Presentation of National Safety Council Driver Awards to Postal Carriers Acting Postmaster Novel Jam-s commended Assistant Postmaster L. G. Schaitzerling for for his excellent service in his over for~y years employment. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Brewer and carried, the following Resolution entitled: "Resolution No. 59-229 declaring the vacation of portions of Smeltzer, Sugar, and Fair~iew avenues~ and Clinton and Kellogg Streets near the East Bank of the Santa Ana River" was considered and passed by the following vote~ A~es, Councilmen Royal E. Dixon W. Tubbs, 14732 Tustin Avenue, stated that he is partial owner and trustee for other owners of this property;and in view of the fact that the Freeway is going to take the property, they are endeavoring to secure land for commercial development in the area. G~ McHenry, 14871 Tustin Avenue, protested any change in zoning of this particular area and requested that he be permitted to read the letter signed by him, dated August 10, 1959, addressed to the Planning Commission, wherein he set out the reasons for his protest. Attorney Walter H. AttorneY W, J. Clemons, on behalf of the applicant, stated there are other businesses in this particular area, such as a service stationj welding shop, grocery store, etc. The building has been changed into au office building, and if the Variance is gra~ted will have stored therein only two tractors, two trucksa and no gasoline, and no burning of oil will be permitted. The applicant has dane considerable work on the yard and will construct a fence as high as necessary at the back ofthe yard. Also, the district has a business right across the street, storing eight or ten times more equipment thm~ will be stored in this building. Rabnuy, 215 South Flower Street, Costa Mesa, said he is the owner of property at 11115 East Fifth Street, and the establishment of a garage business will down-grade the property, and it is his intention to build a home on his property. The Manager asked that Mr. Reagan submit a statement requesting a continuation of hearing to October 5~ 1959. Mr. Savage stated that he would like to file a Record of Survey, concurrent with survey map showing the area as not a part of the subdivision, leaving ~mprovements and actual construction as the responsi- bility of the property ~vners. Objection was made as to conditions 5, 7 and 8, add he requested deferrment of action until September 21st. On motion of Councilman Gould, seconded by Hubbard and carrie~ the Preliminary Record of Survey Map was approved, filed by Cecil DeVore, subject to conditions. . On motion of Councilman Hubbard, seconded by Gould and carried, Map of Tract No. 3531, filed by Cardinal Homes, for the dedication of Fairview Street, Marine Street, King Street, Everglade Street, Sullivan Street, DahlLane, Wilshire Place, LaVerne Avenue, Elder Avenue, and Oorchar~ Avenue, and dedication of vehicular access rights to Fairview Street, except street intersections, and bond in the sum of $146~O00.00 were approved, license fee in the sum of $6,150.00 accepted, and agreement covering improvements ordered signed. . Councilman Hubbard stated there is a State law to cover the printing, distributiom~ or selling of lewd literatare and read Section 311 of the California Penal Code, and said that if the Council passed an Ordinance in conflict with the State law, that it may be decla red unconstitutional. Councilma~ Gould stated that he had discussed this with the Committee, and proceeded to read Section 3il of the California Penal Code; this is a 8~*ficult field to legislate in, and any Ordinance to regulate it would be reasonaole. The Ordinance is a step in the right direction and would be a help. Statements were made by the Mansger, the Attorney, and several persons in the aulience. Edward J. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Gould, seconded by Hubbard and carried, the following Resolution entitled: · Resolution No. 59-245 amending sections 2 and 3 of Resolution No. 58-281, and repealing Resolution No. 5114 and all Resolutions amending said Resolution No. 5114" re-establishing the basic compensation plan for officers and e~lo¥~e~ of the City of Santa Ana, was considered s~l passed ~y the f. ollowing vote: A~es, Councilmen Royal E.
