HomeMy WebLinkAbout79-198CTD/fm 10/25/79 RESOLUTION NO. 79- 198 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA IN SUPPORT OF THE SB 90 CLAIM OF THE COUNTY OF LOS ANGELES FORESTER AND FIRE WARDEN AND CONSOLIDATED FIRE PROTECTION DISTRICTS FOR REIMBURSEMENT FOR FIRE CLOTHING AND EQUIPMENT REQUIREMENTS FORMULATED BY THE OCCUPATIONAL SAFETY AND HEALTH STANDARDS BOARD WHEREAS, the Occupational Safety and Health Standards Board of the State of California did on or about April 27, 1978 adopt certain requirements for clothing and equipment for structural fire fighters which are set forth at Title 8 California Administrative Code Sections 3401 - 3409; and WHEREAS, prior to the aforementioned requirements no specific regulations existed which were applicable to clothing and equipment of structural fire fighters employed by local government; and WHEREAS, the aforementioned requirements constitute a cost mandated by the State upon the City of Santa Ana as defined in Revenue and Taxation Code Section 2207; and WHEREAS, the County of Los Angeles Forester and Fire Warden and Consolidated Fire Protection Districts have filed a claim for themselves, and all similarly situated governmental entities, before the State Board of Control for costs mandated by the aforementioned State regulations, which have not been reimbursed pursuant to Revenue and Taxation Code, Section 2231; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: That this Council declares its support for the aforementioned claim as a State mandated cost caused by an executive order issued by the Occupational Safety and Health Standards Board which should be totally reimbursed by the State of California. The Clerk of the Council is directed to deliver a copy of this resolution to the Executive Secretary of the State Board of Control upon execution.
