Each member of the City Council having received copies of the Minutes of April 20,
1959, reading of the Minutes was dispensed with and approved on motion of
CounCilman Huobard, seconded by Hall and carried.

Variance Application No. 1100 filed by the Orange County Farmers Mutual Fire

size), to be used by their personnel and staff, with off-street parking space
for 30 cars; a portion of the premises to be utilized by a life insurance company
for office space, on property situated at the northwest corner of Fifteenth Street
and North Broadway, in R-2 District, subject to conditions. Attorney Robert S.
Barnes, representing the applicant, requested waiver of the three-foot side yard
setback on the southerly side of the building on Fifteenth Street. The Council
having unanimously waived the reading of the Resolution, on motion of Councilman
Hall, seconded by Hubbard and carried, the following Resolution entitled:

Street between the Santa Aha Riwr and College ~venue; ooth sides of

Setback Lines established, by repealing paragraph (c), paragraph (L) and the
following portion of paragraph (d)"...en both side$ from Flower Street to the west
city limits, 50 feet from the surveyed center, except that..." Said paragraph
(d) will then read "d" West Oeveateenth Street, on the north side from Bristol
Street west to a point 138.71 feet east of the sarveyed center l~ne of ~lona
Street, the setback line shall be 140 feet north of the surveyed center line of
West Seventeenth Street, measured at right angles and except that on the n~rth
side from Bristol Street to Baker Street, the setback line shall be 60 feet

to abate the public nuisance heretofore declared hy the

hear seeds of a wingy or downy nature and attain such a
large growth as to become a fire menace when dry and which

This being the date set for hearing on the annexation of property consisting

The ~ayor announced this is the time and place ests or objections
against the assessment for the improvement of St. Andrew Place and other
streets in Assessment District No. 199, and asked the Clerk if she was in
p~ssession of the affidavit of publication, affidavit of posting and affi-
davit of mailing. The Clerk stated she had the affidavits, and on motion
of Councilman Hubbard, seconded by Hall and carried, the affidavits were
received and filed. The ~vor asked the Clerk if she had received any
written protests or objections against the assessment, the improvements as
constructed, or the proceedings, and the Clerk read letters ofprobest from

On motion of Councilman Huobard, seconded by Hall and carried, the protests
were received and filed. George N. MacA~evin, 2246 Oak Street, stated he
had transferred five feet of property to the city in March, 1959, and felt
he had oeen charged for i~rovement to sm~e. The Director of Fublic Works
answered his inquiries. The ~a~or asked if *.he cost was in excess of the
~riginal estimate, and the Director of Public Works indicated t~mt it was.
The Mayor also inquired as to why these protests were filed for excessive
charges and felt a report should ce made due to the complaints. £he foll-
owing individuals protested relative to excessive chargea, damage to
curbs, driveways, and fences and an explanation as to how the charges were

Hentges, 17472 S. Alewhope. The Director of Public Works explained the
various charges, including the district charge for engin~ering~ legal
fees, inspection, advertising, etc. At the request of the Mayor, the
Director of Public ~orks retired to an adjacent room to answer in detail
questions regarding the above matters. Mr. Kemeth Carter of Sully-
Miller Company, contractc~ on the job, was present, and spoke in defense
of the work. It was moved by Uouncilman Hubbard, secoDAed by Gould s~d
carried that t~ hearing be continued to May 18, 1959.
On motion of Counciln~n Hubbard, seconded by Hall and carried, the recommen-
dation of the Planning Ccam~ission was approved, and Variance Applicatic~
No. 1099 filed by W. C. Connell and Jack L. Jarman granted to construct
a commercial b~ilding, 80 feet by 100 feet in size, to be used for whole-
sale food Ousiness, off-street parking space to be provided for 52 cars,
all as sho~ on plot plan on property situated at 12422 ~est Seventeenth Street,
in R-1 District, subject to conditions.

