RESOLUTION NO. 79-]73
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA DECLARING ITS INTENTION
TO VACATE AN ALLEY EAST OF HALLADAY STREET
AND SOUTH OF CHESTNUT AVENUE, APPROVING A
MAP THEREOF, DIRECTING THE CLERK OF THE
COUNCIL TO FILE SAID MAP, DESCRIBING THE
ALLEY TO BE VACATED, SETTING A PUBLIC
HEARING THEREON, AND DIRECTING NOTICE
THEREOF TO BE POSTED AND PUBLISHED.
BE IT RESOLVED by the City Council of the City of
Santa Aha:
1. Pursuant to and in accordance with the provisions
of Part 3, Division 9 of the Streets and Highways Code of
the State of California, this Council does hereby declare
its intention to order the vacation of and to vacate that
certain alley east of Halladay Street and south of Chestnut
Avenue as more particularly described and shown on that
certain document entitled "Street Abandonment No. 47" together
with attached maps, a copy of which is on file with the
Clerk of the Council, and more particularly described and
shown on Exhibit A attached hereto and incorporated by
reference herein.
2. That the City Council of the City of Santa
Aha does hereby approve said map entitled "Street Abandonment
No. 47" together with attached maps, as the map showing that
certain alley east of Halladay Street and south of Chestnut
Avenue which this Council delcares its intention to vacate.
3. The Clerk of the Council is hereby directed
to file said map in her office where the same may be examined
by any and all persons desiring to do so.
4. Notice is hereby given that at the hour of
7:30 p.m. or as soon thereafter as the matter can be heard
on the 5th day of November , 1979, in the Council
Chambers of the City of Santa Aha, 20 Civic Center Plaza,
Santa Ana, California, a public hearing will be held by this
Council at which time any and all persons interested in or
objecting to the proposed vacation of said alley hereinabove
described may appear and be heard.
5. The Clerk of the Council is hereby directed
to cause this Resolution to be published at least once in
"The Register", a newspaper of general circulation in the
City, within fifteen (15) days after the date of adoption of
this Resolution and at least ten (10) days before the date
set for said hearing.

6. The Director of Public Works is hereby directed
to post conspicuously, in the manner prescribed by law,
notice of the adoption of this Resolution, containing a
statement of the time and place of hearing hereinabove set
forth, along the line of the portion of said alley proposed
to be abandoned.

Proposed Alley Abandonment No. 47
East of Halladay,
South of Chestnut
Legal Description
That certain alley, 15.0 feet in width, in Block C of W. G. Benedict's Sub-
division of the Daniel Halladay Tract, as shown on that certain map recorded
in Book 25, pages 7 and 8 of Miscellaneous Maps, Official Records of Orange
County, California, together with the Northerly 2.5 feet of Lots 10 and 11
in said Block C of W. G. Benedict's Subdivision, together with the Northerly
lO.O0 feet of Lots 12, 13 and 14 in said Block C of W. G. Benedict's Sub-
division.
Excepting therefrom the Westerly 3.00 feet of said 15.0 foot wide alley.
Also reserving and excepting therefrom the permanent easement and right at
any time, or from time to time, to construct, maintain, operate, replace,
remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and
other convenient structures, equipment and fixtures for the transportation
or distribution of electrical energy and incidental purposes, including
access and the right to keep the property free from all inflammable materials
and wood growth, and otherwise protect the same from all hazards, in, upon,
over, across and under a strip of land bounded Southerly by the South line
of said alley and the South line of the North 2.5 feet of said Lots 10 and
ll and the South line of the North lO.O0 feet of said Lots 12, 13, and 14,
and bounded Northerly by a line parallel with and distant Northerly 7.5 feet,
measured at right angles, from said South line of the North lO.O0 feet of
Lots 12, 13 and 14 and its Westerly prolongation.
