HomeMy WebLinkAbout79-129RESOLUTION NO. 79-129 A RESOLUTION OF THE SANTA ANA CITY COUNCIL TO OPPOSE SENATE BILL 462 AND TO URGE ALL CITIES OF THE COUNTY OF ORANGE TO OPPOSE THIS LEGISLATION WHEREAS, State Senator Ralph C. Dills has introduced SB 462 which prohibits any government entity from causing the removal of any billboard or advertising display unless said entity condemns the property through eminent domain; and WHEREAS, this legislation preempts municipal control of billboards and advertising structures by usurping local regulatory authority; and WHEREAS, the existing Municipal Code for the City of Santa Ana, Chapter 41, Section 691 does specifically address an amortization timetable for nonconforming signs; and WHEREAS, it is the desire of the City of Santa Ana to retain, under the police power, its authority to amend and enforce zoning laws as they apply to all real property uses; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana: 1. That it does oppose and strongly urge all cities of the County of Orange to oppose SB 462. 2. That the City Clerk is hereby directed to send copies of this resolution to all State Legislators representing Santa Ana and all other portions of Orange County and to each Orange County City.