The Council, having unanimously waived the reading of the Resolution, on
motion of Councilman Hubbard, seconded by Brewer and carried, the following
Resolution entitled:
"Resolution No. 59-106 of the City Council of the City of

The Manager submitted a tabulation of oids for the improvement of Towner
Street et al in Assessment District No. 202 and stated three bids were
received. Also, this is a very complex Assessment~ District; C~x Brothers
submitted a l~ bid of *17,118.75 but as the low bid is 15% to 20% higher
than the bid anticipated, he requested postponement of the award of the
bid in order to check the property owners in the area to see if this
additmmal cost is acceptable and tore-compute the total amount of the

cation was read from the Planning Commission recommending approval of Tentative
Map of Tract i~o. 3387 filed by Villa Riviera Development Corporation creating
35 residential lots located approximately 830 feet south of Westminster a~enue
and 1320 feet east of Newhope Street. Allan ~. McMahan, representing the
subdivider, stated they Were agreea01e to the condibions with the exception of
Condition No. 5 that Morningside Avenue be extended and stubbed at the east
side of this tract so as to provide a reasonable means for the development of
the adjacent property to the east. M~yor Heinly spoke on behalf of the suo-
divider and stated if this condition is imposed, the subdivider is being forced
to buy Oack from the owner m~e property and take one full lot from him; there
is no definite assurance that this street will go through. It was moved by
Councilman Hu~bard, seconded by Gould and carried that Tentative Tract Map.
No. 3387 be approved, subject to all of the conditions.

14 industrial lots located generally 1000 feet north of McFadden Street on the

Communication was read from the Planning Con~nission recommending approval of
Tentative Map of Tract No. 2868 filed by Donald ~. Butts, creating 148 residential
lots located generally at the nc~theast corner of the intersection of Smeltzer
s~.bject to conditions.
Avenue and Yerano Street/ Donald K. Butts stated he was agreeable to all
conditions except Condition No. 1 that the final tract map shall not be
approved until the City of Santa Ana ccmpleted negotiations with Garden Grove
Sanitary District for sewers. Mr. Butts stated he has no knowledge as to how
soo~ said negotiations will be completed, and he would like to develop and
file the map for one-fourth of the l~nd and start construction. On motion of
Councilman Hall, seconded by Hubbard and carried, Tentative Map of Tract No.
2868 was approved, subject to the conditions with the excepbion of Condition
NO. 1.

Communication was read from the Planning Con~nission recommending approval
of Variance Application No. 1098 i~iled by A. Sandy Steiner to construct a
building to be used for Frostee Freeze ice cream drive-in, with no inside
seating, no Juke boxes nor cigarette machines, and also construct ouilding
at rear of lot with 18 parking spaces, to be used for modern, automatic
laundry, with ample setbacks and allowance fc~ future widening of hdinger
on pr~operty situated at 13226 and 13232 Edinger Street, subject to conditions.
Stree_%/ ~rs. ~¥ade Herrin, 1505 N. Baker Street, a member of the Smedley
Junior High School P.T.A. dejected to the establishing of any type of
eating place so close to the school, and there are other schools in close
proximity, the school operate closed ca~ous so there would be no diffi-
culty during school hours, but after school. Mrs. Herrin stated children
have a tendency to congregate after school hours and feels there may be
vandalism when the children frequent such an establis~ent. Paul Dunn,
12972 Occidental, member of the P.T. A of Smedley Junior High School
and the Diamond School, stated there had been difficulty with a~estab-
lishment of similar nature at this location in the past and objected
to this type of business. The applicant stated he purchased this property
scme 2~ years ago, and for the past 20 years or more it has oeen a business
corner. The property was formerly used for service station purposes witch
a two bedroom house in the rear. The last tenant operated an eating estab-
lishment and there was considerable trouole due to his manner of operation.
Mrs. Louise Perkins, member of the Smedley Junior High School and Diamond
School P.T.A., stated she had no objection to a business being conducted
at this location but protested this type of establishment. Mrs. Andrew M.
~eyer stated she has children in Smedley Junior High, and the school
suffered adverse puolicity sometime ago due to an eating place at this
location known as "Rock and Roll" and objected to a business of similar
a Santa Arm Register reporter,
nature being started. ~alph Worsham~ objected to the granting of the
Variance because of the difficulty experienced during the operation of
a similar business under a former owner. It was moved by Councilman
Gould and seconded Dy Brewer, that a resolution be adopted over-ruling the
rec ........ endation of the Planning Comissic~ insofar as this Variance is
concerned, permitting the construction of a laundromat out denying the
sale of food. Oouncllmar~ Hall stated he recognized the fact there are
problems but did not feel the locatica had any oearing. This is a
nationally recognized business with a good reputation, and thsre are
a n,,mber of undesirable businesses which could he put in at this loc-
ation.
