Hall, Bob Brewer, Dale Ho Heinly Absent: Councilmen Stanley C. Gould, Jr. Councilman Gould arrived at 7:40 Council Chamber Santa Ana City Hall June 29, 1959 7:30 P.M. Variance Appl. No. 1132 Jezowski and Markel iMap of Tra~ct 2743 Villa-Riviera Development, ~UC. Communication was again read from the Planning Conm~ssion recommending approval of Variance Applicatic~ No. 1132 filed by Jezowski and Markel to esta01ish a cement contracting business to be operated with a maximum of four en~loyees, including owners, on premises; and to place a 5 foot Oy 6 foot sign in front of the business; off-street parking space to be provided for six cans on property situated approximately 240 feet north of intersection of ~dinger Street and the proposed exte~sion of Fairview Street, suoject to conditions ~f the Planning Comn~ission and Department of Public '~orks. A cam~unication was read frum Hubert Melton objecting to dedicating nearly l~ acres of his property for the widening of Edinger Street and expressing the desire to sell said property to the City for the sum of $10,000.00. Attorney Jo~ Cochran spoke on behalf of the appli- cants. After considerable discussion, it was moved by Counczlman Hubbard, seconded by Brewer and carried, that Variance Application No. 1132 be granted, subject to conditions. ,, Mayor Heinly disqualified himself on t~e following matter. Vice-Mayor Hall assumed the chair. On motion of ~ounciLman Gould, seconded by Huooard and carried~ Map of Tract Ho. 2743 filed by Villa-~iviera Development, Inc. was approved for the dedic~ion of Moonridge Avenue, Mountain View Street, Agreement First Christian Improvement of Artesia St. i Escrow Instructions Reso. No. 59-164 Accep~ deed James Shealy et ux Reso. ~Wo. 59-165 Declaring additions ,to system of major City streets Rsso. No. 59-166 Quitclaim deed Walter C. ~ollins Hazard Avenue, Newhope Street, and all vehicular access rights to Hazard Avenue and Newhope Street and easement for sanitary sewer purposes as shown; bond in tile sum of $42,000.00 approved; license fee in the amount of $1,450.00 accepted, and agreement covering improvements ordered signed. On mobion of Councilman Hubbard, seconded 0y Brewer and carried, proper officials were authorized to enter into an agreement with the First Christian Church for the improven~nt of Artesia Street, oetween Fifteenth and ~iEteenth Sbreets. ,, It was moved by Councilman Hubbard, seconded by Gould and carried that escrow instructions he amended to provide that no portion of the ,50,O00.00 remaining in escz~ow after the $40,000.00 payment, is to be disoursed until all lessees of the property have executed and delivered to the City quitclaim deeds to the property transferred to the City; that escrow instructions be approved and ordered signed with James A. and Loretta W. Shealy, in the sum of ~90~000.00, as consideration for removing all portions of the building from th~ westerly l0 feet of the property located at the northeast corner of i~ashington Avenue and ~in Street. ,, Mayor Heinly ~esumed the Chair. ,, The Council having unanimously waived the reading of the F~solution, on motion of Councilman Huboard, seconded by Gould and carried, the following Resolution entitled: "Resolution i~o. 59-164 accepting deed from James A. and Loretta ;,. Heiuly Noes, Councilmen None Absent, Councilmen' None The Council having unanimously waived the reading of the Resolution, on ~otion of Councilman Hubbard, secomded by Gould and carried, the following Resolution entitled: "R2solution No. 59-165 selecting and declaring certain proposed thoroughfares to be additions to the major City street system of Santa Ana, California, and requesting the Otate of California, Department of Pu01ic Works, to approve said selection and declaration" said portion of thoroughfares oeing Fairview Street-Delhi Road to First Street; McFadden Avenue-Raitt Street to Fairview Street, and Delhi koad-Raitt Street to Harbor noulevard, was considered and passed by the following vote: Ayes, Councilmen Royal E. The Council ha~ing unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by ~ould and carried, the following Resolution entitled: "Resolution No. 59-166 accepting quitclaim deed" from Walter C. Collins for drainage and sanitary sewer right-of-way running easterly frcm Lincoln Avenue to the south end of Fuller Street, was considered and passed by the following vote: Ayes, Councilmen Royal E. Annex" (Set hearing d~%te) specifications were approved, and the Purchasing Agent authorized to advertise for bids for the improvement of Center Street from mdinger ~treet north to approx~mtely 200 feet north of La Verne ~venue, !~roject C-38; bids to be opened July 20. ,, It was moved by Councilman Hubbard: seconded by Brewer and carried, that the Manager be authorized to institute condemnation proceedings on property at the northwest corner of Nineteenth and Main Streets, owned by Frances M. '~'cCart'er. On motion of Councilman Hubbard, seconded by Hall and carried, the request of the Manager was approved for transfer of funds amending the 1958-59 Budget as follows: From Fund 11-331 to Fund 11-337 - $1,500.00 From Fund 11-332 to Fund 11-337 - *1,000.00 Frcm Fund 11-333 to Fund 11-337 - $1,560.00 and From Fund 11-000 to ~und 23-276 - ~ Total $5,1~O. O0 On motion of Councilman Hubbard, seconded by Hall and carried, the conm~unication from ~o,~- C. Zukerman and a petition signed by approximately thirty-five persans protesting illegal efforts of the City of Garden Grove to impose ad valorem prop-' erty taxes upon the area were received and filed. Roy Zukerman, 14h31 Gates Saint a Aha Street,/spoke briefly in regard to the matter. On motion of Councilman Hubbard, seconded by Gould and carried, the City Attorney was instructed to institute proceedings for a ~rit of ~andate against the City of Garde~ Grove. On motion of Councilman Hubbard, seconded by Hall and carried, the ~'equest of Jack Fisher Chapter 23, Inc., Disabled American Veterans, was granted for per- mission for contestants in an an~ual fund-raising project known as "Blue and Gold" to sell tickets between July 9 and August 15 to a Coronation Ball. The City Attorney reported that the "Tustin and Freeway N. ~. Annex" is located south of First Street, west of Tustin Avenue, and that the Boundary Co~.~mission, at its meeting June 29, 1959, determined the description of the boundary was reasonably definite and certain and was approved with the statement that said boundaries overlapped the ~'Ira March.ant Annexation" of Tustin; that said Tustin annexation has been withdrawn and superseded by the ,,Ira Marchant Annexation No. 2" which Sxoludes the area of overlap as reported by the County Surveyor's Office and the Department of Public ~orks. On motion of Councilman Hubbard, seconded by Gould and carried, the oral repo=t was accepted. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hall, seconded by Hubbard and carried, the following Resolution entitled: "Resolution No. 59-167 initiating proceedings for the annexation of territory to the City of Santa Ana, designating an appropriate name of *Tustin and Freeway N. W. Annex, and giving notice of time and place of hearing protests thereto" setting the hearing date on August 17, 1959, was considered ~ud passed by the following vote: Ayes, Councilmen Noe s, Councilmen Absent, Councilmen Royal E.
