family residential lots located generally at the southwest corner of the intersect-

On motion of Counc~lm~n Gould, seconded by Hubbard and carried, Map of Tract No.
3273 filed by Hugh M. Neighbour, Jr., for thm dedication of Marion Way and Bristol
Street and all vehicular access rights on Bristol Street are dedicated to the City,
was approved subject to the posting of a bond approved by the Attorney and Director
of Public Works, license fee in the sum of $250.00 accepted and agreement covering
improvements ordered signed.
Cnmmunication was read from the Planning Commission recommending denial of Variance
Application No. 1060 filed by Frieda Belfneante to conduct a music school to teach
lessons on instruments of the symphony orchestra to individ,,els and groups, on
property situated at 418 South Bristol Street, in R-2 District. Attorney N. Rodger
Howell, representing the applicant, stated Bristol Street is a very heavily travelled
highway and carries traffic of more than 17,0OO cars per day m~ing it unsuitable
for a residential area. This property is a large corner lot, a portion of which
is entirely vacant; there is a paved alley to the rear of the property which will
allow access thereto, and there is adequate area for off-street parking. Mr. Casey,
an independent real estate broker, stated he attempted to sell property on Bristol
Street but there were no offers made for residential use. The Council having

seconded by Gould and carried, the following Resolution entitled:

Co~nunication was read f~m the Planning Commission recommending denial of Variance
Application No. 1064 filed by Clarence E. Dickenson to build a one-story medical
building of stucco construction, with three proposed offices with nineteen parking
st-] ] s, in accordance with revised plot plan, on property situated at 1313 and 1401
West St. Gertrude Place, in R-3 District. Joe 0. Barker, Mr. Van Yoder and Mr.
Phillips, objected to the Variance and felt that it would be detrimental to their
properties, a precedent would be set if this variance is allowed and it would not
be to the best interest of the area. Clifford Kent, representing the applicant,
requested that the Variance be granted, on motion of Councilman Gould, seconded by
Markel and carried, the recom-~ndation of the Planning C~mmission was approved and
the Variance denied. It was moved by Counc~lm-- Gould, seconded by Markel and
carried, that the previous action denying Variance Application NO. 1064 be amended

Co~mmmication was read from the pl~nn%ng Commission recommending denial of Variance
Application No. 1067 filed by Francis T. and Phyllis E. Hutain to permit construct-
ion of a service station on property consisting of two lots situated at the north-
w~st corner of Bristol Street and St. Gertrude Place (1300 block West St. Gertrude
Place), in R-3 Distric~t. The applicant stated the property has access on two
streets, there are no deed restrictions and it is not spot zoning. They have owned
the property for appro~m-tely three years during which time all inquiries regarding
the purchase of the property were of a commercial nature only. After considerable
discussion, it was suggested that the application be withdrawn and Mrs. Hutain
reluctantly withdrew the Variance Application.
Communication was read from the Planning Commission recommending denial, without
of
prejudice, pending study~ Variance Application No. 10~6,filed by Buffums' to use
the property situated at 928 Spurgeon Street, in R-3 District, for a parking lot in
connection with the store, existing house to be demolished and removed, property to
be landscaped, and the lot to be blacktopped. Fred Cook requested the matter be
set aside until such time as the planning Commission cc~apletes the survey; using
this property for parking facilities would devaluate the properties in the area,
traffic would increase and the parking lot would not add to the appearance of the
neighborhood. Mrs. Smith, ~er of property at Tenth and Bush Stroets, objected
to the granting of the Variance in order to protect the neighborhood for residential
purposes only. Attorney Milford W. D-hl, representing the applicant, stated the
parking lot will accommodate ~6 cars mud will be used for customer and selective
employee parking. The lot will be beautified, a sprinkler system inst~lled, ivy
and trees planted and a block ~1~ put in place. ~he Council having unanimously
waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by
Hall and carried, the follo~ng Resolution entitled:

On motion of Counctlm~ Hubbard, seconded by GOuld and carried, the following
Ordinance entitled:
"Ordinance amending Part 3 of Chapter 3 of Article IV of the
Santa Ana MAmicipal Code, regulating pool halls"
was introduced, considered and placed on file for second reading, with the provision
relating to Police Officers be stricken from the Ordinence.
A petition was presented signed by approxi~etely 86 persons requesting that either
a four-way stop or sig~ lights be installed, at First and ~,~Lliw~n Stre(t~ and oD
motion of Counc!~man Gould, seconded by Hubbard and carried, the petition was
received, filed and request denied.
On motion of Counci!~en Hubbard, seconded by Hall and carried, the application of
L. M. Guyon, dba State Merchants Police, for a business permit to operate a patrol
service was referred to the Police Department for investigation, processing and
report back when the applicant has fulfilled the necessary requirements as set
forth in the Municipal Code.

that only two palm trees have been replanted on North Main Street in the three
blocks recently widened, and a poll of property owners, which was taken shortly
before the street widening program began, showed 17 persons wanted the trees re-
planted, and suggesting that before further widening operations begin, the Department
of Public Works furnish the Cc.~.ittee a plan showing the possible location of the
palm trees so that Committee members may make a further survey of the desires of
the property owners,

authorized to execute contract dated February 16, 1959, with Harold Gimeno, Architect,
reference certain revisions in the electric services of the Municipal Library to
permit future connection of said services to future master service to be located in
the Police Building.

M & W Bus Lines, Inc., before The Public Utilities Commission, for relocation of
terminal and rerouting, was referred to the Administrative Staff for reco~nendation
and report at the next meeting.
On motion of Councilm-n Gould, seconded by Markel and carried, bond in the sum of
$72,000.00, filed by Harmir Construction Inc., for the improvements of Shelton
Street, Park Drive, Towner Street, and a portion of Central Avenue, in Tract No.
2461, was ordered released and improvements accepted as completed.

It was moved by Councilman Gould, seconded by Hall and carried, that authorization

be given Attorney Robert S. Barnes, of/_Kindel and Anderson, to proceed with the
appeal in the matter of McClurkin versus the City of Garden Grove, to have Judgment
entered in and proceed at once to appeal the case of Luna Eades and other parties,
Case No. 71219, versus the City of Garden Grove and to carry both matters forward
to conclusion at the agreed fee of $2750.00 for both matters, which said amount is
to include all court costs, including the printing of briefs; ~aid amount being

On motion of CouncJlm-n Gould, seconded by Hall and carried, the City Y~n-ger was
granted permission to leave the City from February 18th to February 21st, 1959, to
attend the City Managers' Spring Conference, in San Mateo.
On motion of Counc~lm~n Gould, seconded by Hall and carried, the Mayor was directed
to write a letter of commendation to the Junior Chamber of Commerce on the success
of their Santa Annual Frolic.
On recommendation of the Manager and on motion of Councilman Gould, seconded by Hall
and carried, authorization was granted to change the total cost of Project No. 111,
reconstruction of Standard Avenue from Delhi Road to McFadden Street, from $25,B41.50
to $26,835.63.
On motion of Counc¶lman Gould, seconded by Hall and carried, the City Attorney was
instructed to appear in Superior Court, February 27, 1959, in regard to service of
papers on the City Council and the Clerk of the Council on the petition for alternative
writ of mandate and order staying further proceedings, and Summons in the case of
the City of Garden Grove, a Municipal Corporation, versus the City of Santa Ama,
et al, Case 80700, reference scheduled March 10, 1959 election of the '"West Santa
