HomeMy WebLinkAbout80-086REL:ms 4/24/80 RESOLUTION NO. 80-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DESIGNATING AN HISTORICAL REHABILITATION AREA AND ADOPTING PROCEDURES FOR THE SELECTION AND FINANCING OF REHABILITATION PROJECTS PURSUANT TO THE MARES HISTORICAL REHABILITATION ACT OF 1976 WHEREAS, the Marks Historical Rehabilitation Act of 1976 provides a means by which local governmental agencies may make long-term, low-interest loans to finance the rehabilitation of properties of historic or architectual significance; and WHEREAS, this Council, by it Ordinance No. NS-1519, adopted criteria for the selection of historical properties eligible for financing and criteria for the selection of an historical rehabilitation area; and WHEREAS, this Council has established a Citizens Advisory Board for the purpose of providing recommendations to the City Council on the contents of the Historical Rehabilitation Financing Program; and WHEREAS, the said Citizens Advisory Board has recommended the designation of an Historical Rehabilitation Area as delineated in Exhibit A, attached hereto and incorporated herein as though fully set forth; and WHEREAS, public meetings have been held to inform the public of the proposed Historical Rehabilitation Financing Program; and WHEREAS, prior to the adoption of this resolution, this Council has held a public hearing, duly noticed in the manner required by Section 37628 of the Health and Safety Code of the State of California, and has considered all of the proceedings, testimony and evidence presented to it at said hearing; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana as follows: SECTION 1: The "Marks Historical Rehabilitation Area" as shown on the map attached hereto as "Exhibit A" and incorporated herein by reference is hereby designated as the Historical Rehabilitation Area of the City of Santa Ana. SECTION 2: Based on the recommendations of the Citizens Advisory Committee and upon the other evidence submitted to the City Council at the public hearing, it is hereby found and determined that the said Historical Rehabilitation Area constitutes a distinct section of the City of Santa Ana having special character, historical, architectural and aesthetic interest and value, and providing significant examples of architectual values of the past. RESOLUTION NO. 80- 86 '~ PAGE ~0 SECTION 3: The procedures set forth in Exhibit B, attached hereto and incorporated herein by this reference, are hereby adopted as the procedures for the selection and financing of rehabilitation projects pursuant to the Historical Rehabilitation Financing Program of the City of Santa Ana. Administration of the Historical Rehabilitation Financing Program shall be by the City Manager or such officer as may be designated by him (hereafter referred to as the Administrative Officer). 2. Any person who desires to obtain a long-term, low-interest loan for the purpose of rehabilitating a building within the Historical Rehabilitation Area to the Historical Rehabilitation Financing Program shall submit a rehabilitation proposal to the Administrative Officer. The proposal shall contain: (a) A description of the subject building. (b) A statement of the building's qualification to be designated as Historical Property under the standards set forth in section 30-2 of the Santa Ana Municipal Code. (c) The nature and extent of the rehabilitation work to be undertaken. (d) The amount of the loan desired. (e) The correct legal name of the current owner of the building. If the proponent is not the owner, a full explanation of the proponent's connection with the building will be required. (f) A description of present and proposed occupancy of the building, including the names of any tenants and a general description of the uses made of the building by the occupants. (g) Any other information which the Administrative Officer determines to be appropriate. 3. The Administrative Officer shall submit the proposal to the Citizens' Advisory Committee for its review and recommendations. 4. The Administrative Officer shall submit the proposal, together with his recommendations and those of the Citizens' Advisory Committee, to the City Council for a determination of whether the subject building should be entered into the Register of Historical Property pursuant to section 30-1 of the Santa Aha Municipal Code. In the event the City Council determines not to enter the building into the Register, no further proceedings shall be undertaken with respect to the proposal. The Proponent shall submit rehabilitation plans to the Administrative Officer, who shall coordinate review of said plans by the Director of Building Safety, the Planning Director, the Fire Chief, and the Director of Public Works, for the purpose of determining whether the proposal complies with the laws and regulations of the City of Santa Aha, or such conditions and modifications as are necessary to bring the proposal into compliance. 6. The proponent shall submit rehabilitation plans to a locally appointed architectural review board to achieve rehabilitation in conformance with the Secretary of the Interior standards for Rehabilitation of Historic Structures. 7. The Administrative Officer shall prepare a recommendation with respect to the granting a long-term, low-interest loan to the proponent, based upon the availability of funding, the relative priority of the proposed rehabilitation project, and the assurance of future repayment of the loan. In formulating his recommendations, the Administrative Officer may require the proponent to furnish him with any and all information necessary to assure compliance with the limitations set forth in Section 8, and such other terms and conditions as are necessary or appropriate. 8. If the Administrative Officer determines that the loan should be granted, he shall prepare a loan agreement with the proponent and submit the same, together with his recommendations, to the City Council for approval or disapproval. In accordance with the requirements of the Marks Historical Rehabilitation Act the loan agreement shall be subject to the following limitations: (a) Outstanding loans on the property to be rehabilitated, including the amount of the loans for rehabilitation, shall not exceed 80 percent of the anticipated after-rehabilitation value of the property. (b) The maximum repayment period for historical rehabilitation loans shall be 40 years or four-fifths of the economic life of the property, whichever is less. (c) No less than 90% of any loan for historical rehabilitation shall be used for historical rehabilitation, as defined in Section 37602(c) of the Health and Safety Code of the State of California.
