HomeMy WebLinkAbout80-010DMF: ms 1/3/80 RESOLUTION NO. 80-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AUTHORIZING LOANS UNDER CERTAIN CIRCUMSTANCES TO PAY ALL OR A PORTION OF QUALIFIED PROPERTY OWNERS' SHARES OF SPECIAL ASSESSMENTS. WHEREAS, federal regulations (24 CFR 570.200(f)) provide that Community Development Block Grant ("CDBG") funds received from the United States Department of Housing and Urban Development ("HUD") may be used to pay the property owners's share of costs of public improvement of property owned or occupied by iow- and moderate-income households in a special assessment district; and WHEREAS, CDBG funds in the amount of $64,000 were approved by the City Council in the third and fourth year CDBG budget for loans to needy low- and moderate-income property owners in special assessment districts to pay their share of costs of public improvements in said districts; and WHEREAS, Assessment District 242 was created in the City of Santa Ana in accordance with the "Improvement Act of 1911," California Streets and Highways Code Sections 5000 e~t seq. by Resolutions 78-67 and 78-68 of this Council; and WHEREAS, the City Council adopted Resolution 79-222 confirming assessments in Assessment District 242 pursuant to the Improvement Act of 1911 on December 3, 1979; and WHEREAS, Section 5129 of the California Streets and Highways Code permits use of federal funds for the payment of assessments levied, on lands owned and occupied by low- and moderate-income households, by legislative bodies in special assessment districts created under the Improvement Act of 1911; and WHEREAS, the City of Santa Ana desires to lend Community Development Block Grant funds received from HUD to pay all or a portion of special assessments on properties owned and occupied by certain qualified low- and moderate- income households in Assessment District 242 in amounts not greater than $2,000.00 for each benefited property. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, that loans using Community Develop- ment Block Grant funds to pay all or a portion of the property owner's share of costs of public improvements benefiting properties owned and occupied by qualified low- and moderate- income households in Special Assessment District 242, created under the Improvement Act of 1911, are hereby authorized, RESOLUTION NO. 1/3/80 Page Two 80-10 subject to a maximum of $2,000.00 for each such loan such benefited property.
