HomeMy WebLinkAbout80-055REL:ms 3/4/80 RESOLUTION NO. 80-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA REQUESTING THE BOARD OF SUPERVISORS OF ORANGE COUNTY TO CONSOLIDATE A SPECIAL MUNICIPAL ELECTION OF THE CITY OF SANTA ANA WITH THE GENERAL ELECTION TO BE HELD ON JUNE 3, 1980 WHEREAS, the City Council of the City of Santa Ana intends to call a special election in the City of Santa Ana on June 3, 1980 for the purpose of submitting to the qualified voters of the City certain proposed amendments to the City Charter; and an advisory measure on sales for apportionment; and WHEREAS, there will be a statewide general election held on June 3, 1980; and WHEREAS, it is deSirable that said special election of the City of Santa Ana be consolidated with the statewide general election to be held on the same date and that within the City of Santa Aha the precincts, polling places and election officers be the same, and that the Board of supervisors of the County of Orange canvas the returns of the special municipal election be held in all respects as if there were only one election; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana: SECTION 1: That pursuant to the requirements of Section 23302 of the Elections Code of the State of California, the Board of Supervisors of the County of Orange is hereby requested to consent to and order the consolidation with the general election of June 3, 1980, of a special election of the City of Santa An~ to be held upon the same date for the purpose of submitting to the electors of the City of Santa Ana certain propositions to appear on the ballot as follows: NUMBER OF WARDS. Shall section 101.1 of : YES : : the Charter be amended and section 101.3 be : : : deleted so that the number of wards in the : : : City shall not be more than seven, regard- : NO : : less of population increases? : : : RESIDENCY QUALIFICATIONS OF CANDIDATES FOR : : : CITY COUNCIL. Sha~l section 401 of the : YES : : Charter be amended to make it consistent : : : with existing law by requiring that a : : : candidate for city council be a resident of : NO : : the ward from which he seeks election at the : : : time of his nomination? : : : RESOLUTION NO. 80-55 PAGE TWO EMPLOYMENT OF DEPARTMENT HEADS. Shall : section 1002 of the Charter be amended to : include the Director of Recreation and Parks,: Library Director, Museum Director, Director : of Public Works, Director of Building Safety,: Director of Planning, Equipment Maintenance : Superintendent, and Executive Director - : Redevelopment Agency in the "excepte~ : service" division of the civil service? : YES : : NO : : CONSOLIDATIONS AND ANNEXATIONS. Shall sections 1012 and 1013 be added to the Charter to provide for placement on city employment eligibility lists of officers and employees of any city which may be consolidated into the City of Santa Aha or other public agencies which may be annexed or: otherwise merged into the City of Santa Ana?: SALES TAX APPORTIONMENT~ Should the Governor : and Legislature of the State of California : be advised that: : : "It is the will of the people of the : City of Santa Ana that the Governor and : Legislature apportion the existing six : cents sales and use tax so that two : cents ~rather~ than t~e ~present one cent : be allocated to be used by cities and : counties and special districts for : priority local services rather than by : the state for state distribution or : state reserves. : 'It is understood that if the Governor : and Legislature so act, any funds : resulting therefrom which would cause : the city to exceed a spending limit : imposed by a vote of the people of the : City. of Santa Ana or the State of : California shall, in accordance with : the provisions of the limitation, be : returned to the people. : 'Further, it is the will of the people : that the Governor and Legislature enact : such allocation into law no later than : July 1, 1980, to avoid enactment of : this proposal through the initiative : process tO cure .legislative default." : : YES : : NO : : YES NO SECTION 2: Said Board of Supervisors is hereby authorized to canvas the returns of said special municipal election pursuant to Section 23306 of the Elections Code of the State of California. SECTION 3: The City of Santa Ana recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County for any such costs. RESOLUTION NO. 80-55 PAGE THREE SECTION 4: The Clerk of the Council is hereby directed to file a certified copy of this resolution with the Board of Supervisors of the County of Orange and a certified copy of this resolution with the Registrar of Voters of the County of Orange.
