Each member of the City Council having received copies of the Minutes of April 6 and April 14, 1959~ reading of the Minutes was dispensed with anM approved on motion of Councilman Hubbard, seconded by Hall and carried. Hearing Amending Section 9112.7 of Municipal Code. Ordinance This being the date set for hearing on amending Section 9112.7 of the municipal Code so that the first line of said Section shall reed as foll~s: "Said parking areas shall be afforded access to a public street or alley, and driveways to and from the parking area shall not be included in the required one-third total herein provided for;" no protests were received, and the hearing was declared closed. On motion of Councilman Hubbard, seconded by Hall and carried, the rec~mendation of the Planning Comissi~ was approved and the Variance granted subject to a condition. . Comm~cation was read frem the Planning Commission recommending approval of Variance Application No. 1086 filed by E. Reese Allison and Helen E. Peddicord to permit construction of a concrete block building (49 feet by 65 feet) to be used for a Nursery School, designed to accmmmodate 4~ children, two to five years (pre-kindergarten), with a fenced play yard from rear of the building approx- imately 50 feet by 50 feet; the proposed building will front 30 feet back of side- walk, with blacktopped area in fror$ allowing for off-street loading and un2~ding, and off-street parking to the rear for six cars, on propert~ situated ca the east side of North Grand Avenue, immediately south of 1741 North Grand Avenue, in R-1 District. Communication was read from the Planning Comm~ssian recommending approval cf Variance Application No. 1089 filed by Lyre bryant for construction of four triplex units, i.e., construct one triplex on each of the 50 foot hy 108 foot lots~ each triplex to consist of three two-bedroom apartments on property situated at 2201 and 2205 Kilson Drive, amd 220~ and 2206 Hickory, in R-1 District. Lyle Bryant, Drive 2205 Kilso~, stated income from the proposed buildings would constitute part of his live- lihood and felt the structures would improve the area. It was moved by Councilman Hubhard, seconded by Brewer and carried that the Variance be granted in accordance with submitted plot plan. Communication was read fr~ the Planning Comissi~n recommending denial on proposed abandon- ment of alley extending south frcm Washington Place between Logan and Lincoln Streets, which abandoument was requested by Frank Valencia, et al., under date of Febraary 13, 1959, as it would prevent property owners from having access to their proper~y. It was moved by Councilman Gould, secouded by Hall end carried, that the matter be continued until May 4, 1959, and that Mr. Valencia be advised accordingly. . Communication was read from the Planning C~m~ission rec~maending denial of Variance appli- cation No. 1081 filed by L. B. Hiett to construct a two-car garage with apartment aoove (24 feet by 22 feet in size) on rear portion of the lot, facing Anahurst Street cn t~- South, on property situated at 214~ Kilson Drive, in R-1 District. It was moved by Council- man Hall m~d secouded by Hubbard, that the Variance be denied as reco~onded by the Planning Cmm~ission. The mayor inquired if the applicant would consider a one-story apartment with attached garage, and Mr. Hiett stated he would be receptive to this suggestion. Councilman Hall withdrew his motiun. Itwas mOVed by Councilman Hall, seconded by Hubbard and carried, that the Variance Applicatiom be referred to the Planning Conmission for final determination as the applicant desires to submit a new plot plan. # On motion of Councilman Gould, seconded by Hubbard and carried, the recommendation of the Planning Commission was approved and Variance Application No. 1082 filed by Gerald Garcia granted to construct a single-fsmily three-bedroom house on rear portion of lot, in accordance with plot plan, on property situated at 1531 ~est Second Otreet, in R-2 District, subject to conditions. No. 1083 Farmers Unde~riters Associatic~ Reso. 5~-88 gr~nting Variance Ccmmuncation was read from the Planning Commission recommending denial of Variance Application do. 1083, filed by Farmers Underwriters Association to con- struct a building to be used for a regional office of the Farmers Insurance Qroup, the off,ce to be used only for ~tministrative purposes, and no sales operations to be conducted therefrom except on the supervisory level, on property situated on the east side of Flower Street between Memory La~e and Santa Ana Freeway, consisting of 8.2 acres. Communication was read from the Chamoer of Commerce setting forth their reasons for the approval of the Variance. On motion of Councilman Hubbard, secor~ed