Invocation was given by Reverend Frederick Haynes of the Johnson Chapel, African Methodist Episcopal Church. Each member of the City Council having received copies of the Minutes of February 2, 1959, rending of the Minutes was dispensed with and approved on motion of Counct!m~n Hubbard, Alternative writ of mandate and order staying further proceedings ~est Santa Ana Annex" sec~m~ed ~y Gould and carried. Garden Grove Police Officer Gerald Linn served Mayor Dale R. Reinly, Royal E. Hubbard, Stanley C. Gould, Jr., A. A. Hall and J. Ogden Markel, each a member of the City Council of the City of Santa Aha, and Marion Suttner, Clerk of the Council, with a petition for alternative writ of mandate an~ order staying further proceed- ings, and S~,m~nns in the case of the City of Garden Grove, a Municipal Corporation, Case 80700, versus the City of Santa Aha, et alz/to appear in Superior Court Februa~%. 27, 1959, at l:h5 P.M., to show cause why the scheduled March 10, 1959 election for the "West Bid acceptance Power street sweeper Spec. 624-6 Santa Aha Annex" shoald not be cancelled. Neighbour, Jr., for thm dedication of Marion Way and Bristol Street and all vehicular access rights on Bristol Street are dedicated to the City, was approved subject to the posting of a bond approved by the Attorney and Director of Public Works, license fee in the sum of $250.00 accepted and agreement covering improvements ordered signed. Cnmmunication was read from the Planning Commission recommending denial of Variance Application No. 1060 filed by Frieda Belfneante to conduct a music school to teach lessons on instruments of the symphony orchestra to individ,,els and groups, on property situated at 418 South Bristol Street, in R-2 District. Attorney N. Rodger Howell, representing the applicant, stated Bristol Street is a very heavily travelled highway and carries traffic of more than 17,0OO cars per day m~ing it unsuitable for a residential area. This property is a large corner lot, a portion of which is entirely vacant; there is a paved alley to the rear of the property which will allow access thereto, and there is adequate area for off-street parking. Mr. Casey, an independent real estate broker, stated he attempted to sell property on Bristol Street but there were no offers made for residential use. The Council having ,,r~nimously waived the readt~ of the Resolution, on motion of Councilman seconded by Gould and carried, the following Resolution entitled: "Resolution No. 59-31 granting Variance Application No. 1060 where Planning Commission recom~ended denial and imposing conditions upon the granttn~ thereof" was considered and passed by the following vote: Ayes, Councilmen Royal E. Dickenson to build a one-story medical building of stucco construction, with three proposed offices with nineteen parking st-] ] s, in accordance with revised plot plan, on property situated at 1313 and 1401 West St. Gertrude Place, in R-3 District. Joe 0. Barker, Mr. Van Yoder and Mr. Phillips, objected to the Variance and felt that it would be detrimental to their properties, a precedent would be set if this variance is allowed and it would not be to the best interest of the area. Clifford Kent, representing the applicant, requested that the Variance be granted, on motion of Councilman Gould, seconded by Markel and carried, the recom-~ndation of the Planning C~mmission was approved and the Variance denied. It was moved by Counc~lm-- Gould, seconded by Markel and carried, that the previous action denying Variance Application NO. 1064 be amended Variance Appl. No. 1067 Francis T. Ogden Markel Absent, Councilmen None Co~mmmication was read from the pl~nn%ng Commission recommending denial of Variance Application No. 1067 filed by Francis T. and Phyllis E. Hutain to permit construct- ion of a service station on property consisting of two lots situated at the north- w~st corner of Bristol Street and St. Gertrude Place (1300 block West St. Gertrude Place), in R-3 Distric~t. The applicant stated the property has access on two streets, there are no deed restrictions and it is not spot zoning. They have owned the property for appro~m-tely three years during which time all inquiries regarding the purchase of the property were of a commercial nature only. After considerable discussion, it was suggested that the application be withdrawn and Mrs. Hutain reluctantly withdrew the Variance Application. Communication was read from the Planning Commission recommending denial, without of prejudice, pending study~ Variance Application No. 10~6,filed by Buffums' to use the property situated at 928 Spurgeon Street, in R-3 District, for a parking lot in connection with the store, existing house to be demolished and removed, property to be landscaped, and the lot to be blacktopped. Fred Cook requested the matter be set aside until such time as the planning Commission cc~apletes the survey; using this property for parking facilities would devaluate the properties in the area, traffic would increase and the parking lot would not add to the appearance of the neighborhood. Mrs. Smith, ~er of property at Tenth and Bush Stroets, objected to the granting of the Variance in order to protect the neighborhood for residential purposes only. Attorney Milford W. D-hl, representing the applicant, stated the parking lot will accommodate ~6 cars mud will be used for customer and selective employee parking. The lot will be beautified, a sprinkler system inst~lled, ivy and trees planted and a block ~1~ put in place. ~he Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Hall and carried, the follo~ng Resolution entitled: "Resolution No. 59-~2 approving Variance on Application No. 1066 where Planning Commission recommended denial, and imposing conditions thereon" was considered and passed by the following vote: Ayes, Councilmen Royal E. On motion of Counci!~en Hubbard, seconded by Hall and carried, the application of L. M. Guyon, dba State Merchants Police, for a business permit to operate a patrol service was referred to the Police Department for investigation, processing and report back when the applicant has fulfilled the necessary requirements as set forth in the Municipal Code. On motion of Councilman Gould, seconded by Markel and carried, proper officials were authorized to execute contract dated February 16, 1959, with Harold Gimeno, Architect, reference certain revisions in the electric services of the Municipal Library to permit future connection of said services to future master service to be located in the Police Building. On motion of Councilm-n Gould, seconded by Markel and carried, bond in the sum of $72,000.00, filed by Harmir Construction Inc., for the improvements of Shelton Street, Park Drive, Towner Street, and a portion of Central Avenue, in Tract No. 2461, was ordered released and improvements accepted as completed. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Could, seconded by Hall and carried, the following Resolution entitled: "Resolution No. 59-39 declaring '~eld right,of-way ' intersection" on Myrtle Street at ~elton Street, as recommended by the Department of Public Works, was considered and passed by the following vote: Ayes, Councilmen Noes, Councilmen Absent, Councilmen Stanley C. Hubbard It was moved by Councilman Gould, seconded by Hall and carried, that authorization Messrs. be given Attorney Robert S. Barnes, of/_Kindel and Anderson, to proceed with the appeal in the matter of McClurkin versus the City of Garden Grove, to have Judgment entered in and proceed at once to appeal the case of Luna Eades and other parties, Case No. 71219, versus the City of Garden Grove and to carry both matters forward to conclusion at the agreed fee of $2750.00 for both matters, which said amount is to include all court costs, including the printing of briefs; ~aid amount being enlarged sufficiently to more than cover any court costs in these two matters. On motion of Counc~lm~n Gould, seconded by Hall and carried, the Mayor was directed to write a letter of commendation to the Junior Chamber of Commerce on the success of their Santa Annual Frolic. On recommendation of the Manager and on motion of Councilman Gould, seconded by Hall and carried, authorization was granted to change the total cost of Project No. 111, reconstruction of Standard Avenue from Delhi Road to McFadden Street, from $25,B41.50 to $26,835.63.
