HomeMy WebLinkAbout80-106REL:adg 6/10/80 RESOLUTION NO. 80-106 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA OVERRULING THE PLANNING COMMISSION'S DENIAL OF WAIVER 80-1, GRANTING SAID WAIVER, AND GRANTING APPEAL NO. 417 WHEREAS, a public hearing was duly held before the City Council of the City of Santa Ana on June 2, 1980, in the action taken by the Planning Commission in denying Waiver No. 80-1, which seeks to waive (1) the requirement for separate sewer connection facilities for each dwelling unit imposed by Section 34-313(e) of the Santa Ana Municipal Code, and (2) the requirement for separate meters for each dwelling unit, with respect to water service, imposed by Section 34-313(f) of the Santa Ana Municipal Code, in a condominium project located at 2500 West MacArthur Boulevard; and WHEREAS, prior to taking action on this Waiver, this Council has reviewed and considered and approved Negative Declaration, I.S. No. 80-52, for the project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana as follows: 1. That based on such public hearing and the oral and documentary evidence submitted therein, the City Council does hereby overrule the action of the Planning Commission denying Waiver No. 80-1, and grant Appeal No. 417, and grant said Waiver subject to the requirements hereinafter set forth. 2. Insofar as concerns the requirement for separate sewer facilities, said requirement is waived as necessary to allow the dwelling units to use common sewer lines both within and outside of the buildings to be developed for multi-family residential use. 3. Insofar as concerns the requirement for separate meters for water service, said requirement is waived subject to the condition that the project comply with the following alternative requirement prior to final approval of building permits, utility release, and occupancy: Seven (7) master meters shall be installed in accordance with City of Santa Ana's standard requirements for municipal water service, for the purpose of subsequent billing of water service charges by the City. Individual meters shall be installed, one for each dwelling unit, in such a manner as will allow the associated owners to allocate dues to pay for such charges in proportion to each dwelling unit's use of water. 4. In granting the abovesaid Waiver, the City Council finds and determines that imposition of the strict requirements of Section 34-313(e) and 34-313(f) of the Santa RESOLUTION NO. 80- 106 PAGE TWO Ana Municipal Code, rather than the substitute standards herein set forth, would impose a financial hardship on the subdivider which would be disproportionate to any public benefit which would thereby be attained.