by Hall and carried, the communication was re- ceived and filed. -Attorney Robert L. Corfman, representing in excess of 100 residents in the vicinity of River Lane, North Flower and north of Oeventeenth Street, stated he had taken the liberty cf sending the Council excerpts from the meeting cg the Planning Cc~mi~sionj and quoted some of the remarks m~de by Com~aissioner Jeesee Ludicating this is apot zoning and not orderly planning, and to put a commercial island in a residential district is not good zoning, mr. Corfman said the InsuranCe Company has stated homes would be built of at least 1700 square feet in area amd~sting at least $17,000.00, to act as a buffer strip. Mr. Corfman stated that from a legal standpoint he would take considerable issue with the City Attorney on his position that this buffer zone could be enforced; there is no precedent in t~ds State where a City Cenncil can impose a zone on adjacent property. If the application is approved, subject to those ccaditions, there is nothing to prevent the applicant frm, selling these lots to people who would use them for service stations, dry cleaning establishments, etc. Mr. Con,man submitted a map showing locations of property owners signing protest petitions totaling 819 protestants. On motion of Councilman Gould, seconded by Hubbard and carried, the map was received and filed. Mr. Corfman stated he had a report from the Title Company for t~ various lots that are identical with lots involved in this particular trianglej and shows the numoer of changes which have been made in these lots since they were subdivided; one lot has been so~l five tim~s in a period of seven years, and severa~ · the lots have been sold only once. It was moved by Councilman Hubbard, seconded by Hall and carried, that the oral report be accepted. Mr. Ccrfman stated the group he represents has shown how they feel about the matter and requested the Council to preserve the intag~i~ of their homes in the area and dew the application, kobert T. Denton, 2746 llorth Flower Street, sa~ he lives directly across tD~ street from the pro- posed construction and asked what assurance the residents would have t ~at the dwellings proposed would actually be built; it is his understanding the Insurance Company cannot be compelled to construct the hcmes and the subdivider to whom the propert~ is sold could build anything he chose. ~e preferred the ~uole area be constructed in R-1 homes comparable to the homes in the 2700 block on North Flower. Mr. Denton requested that if the Council over-rules the Planning Commission that some legal terminology be incorporated which will assure the re- sidents of the area that the type of homes will be built as described by Mr. Smith of the Insurance Company. Douglas Corrigan, 2828 North Flower Street, stated he owns 660 foot frontage on North Flower Street and would~efer that the area remain residential;there are other areas in the City which the Insurance Company could purchase requiring no zone change and suggested that fir.. Smith of the. Insurance Company withdraw his application for a variance. Mr. J. Ogden Markel appeared as an interested citizen and requested the Council to retain the integrity of the City and deny this Variance. Gates Burrows, 950 River Lane, stated Henry Segerstrcm, Harold Segerstrom, William Croddy, Dr. Dalton Peelle, Dr. Blaisdell, Messrs. Carlyle, Hanson and Jd~nson et al, are opposed to t~s Variance. The M~For read com~,nications from Gates Burrows and A. J. mcfadden objecting to the granting of the Variance, and on ~motion of Co~cilman aubbard, seconded by Hall and carried, the communications were received and filed. Mrs. ~e~ay ~uick, 2218 North Ross Street, and ~illiam Gordon, 2632 North Flowerj gave their reasons far opposing the granting of the Variance. Herbert Oalverson, one ~the owners of the two parcels of proper~ stated he also was speak/ng on behalf of mr. and Mrs. Theo Lacy, owners of the other parcel. ~e said he had developed his orange grove for some sixteen years an~ had taken great pride in it; he now desires to sell this property but would not consider doing so unless he felt it was a goOd thing for the City; the ~nsurance Building would be a fine thing far the City and the neighoorhood, and requested the Variance be granted. J. M. Smith of the Farmers Underwriters A ' ssoclatiou, spoke on behalf of the Company. He stated they propose to con- struct a ouilding of approximaoely 65,000 square feet. 