RESOLUTION NO. 79-46
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA, ADOPTED PURSUANT TO THE PROVI-
SIONS OF SECTION 10061 OF THE STATE PUBLIC
UTILITIES CODE, CONCURRING IN THE SALE TO
SAID CITY OF A CERTAIN WATER SYSTEM, AND THE
TERMS AND CONDITIONS THEREOF, AND BINDING
SAID CITY TO RENDER WATER SERVICE TO THE
PERSONS FORMERLY SERVED THROUGH THE SYSTEM
BEING ACQUIRED ON TERMS AND CONDITIONS WHICH
ARE JUST AND REASONABLE AND WHICH DO NOT
UNREASONABLY DISCRIMINATE AGAINST THE CUSTO-
MERS OF THE ACQUIRED ENTITY.
WHEREAS, this Council has heretofore authorized
execution, on behalf of the City of Santa Ana, of that
certain "Water Systems Acquisition Agreement", form dated
7/8/78, a copy of which is on file in the office of the
Clerk of the Council, to which copy reference is hereby made
for full particulars, and
WHEREAS, under the provisions of said agreement, the
City of Garden Grove agrees to sell and the City of Santa
Ana agrees to buy, a certain portion of the public utility
owned and operated by Garden Grove for furnishing water
service, said portion being so much thereof as is situate
within the geographic boundaries of the City of Santa Ana.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA:
That this Council hereby concurs in such sale and
transfer of said portion of said publicly owned and operated
public utility, and the terms and conditions thereof, and
that the City of Santa Ana will be bound to render water
service to the persons formerly served through the system
being sold on terms and conditions which are just and
reasonable and which do not unreasonably discriminate
against the customers of the acquired entity.
