL TO FILE SAID MAP, DESCRIBING THE PORTION OF SAID STREET TO BE VACATED, SETTING A PUBLIC HEARING THEREON, AND DIRECT- ING NOTICE THEREOF TO BE POSTED AND PUBLISHED BE IT RESOLVED by the City Council of the City of Santa Ana: 1. Pursuant to and in accordance with the provisions of Part 3, Division 9 of the Streets and Highways Code of the State of California, this Council does hereby declare its in- tention to order the vacation of and to vacate an East-West alley West of Euclid Street and North of McFadden Avenue, as more particularly described and shown on that certain document entitled "Proposed Alley Abandonment #44", together with attached maps, a copy of which is on file with the Clerk of the Council, and more particularly described as the North 20.00 feet of that portion of the Northeast quarter of Section 17, Township 5 South, Range 10 West, in the Rancho Las Bolsas, City of Santa Ana, County of Orange, State of California, as per map recorded in Book 51, page 12 of Miscellaneous Maps, in the office of the County Re- corder of said County. 2. That the City Council of the City of Santa Ana does hereby approve said map entitled "Proposed Alley Abandon- ment #44", together with attached maps, as the map showing said alley which this Council declares its intention to vacate. 3. The Clerk of the Council is hereby directed to file said map in her office where the same may be examined by any and all persons desiring to do so. 4. Notice is hereby given that at the hour of 7:30 p.m. or as soon thereafter as the matter can be heard on the 2nd day of October , 1978, in the Council Chambers of the City of Santa Ana, 20 civic Center Plaza, Santa Ana, California, a public hearing will be held by this Council at which time any and all persons interested in or ob- jecting to the proposed vacation of the alley hereinabove des- cribed may appear and be heard. 5. The Clerk of the Council is hereby directed to cause this Resolution to be published at least once in "The Register", a newspaper of general circulation in the City, within fifteen (15) days after the date of adoption of this Resolution and at least ten (10) days before the date set for said hearing. 6. The Director of Public Works is hereby directed to post conspicuously, in the manner prescribed by law, notice of the adoption of this Resolution, containing the statement of the time and place of hearing hereinabove set forth, along the line of the portion of said alley proposed to be abandoned. GOW City Attorney Proposed Alley Abandonment: Legal West of Euclid, North of McFadden Description " The North 20.00 feet of that portion of the Northeast quarter of Section 17, Township 5 South, Range 10 West, in the Rancho Las Bolsas, City of Santa Ana, County of Orange, State of California, as per map recorded in Book 51, page 12 of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: Beginning at the Southwest corner of the Southeast quarter of the Southeast quarter of said Northeast quarter; thence North 0° 40~ 06" West 329.87 feet along the West line of said Southeast quarter of the Southeast quarter to the Northwest corner of the land described in the deed to the American Lutheran Church by deed recorded June 15, 1961 in Book 5755 page 823 of Official Records; thence North 88© 11' 30" East 396.23 feet along the North line of said land and the North line of the land described in the deed to American Lutheran Church recorded June 15, 1961 in Book 5755 page 825 of Official Records to the Northeast corner of said land of American Lutheran Church; thence South 0° 40' 06" East 329.87 feet to the Southeast corner of said land; thence South 88© 11' 30" West 396.23 feet to the point of beginning.