'l'hey brave nine other similar buildings. The function of these buildiD~s is to act as a regional office to process applications, claims, etc. Most of the employees will be clerical in nature with some executives. He feels the residents want some comcrete proof that the company will do exactly as they have represented, and they deserve an answer or proof of good faith. The company will build a high-class building, will be good neighbors, will put in proper Ouffer walls so that the entire area will he beautiful and one of which to be proud. The company has engaged Boyle Engineering ComDar~, Oonsulting Engineers, Spurgeon Building, Santa Ana, to go over the pro~erty and make an estimate as to what it would cost to put in the necessary ~mp. rovements on this parcel of land to make/~ a high grade suOdivision. £he figures are as follows: Site preparation, clearing 38 lots, %1200; excavation, lh,OOO cubic feet, e7,O00; curos for the subdivision, t4,350; paving $12,200; sidewalks 14,500 square feet, ,5,800! main sewer complete, $6,120; water mains, $5,h00; sewer house cannections, $3,OHO; 6' masoury wal]~ 2250 feet, $11,250; alley, 1200 linear feet, $8,6hO~ Since then it has been mentioned that a traffic signal should Oe installed, and if this Variance is granted, the Company will pay for a signal at Memory Lane and Flower ~treet. The total expenditure for the improvements will be approximately $78j273. These figures were submitted to the Executive ~ozmittee of applicant, and ~r. Smith was instructed to advise that if the Variance is granted, an expenditure of some %78,000. will De made which should attract high class buyers and show an act of good faith of the COmpany. The Company offered deed restrictions at the first mee~ng to assure buyers that the proper residential dwellings would be built in the area and would attract a high type buyer. There are prbbably many legal ways to ta~ further precautions to see that the $78,000. is actually spent. Carl Isaacson, 2738 ~iorth ~lower Street, stated he lives across the street from the proposed Ouilding. He indicated he has confidence in the insu~'ance company and feels they will live up to their contentions as to what they will do, and the building will be an asset to the ~s. ~. R. Johnson, 2742 ~. Flower Street, stated she lives across the street from the proposed structure. She ha~ been told her property value would decrease if the Variance is granted, Out she consulted t~ree well known real estate brokers who assured her the building would not be detrimental to the valuation. She feels if the Variance is not granted, homes of lesser ~ue may be c~n- structed, Dr. Robert Perry Davis, 524 W. Santa Clara Avenue, stated he h~ come to the meeting with au unbiased ~tnd and on the strength of the data presented by both sides, feels the integrity of the homes shonl~ be protected. The stipula- tions in the Variance should ~ke the ?n~urance Compa~y carry out the promises they have made~ ~ ~or declared the hearing closed. The Ma~or read a c~mu~cation sig~ed by E. G. Buster, Vice-president of the Townsend Compare,y, stating that the best possi01e use of the land in question would be made by the I~s~rance Company, and on motion of Councilman Gould, secouded by Hall and Carried, the communication was received ar~ filed. Councilman Gould stated that a difficult decision would have to be made. A Variance is granted to a person who is owner of property where there is a hardship to continue for him to use the property for R-l, and conditions can be imposed and enforced, ae stated he did not believe this property is an island. The railroad and the Freeway bring this specific property into special circumstances. Its use as R-1 is useless for that purpose--it could be R-3. Three requests to re-zc~e this property have been rejected. ' If the Variance is granted, an attrabtive building, with good homes surrounding it, will not detract from the value of the homes in the area. Councilman Gould moved that the Council declare there appears to be a hardship in the use of this property. ~otion lost for lack of a second. Councilman Brewer asked at what approximate date construction of curbs, etc. would begin. Mr. ~mith of the Insurance Company stated within one week of the granting of the Variance an architect would De engaged to draw the proper plans and give advice as to how to locate the dwellings. He was unable to give the exact date the construction would actuall~ begin, but as soon as plans were received from the architect, the company would call for bids. Councilman Hall stated be felt Santa Aha should se a well Oalanced community. ~a~or neinly stated if the Variance is granted he will see that every legal pro- tection is given that the insurance group builds the 1700 foot houses, the improvements go in before the ouilding is constructed, and that the houses go in as a ouffer strip. The Council has given the matter a great deal of con- st~eration and is looking to the best interests of Santa Aha.
