RESOLUTION NO. 80-56
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA REVERSING THE ACTION
OF THE PLANNING COMMISSION ON CONDITIONAL
USE PERMIT APPLICATION NO. 79-34, APPROVING
SAID CONDITIONAL USE PERMIT, AND GRANTING
APPEAL NO. 413.
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on March 17, 1980, on
the action taken by the Planning Commission in denying
Conditional Use Permit Application No. 79-34, which application
seeks to allow construction of an outdoor advertising sign
(billboard) at 2643 North Main Street in the C2 District;
and
WHEREAS, prior to taking action on said Conditional
Use Permit Application, this Council has reviewed and considered
the Negative Declaration for the project, including Initial
Study No. IS 79-218;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. That based on such public hearing and the
oral and documentary evidence submitted therein, the City
Council does hereby reverse the action of the Planning
Commission denying said Conditional Use Permit Application
No. 79-34, and does hereby approve said Conditional Use
Permit and grant Appeal No. 413.
2. That the City Council hereby adopts, as its
findings of fact for the approval of Conditional Use Permit
No. 79-34, the following:
(a) The subject sign is consistent with a policy
of providing a moderate amount of outdoor advertising
space in appropriate locations in the City, which
service contributes to the general well-being of
the community.
(b) The subject sign will not have a significant
adverse effect on persons or property in the
vicinity, due to the circumstances of its location
and surroundings.
(c) The subject sign will be in compliance with
all relevant zoning regulations and conditions.
(d) The subject sign will not have a significant
adverse effect on the future development of the
surrounding area in accordance with the General
Plan of the City.
3. For the reasons set forth in the Negative
Declaration prepared for this project, the Council approves
and adopts the said Negative Declaration and its finding
that the project will not have a significant effect on the
environment.

4. The said Conditional Use Permit is approved
subject to the requirements and limitations set forth in the
report of the Planning Commission for the said Conditional
Use Permit, a copy of which is a file on the office of the
Clerk of the Council, except that requirement 7A(1) therein
is revised to read as follows:
That this conditional use permit shall terminate
at the end of a five-year period; provided, however
that at the applicant's request the Planning
Commission may grant an extension of this Conditional
Use Permit under the same conditions, or under
different conditions, without the necessity of
filing an additional application; and provided,
further, that the applicant shall remove the sign
without cost to the City of Santa Ana upon thirty
days written notice from the City Council, if, at
any time, the City Council determines that removal
of the sign is necessary or appropriate for purposes
of new development or redevelopment of the subject
site.
