HomeMy WebLinkAbout80-100RESOLUTION NO. 80-100 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA SUPPORT- ING ASSEMBLY BILL 2376 WHEREAS, Revenue and Taxation Code Section 99(b) provides that municipal annexations shall not become effective until the governing bodies of all agencies, whose service areas or service responsibilities would be altered thereby, shall meet to determine the amount of property tax revenues to be exchanged between and among such affected agencies; and WHEREAS, the current procedure makes no provision which would permit the annexations to take effect in the event the affect- ed taxing agencies are unable to agree upon a tax revenue allocation; and WHEREAS, current law permits the County to impound all tax revenues until such negotiations are completed; and WHEREAS, the League of California Cities has sponsored AB 2376 (Lancaster) which authorizes the County Auditor to appor- tion property tax revenues according to a fixed formula based upon service responsibilities transferred to the successor agency in the event a negotiated agreement is not reached among the taxing agencies by September 1 of any year; and WHEREAS, AB 2376 would establish an expeditious manner to permit annexations to become effective in instances where the taxing agencies are unable or unwilling to negotiate an exchange of tax revenues. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL: That the City of Santa Ana does hereby support Assembly Bill 2376 and urges its passage. Be it further resolved that a certified copy of this resolution shall be forwarded to the Executive Director of the Orange County League of California Cities, each City in the County of Orange, and, all State Assemblymen in Orange County.
