A RESOLUTION OF THE CITY COUNCIL OF THE .
CITY OF SANTA ANA FIXING AND ESTABLISHING
OF THE COUNCIL OF THE CITY OF SANTA ANA,
EFFECTIVE DECEMBER 11, 1978, AND REPEALING
RESOLUTIONS INCONSISTENT HEREWITH.
BE IT RESOLVED by the City Council o 79-,,, ~,,

1. That the salary for the office of the Clerk of
the Council of the City of Santa Ana is hereby fixed and
established at One Thousand Eight Hundred Dollars ($1,800.00)
per month.
2. That said salary shall be paid in the same manner
and at the same times as other monthly salaries in the City are
paid, and shall take effect and be paid from and after Decem-
ber 11, 1978.
3. In addition to the salary hereinabove fixed and
established for said office, said officer shall receive, as
additional compensation, the following employee benefits:
(a) Deferred Compensation
Said officer shall receive as deferred
compensation an amount equal to one percent
(1%) of his or her monthly salary. The
amounts contributed by the City under this pro-
vision shall be subject to the terms and con-
ditions of the City of Santa Ana Deferred
Compensation Plan, and subject further to the
conditions that:
i. Said officer shall not have
any vested right in the amounts con-
tributed by the City until termina-
tion of employment with City;
ii. City will pay the total
amount of contributions plus any
earnings thereon to said officer upon
termination, resignation, retirement,
dismissal or death.
(b) Health Insurance
The City will contribute the following
amounts toward the payment of the premiums
for said officer and dependents, if applicable,
under the existing health insurance program
(or a new program providing substantially
similar coverage and benefits):
i. If said officer does not have
dependents included under the program,
one hundred percent (100%) of the
premiums;

ii. If said officer has one or more
dependents included under the program, an
amount equal to that proportion of the
total premium applicable to the "family
plan" covering said officer and his or
her dependents that is paid by the City
on behalf of other officers and employ-
ees.
(c) Retirement Benefits
Effective July 1, 1976, or as soon there-
after as practicable, the City shall amend its
contract with the Public Employees' Retirement
System of the State of California (PERS) so as
to improve the retirement program for said
officer by providing military service credit
benefits. Thereafter such officer will be per-
mitted to exercise the option to "buy-back" or
have "bought-back" on his or her behalf, his or
her prior military service, to the extent per-
mitted and in accordance with the terms and con-
ditions of Section 20930.3 of the California
Government Code, with such officer being obli-
gated to "buy-back" all completed military
service occurring subsequent to the effective
date of the City's contract with PERS and the
City being obligated to "buy-back'' on behalf of
such officer military service occurring prior
to the effective date of said contract.
(d)
Option to Convert Termination Payment
for Unused Sick Leave to Health
Insurance Benefits
Effective from and after July 1, 1976, such
officer shall have the option to convert that lump
sum payment for unused sick leave benefits avail-
able to him or her pursuant to the provisions of
Section 9-169 of the Santa Aha Municipal Code into
an obligation on the part of the City to pay on
behalf of said officer and his or her dependents,
if any, all health insurance premiums for said
officer and any dependents necessary to cause
said officer and any designated dependents to
receive the full benefits available under the
health insurance program then maintained by the
City on behalf of its employees and their depend-
ents; provided, however, that the City's obliga-
tion to pay such premiums shall terminate as soon
as one of the following events occurs:
i. The payment of said premiums for a
period of five (5) years beyond termination
of employment; or
ii. The payment of premiums, after
termination of employment, in a sum equal
to one hundred fifty percent (150%) of the
amount of said lump sum payment that the
officer would have received for unused sick
leave benefits has this option not been
elected.

(e) Disability Insurance
Effective January 1, 1978, the City shall
pay the full premium for a long-term disability
insurance plan, selected by the City, for said
officer.
(f) Carry Over Benefits
In addition to the benefits specified in
subparagraphs (a) through (e) hereinabove, said
officer shall receive any and all employee bene-
fits which the incumbent of said office was en-
titled to receive on June 30, 1976, by reason of
prior action of the Council, provided and except-
ing, however, the health insurance benefit shall
be as provided hereinabove, and not as it ex-
isted on June 30, 1976.
4. Resolution No. 77-83 of this Council, adopted
on August 1, 1977, and any and all other resolutions of this
Council inconsistent herewith, are hereby repealed.
